Ordinance 2015-13 ORDINANCE NO. 2015- 13 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE NO. 2014-30 (2014-2015 BUDGET) AND APPROVING AN APPROPRIATION OF FUNDS IN THE AMOUNT OF $102,911.47 FOR THE GENERAL FUND POLICE DEPARTMENT (POLICE ASSISTANT CHIEF POSITION) ; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it will be beneficial and advantageous to the citizens of the City of Wylie, Texas ("Wylie") to amend Ordinance No. 2014-30 (2014-2015 Budget) for the purpose of creating an Assistant Police Chief position, for the purpose of reducing command and control and creating a more effective and efficient management structure for the Department. WHEREAS, the estimated cost of creating the Assistant Police Chief position is One hundred two thousand nine hundred eleven dollars and forty seven cents ($102,911.47) ; and WHEREAS, the creation of the Assistant Police Chief position has become critical to the continued successful management of the Wylie Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE,TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Ordinance No. 2014-30 (2014-2015 Budget). Ordinance No. 2014-30(2014-2015 Budget) is hereby amended to allow for the following appropriation: Sixty three thousand five hundred twenty seven and ten cents ($63,527.10) shall be appropriated to Expense Account 100-5211-51110 of the General Fund Eleven hundred and seventy dollars ($1,170.00) shall be appropriated to Expense Account 100-5211-51160 of the General Fund Two thousand three hundred and forty dollars ($2,340.00) shall be appropriated to Expense Account 100-5211-51210 of the General Fund Eight hundred seventy seven dollars and fifty cents ($877.50) shall be appropriated to Expense Account 100-5211-51220 of the General Fund Ordinance No.2015-13 Approving An Appropriation Of Funds In The Amount Of$102,911.47 For The General Fund Police Department(Police Assistant Chief Position) Nine Thousand four hundred and thirty six dollars and fifty one cents (9,436.51) shall be appropriated to Expense Account 100-5211-51310 of the General Fund Nine Thousand three hundred seventeen dollars and fifty three cents (9,317.53) shall be appropriated to Expense Account 100-5211-51410 of the General Fund Three hundred sixty two dollars and ten cents ($362.10) shall be appropriated to Expense Account 100-5211-51420 of the General Fund Four thousand one hundred fifty eight dollars and twenty three cents ($4,158.23) shall be appropriated to Expense Account 100-5211-51440 of the General Fund Nine hundred seventy two dollars and forty nine cents ($972.49) shall be appropriated to Expense Account 100-5211-51450 of the General Fund Two hundred seventy dollars ($270.00) shall be appropriated to Expense Account 100-5211-51480 of the General Fund One thousand dollars ($1,000.00) shall be appropriated to Expense Account 100- 5211-56210 of the General Fund Three hundred and five hundred dollars ($3,500.00) shall be appropriated to Expense Account 100-5211-54810 of the General Fund Five thousand five hundred dollars ($5,500.00) shall be appropriated to Expense Account 100-5211- 52130 of the General Fund Four hundred eighty dollars (480.00) shall be appropriated to Expense Account 100-5211-56110 of the General Fund SECTION 3: Savings/ Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed; but such repeal shall not abate any pending prosecution for violation of the repealed Ordinance, nor shall the repeal prevent prosecution from being commenced for any violation if occurring prior to the repeal of the Ordinance. Any remaining portions of conflicting ordinances shall remain in full force and effect. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional or invalid. SECTION 5: Effective Date. This Ordinance shall become effective immediately upon its passage.
