AN ORDINANCE CREATING A LIBRARY DEPARTMENT AND ESTABLISHING
A LIBRARY BOARD TO ASSIST IN IMPLEMENTING N~D CARRYING OUT
THE DUTIES AND FUNCTIONS OF SUCH LIBRARY; PROVIDING FOR TERMS
OF OFFICE AND QUALIFICATIONS OF SUCH BOARD MEMBERS; PRESCRIB-
ING THE AUTHORITIES AND DUTIES OF SUCH BOARD MEMBERS; PRO-
VIDING FOR BEQUESTS TO THE LIBRARY AND DECLARING AN EMERGENCY.
SECTION 1: A Public Library Department of the City
is hereby established and a Board for the Library Depart-
ment is hereby created. The Library Department shall
hereafter be known as the Wylie Public Library and said
Board shall hereafter be known as the Library Board of
the City.
SECTION 2: The Library Board of the City of Wylie
shall consist of five members, each of whom shall be a
resident citizen and qualified voter of the City of Wylie,
Texas and shall be appointed by the Mayor with the advice
and consent of the City Council. Said members shall hold
office for two years except that three of those first ap-
pointed shall hold office for the term of two years and
two other members shall hold office for a term of one
year, the term of each to be a determined lot, and there-
after their successor shall hold offiCe for two years and
until their successors are appointed. Upon the death,
resignation, removal or expiration of the term of office
of any member of the Library Board, the Mayor with the
advice and consent of the City Council shall appoint a
successor as a member of the Board who shall hold his mem-
bership for the unexpired term of the member he is appointed
to succeed or for the period of two years when the appoint-
ment is made due to the expiration of a Board Member's term.
In the event the best interest of the City requires the
removal of any member of the Board, his removal shall be
effected through appointment of a successor by unanimous
vote of the City Council.
The Board shall select from one of its members
a chairman to serve for a one year period. Said chair-
man shall be entitled to a vote on all matters.
The Mayor or his nominee with the advice and con-
sent of the Council shall be an ex-officio member of
said Board but shall not be entitled to a vote on said
Board.
SECTION 3: The Library Board is and shall consti-
tute an advisory board to the City Council with the
authority to hold hearings in the City and to consider
and to make recommendations to the City Council in writing
from time to time on any and all matters pertaining to
the City's Public Library system.
Such Board shall recommend one or more librarians
who shall be appointed by the Mayor with the advice and
consent of the City Council. The librarian shall have
charge of the library and reading rooms and be responsi-
ble for the care of the books and other library property;
classify ana arrange all books and literature and keep
the same catalogued according to such plans as may be
approved by the Board and to discharge such other duties
as may be prescribed by the Board; provided that in the
performance of the duties, the librarian shall not incur
debt of liability of any kind or character without express
authority from the Library Board and the City Council of
the City of Wylie. The Librarian shall be an Ex Officio
member of the Library Board without vote and shall serve
as Secretary of such Board.
The Board shall submit to the City Council in
writing on or before July 31st of each year a proposed
budget for the ensuing fiscal year beginning on October
1st.
In the event gifts or endowments are made for the
benefit of the Library such gift or endowment shall be
administered by the Library Board and shall become the
property of the Library and shall be used in the same
manner as any other property owned by the Library. All
gifts and endowments or bequests shall be accepted or
rejected on two-thirds (2/3rds) majority vote of the
City Council and all moneys so received shall be deposited
to the City of Wylie - Library Fund.
SECTION 4: The fact that the construction, ma~n-
tenance and operation of a Library shall be accomplished
within a limited period of time creates an emergency and
an imperative public necessity requiring the suspens~on
of the rules requiring ordinances to be read at three
(3) separate meetings be suspended, and said rule is
hereby accordingly suspended, and this ordinance shall be
in full force and take effect from and after its final
passage.
