Ordinance 1984-14 ORDINANCE 84- 14 AN ORDINANCE OF THE CITY OF WYLIE, TE%AS PROVIDING FOR AMENDMENTS TO ORDINANCE.84-12 WHICH ESTABLISHES VARIOUS FEES FOR THE CITY OF WYLIE. SPECIFICALLY AMENDING SECTION 3 PARAGRAPH D ESTABLISHING A NOT LATER THAN DUE AND PAYABLE TIME FOR IMPACT FEES; AMENDING SECTION 1 PARAGRAPA J SUB-PARAGRAPHS b AND d BY CHANGING THE FEE PER LIVING UNIT; PROVIDING A PENALTY CLAUSE; A SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. Whereas, the City Council of the City of Wylie has determined a need to amend the previous fee ordinance and adopt a different date for collection of impact fees and allow an effectire date for enforcement of this ordinance which grants builders and derelopers a brief period with which to accustom themsel~es to payment of such fees;~ and Whereas, with the implementation of the impact fee the tap fee and master meter development can be reduced; now Therefore, be it resol~ed by the City of Wylie, Texas that: The following amendment fees and charges are adopted by the City Council of the City of Wqlie, Texas changing said sections to read as follows: SECTION 3 - PARAGRAPH D These fees shall be due and payable not later than - or at the time of the issuance of a building permit, water and/or sewer tap requests, or the request for the pro~isions for water or sewer service and the actual connection to the existing system. These fees may be paid on individual construction projects or by de~elopment or phases of de~elopment. AI~~IENDING SECTION 1- WATER AND SEWER PARAGRAPH J SUB- PARAGRAPHS b, d. to read "$20.00 per living unit". PENALTY Any person, firm, corporation or other entity who is found guiltq of violating the terms of this ordinance shall be deemed guilty of a misdemeanor, and upon con~iction of any such ~iolation, shall be subject to a fine of not less than $1.G0 nor more than $200.00. SEVERABILITY All ordinances or parts of the ordinance in conflict herewith are specifically repealed and are superceded by this ordinance. All other parts of such ordinances are not repealed. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause~ sentence or section of this ordinance shall be declared unconstitutional or in~alid by any judgement or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the reraaining portions e~en though it had known the affected parts would be held unconstitutional. 1 EFFECTIVE DATE This ordinance and its amendments and the fees which it amends shall become effective on the first day of May, 1984.
