ORDINANCE NO. 2008-12
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, REPEALING
ORDINANCE NO. 2005-64; ADOPTING THE 2006 EDITION OF THE
INTERNATIONAL RESIDENTIAL CODE, SAVE AND EXCEPT THE
DELETIONS AND AMENDMENTS SET FORTH HEREIN;
PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE; PROVIDING FOR REPEALING, SA VINGS AND
SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE OF THIS ORDINANCE; AND PROVIDING FOR THE
PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has
investigated and determined that it would be advantageous and beneficial to the citizens of the
City of Wylie, Texas ("Wylie") to repeal Wylie Ordinance No. 2005-64; and
WHEREAS, the City Council has investigated and determined that it would be
advantageous and beneficial to the citizens of Wylie to adopt the 2006 Edition of the
International Residential Code, save and except the deletions and amendments set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1: Findings Incorporated. The findings set forth above are incorporated into
the body of this Ordinance as if fully set forth herein.
SECTION 2: Ordinance No. 2005-64 Repealed. Wylie Ordinance No. 2005-64 is
repealed in its entirety and replaced by this Ordinance. The effective date of the repeal discussed
in this Section shall not occur until the effective date of this Ordinance at which time Ordinance
No. 2005-64 shall be repealed. Such repeal shall not abate any pending prosecution and/or
lawsuit or prevent any prosecution and/or lawsuit from being commenced for any violation of
Ordinance No. 2005-64 occurring before the effective date of this Ordinance.
SECTION 3: Adoption of the 2006 International Residential Code. The International
Residential Code, copyrighted by the International Code Council, Inc., save and except the
amendments set forth in Exhibit "A", attached hereto and incorporated herein for all purposes, is
hereby adopted as the Residential Code for Wylie, prescribing regulations applicable to
residential structures and constitutes minimum requirements and standards for residential
construction applications (the "2006 International Residential Code"). The 2006 International
Residential Code is made a part ofthis Ordinance as if fully set forth herein. One (1) copy of the
2006 International Residential Code is on file in the office of the City Secretary of Wylie being
marked and designated as the 2006 International Residential Code.
SECTION 4: Savings/Repealing Clause. All provisions of any ordinance in conflict with
this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not
abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal

prevent a prosecution from being commenced for any violation if occurring prior to the repeal of
the ordinance. Any remaining portion of conflicting ordinances shall remain in full force and
effect. A reference in any ordinance to an earlier or different version of a residential code is
hereby amended to refer to the 2006 International Residential Code as it is adopted herein or may
be subsequently amended.
SECTION 5: Penalty Provision. Any person, firm, corporation or entity violating this
Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
subject to a fine not to exceed the sum of TWO THOUSAND AND NOll 00 DOLLARS
($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate
offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from
filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it
pursuant to local, state and federal law.
SECTION 6: Severability. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason, held to be unconstitutional or invalid by a court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this
Ordinance. Wylie hereby declares that it would have passed this Ordinance, and each section,
subsection, clause or phrase thereof, irrespective of the fact that anyone or more sections,
subsections, sentences, clauses, and phrases be declared unconstitutional.
SECTION 7: Effective Date. This Ordinance shall become effective upon its passage and
publication as required by the City Charter and by law.

Amendments to the 2006 International Residential Code
The following sections, paragraphs, and sentences of the 2006 International Residential Code are hereby amended
as follows: Standard type is text trom the IRe. Underlined type is text inserted. Lined through type is deleted text
trom IRe. A double asterisk at the beginning of a section identifies an amendment carried over trom the 2003
edition of the code and a triple asterisk identifies a new or revised amendment with the 2006 code.
**Section RI02.4; change to read asfollows:
RI02.4 Referenced codes and standards. The codes. when specifically adopted. and standards referenced in this
code shall be considered part of the requirements of this code to the prescribed extent of each such reference.
Wheneyer amendments have been adopted to the referenced codes and standards. each reference to said code and
standard shall be considered to reference the amendments as well. Any reference made to NFP A 70 or the ICC
Electrical Code shall mean the Electrical Code as adopted.
Where differences occur between provisions of this code and referenced codes and standards, the provisions of this
code shall apply.

of the project.
Where temporary toilet facility is defined as a portable, fully enclosed, chemically sanitized toilet, which is accible
and services at least once a week..

for continuous ventilation. Ventilation air from the space shall be exhausted directly to the outside.
2. Bathrooms that contain only a water closet. lavatory or combination thereof may be ventilated with an
approved mechanical recirculating fan or similar device designed to remove odors from the air.

Carbon monoxide detector shall be installed in new dwelling units. The detector may be omitted where there are

address shall be placed on all new and existing buildings or structures in such a position as to be plainly visible and
legible form the street or road fronting the property and from all rear alleyways where said alleyways exist.

Automatic Sprinkler Systems. An automatic sprinkler system shall be installed in all new buildings 6,000 square

greater than 6,000 square feet which are enlarged. Only gross floor area within the exterior walls shall be used to
calculate the building area. A variance and/or waiver to this requirement shall be at the discretion & determination
made by the Fire Chief.

For 2.67 square feet (0.248 m2) of wall area. the following dimensions shall be adhered to:
1. When ties are placed on studs 16 in (407 mm) o.c.. they shall be spaced no further apart than 24 in (737 mm)
vertically starting approximately 12 in (381 mm) from the foundation.
2. When ties are placed on studs 24 in (610 mm) o.c.. they shall be spaced no further apart than 16 in (483 mm)

1102.1 Insulation and fenestration criteria. The building thermal envelope shall meet the requirements of Table
N 1102.1 based on the climate zone specified in Table N 110 1.2.
When compliance using Table 1102.1 is demonstrated with a ceiling R-yalue of R30 or less. no more than 33% of
the total projected ceiling area may be of cathedral type construction (ceiling ioist/roofrafter assembly) and the
required insulation R-value may be reduced to a minimum of R22 insulation when the remaining ceiling area
insulation is increased to R38.
(Reason: This amendment is compatible with the previous amendments increasing the number of builders who could
use the "simplified prescriptive" approach of the IRC and incorporates the Home Builder Association prescriptive
package proposal. The addition of "Ceiling Joist/Roof Rafter Assembly" requirements protect such assemblies from
the damage likely to occur if greater amounts of insulation were attempted in such assemblies.)

and free area of louvers and grilles are not known, it shall be assumed that wood louvers will have 25-percent free
area and metal louvers and grilles will have ~50-percent free area. Screens shall have a mesh size not smaller than
V. inch (6.4 mm). Nonmotorized louvers and grilles shall be fixed in the open position. Motorized louvers shall be
interlocked with the appliance so that they are proven to be in the full open position prior to main burner ignition

2. Ducts shall terminate in an unobstructed space allowing free movement of combustion air to the appliances.
3. Ducts shall serve a single enclosure.
4. Ducts shall not serve both upper and lower combustion air openings where both such openings are used.
The separation between ducts serving upper and lower combustion air openings shall be maintained to the
source of combustion air.
5. Ducts shall not be screened where terminating in an attic space.
6. Horizontal upper combustion air ducts shall not slope downward toward the source of combustion air.
7. The remaining space surrounding a chimney liner, gas vent, special gas vent or plastic piping installed
within a masonry, metal or factory-built chimney shall not be used to supply combustion air.
Exception: Direct-vent gas-fired appliances designed for installation in a solid fuel-burning fireplace

pressure range not to exceed 20 psi. ha-,te a range such tllat the Highest ead of the scale is not greater than five times
tho test pressure.
For welded piping. and for piping carrying gas at pressures in excess of fourteen (14) inches water column pressure
(3.48 kPa) (1/2 psi) and less than 200 inches of water column pressure (52.2 kPa) (7.5 psi), the test pressure shall not
be less than ten (10) pounds per square inch (69.6 kPa). For piping carrying gas at a pressure that exceeds 200
inches of water column (52.2 kPa) (7.5 psi). the test pressure shall be not less than one and one-halftimes the
proposed maximum working pressure.
(Reason: To provide for lesser pressures to coordinate with the use of more accurate diaphragm gauges.)
**Section G24l7.4.2; change to read asfollows:
G24l7.4.2 (406.4.2) Test duration. The test duration shall be held for a length of time satisfactory to the Code
Official, but in no case for be--oot less than -W-fifteen (15) minutes. For welded piping, and for piping carrying gas
at pressures in excess of fourteen (14) inches water column pressure (3.48 kPa). the test duration shall be held for a
length of time satisfactory to the Code Official, but in no case for less than thirty (30) minutes.
(Reason: To comply with accepted regional practices.)
**Add Section G2420.1.4 to read asfollows:
G2420.1.4 Valves in CSST installations. Shutoff valves installed with corrugated stainless steel (CSST) piping
systems shall be supported with an approved termination fitting, or equivalent support. suitable for the size of the
valves. of adequate strength and quality. and located at intervals so as to prevent or damp out excessive vibration but
in no case greater than 12-inches from the center of the yalye. Supports shall be installed so as not to interfere with
the free expansion and contraction of the system's piping. fittings. and valves between anchors. All valves and
supports shall be designed and installed so they will not be disengaged by movement of the supporting piping.
(Reason: To provide proper security to CSST valves. These standards were established in this region in 1999 when
CSST was an emerging technology.)
**Section G2421.1; add a second paragraph and exception to read asfollows:
Access to regulators shall comply with the requirements for access to appliances as specified in Section M1305.
Exception: A passageway or level service space is not required when the regulator is capable of being
serviced and removed through the required attic opening.

G2439.5.l (614.6.1) Maximum length. The maximum length of a clothes dryer exhaust duct shall not exceed 25
feet (7620 mm) from the dryer location to the outlet terminal with not more than two bends. When extra bends are
installed. the maximum length of the duct shall be reduced 2 1/2 feet (762 mm) for each 45-degree (0.79 rad) bend
and 5 feet (1524 mm) for each 90-degree (1.6 rad) bend that occur after the first two bends. measuring in the
direction of airflow.
Exception: Where the make and model of the clothes dryer to be installed is known and the manufacturer's
installation instructions for such dryer are provided to the code official, the maximum length of the exhaust
duct, including any transition duct, shall be permitted to be in accordance with the dryer manufacturer's
installation instructions. and provided that a 4 inch by 6 inch sign red in color with white letters is
permanently affixed to the structure stating the following:
Warning: Dryer must be approved for vent length not to exceed 40 feet Total Developed Length
(TDL).

(Reason: To make more consistent with regional practice. Dryer technology has improved to the point where a large
number of makes and models of dryers are capable of handling greater dryer vent length.)

G2445.2 (621.2) Prohibited use. One or more unvented room heaters shall not be used as the sole source of
comfort heating in a dwelling unit.
Exception: Existing approved unvented heaters may continue to be used in dwelling units. in accordance
with the code provisions in effect when installed, when approved by the Code Official unless an unsafe
condition is determined to exist as described in International Fuel Gas Code Section 108.7 of the Fuel Gas
Code.

vertical fixture drain. The return vent shall be connected to the horizontal drain through a wye-branch
fitting and shall. in addition. be provided with a foot vent taken off the vertical fixture vent by means of a
wye-branch immediately below the floor and extending to the nearest partition and then through the roof to
the open air or may be connected to other vents at a point not less than six (6) inches ( 152 mm) aboye the
flood level rim of the fixtures served. Drainage fittings shall be used on all parts ofthe vent below the floor
level and a minimum slope of one-quarter (1/4) inch per foot (20.9 mm/m) back to the drain shall be
maintained. The return bend used under the drainboard shall be a one (1) piece fitting or an assembly of a
forty-five (45) degree (0.79 radius), a ninety (90) degree (1.6 radius) and a forty-five (45) degree (0.79
radius) elbow in the order named. Pipe sizing shall be as elsewhere required in this Code. The island sink
drain. upstream of the return vent. shall serve no other fixtures. An accessible cleanout shall be installed in
the vertical portion of the foot vent.
(Reason: To clarify the installation of island venting and to provide a regional guideline on a standard installation
method for this region.)
