AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING
ORDINANCE NO. 2012-27 (2012-2013 BUDGET) AND APPROVING AN
APPROPRIATION OF FUNDS IN THE AMOUNT OF $55,000.00 TO THE
PARKS BUILDING FUND BUDGET AND APPROVING A DEPOSIT OF
$55,000 FROM THE WYLIE ADVOCATES FOR SENIOR ACTIVITES
(WASA) AS REVENUE INTO THE GENERAL FUND; PROVIDING FOR
A REPEALING, SAVINGS AND SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has
inve;stigated and determined that it will be beneficial and advantageous to the citizens of the City
of `JVylie, Texas ("W.ylie") to amend Ordinance No. 2012-27 (2012-2013 Budget) for the
pur��ose of remodeling the former Smith Public Library (800 Thomas St.) for use as a Wylie
Senior Center; and
WHEREAS, the WASA board of directors voted to grant to the City the sum of$55,000
for �the exclusive purpose of remodeling the former Smith Public Library for the use as a Wylie
Senior Center; and
WHEREAS, the remodel design and construction documents are complete and ready to
.�,., go out for bid when funding is available; and
WHEREAS, the current Wylie Senior Program has become too large and well attended
to ��e adequately served by the Community Center, the City desires to begin construction and
complete as much of the remodel as possible.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CI7�Y OF WYLIE, TEXAS:
SECTION 1: Findin sg Incorporated. The findings set forth above are incorporated into
the body of this Ordinance as if fully set forth herein.
SECTION 2: Amendment to Ordinance No. 2012-27 (2012-2013 Bud�. Ordinance
No. 2012-27 (2012-2013 Budget) is hereby amended to allow for the following appropriation:
"FijFty-Five Thousand dollars and 00/100 ($55,000) paid by WASA shall be deposited into
Revenue Account 100-4000-48440 (Contributions and Donations.); and
Fifty-five Thousand dollars and 00/100 ($55,000) shall be appropriated to Expense Account 100-
5511-58910 of the Parks Building Fund Budget.
SECTION 3: Savin sg / Repealing Clause. All provisions of any Ordinance in conflict
`�°` wit:h this Ordinance are hereby repealed; but such repeal shall not abate any pending prosecution
for violation of the repealed Ordinance, nor shall the repeal prevent prosecution from being

commenced for any violation if occurring prior to the repeal of the Ordinance. Any remaining
portians of conflicting Ordinances shall remain in full force and effect. �
SECTION 4: Severabilitv. Should any section, subsection, sentence, clause or phrase of
this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is
expressly provided that any and all remaining portions of this Ordinance shall remain in full
force and effect. Wylie hereby declares that it would have passed this Ordinance, and each
sectian, subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, or phrases be declared unconstitutional or invalid.
SECTION 5: Effective Date. This Ordinance shall become effective immediately upon its
passage.
