Ordinance 2008-12 ORDINANCE NO. 2008-12 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, REPEALING ORDINANCE NO. 2005-64; ADOPTING THE 2006 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE, SAVE AND EXCEPT THE DELETIONS AND AMENDMENTS SET FORTH HEREIN; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING, SA VINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the City of Wylie, Texas ("Wylie") to repeal Wylie Ordinance No. 2005-64; and WHEREAS, the City Council has investigated and determined that it would be advantageous and beneficial to the citizens of Wylie to adopt the 2006 Edition of the International Residential Code, save and except the deletions and amendments set forth below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Ordinance No. 2005-64 Repealed. Wylie Ordinance No. 2005-64 is repealed in its entirety and replaced by this Ordinance. The effective date of the repeal discussed in this Section shall not occur until the effective date of this Ordinance at which time Ordinance No. 2005-64 shall be repealed. Such repeal shall not abate any pending prosecution and/or lawsuit or prevent any prosecution and/or lawsuit from being commenced for any violation of Ordinance No. 2005-64 occurring before the effective date of this Ordinance. SECTION 3: Adoption of the 2006 International Residential Code. The International Residential Code, copyrighted by the International Code Council, Inc., save and except the amendments set forth in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby adopted as the Residential Code for Wylie, prescribing regulations applicable to residential structures and constitutes minimum requirements and standards for residential construction applications (the "2006 International Residential Code"). The 2006 International Residential Code is made a part ofthis Ordinance as if fully set forth herein. One (1) copy of the 2006 International Residential Code is on file in the office of the City Secretary of Wylie being marked and designated as the 2006 International Residential Code. SECTION 4: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal Ordinance No. 2008-12 Repealing Ordinance No. 2005-64; Adopting the 2006 Edition of the International Residential Code Ordinance Page I 510792.vl prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portion of conflicting ordinances shall remain in full force and effect. A reference in any ordinance to an earlier or different version of a residential code is hereby amended to refer to the 2006 International Residential Code as it is adopted herein or may be subsequently amended. SECTION 5: Penalty Provision. Any person, firm, corporation or entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine not to exceed the sum of TWO THOUSAND AND NOll 00 DOLLARS ($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 6: Severability. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason, held to be unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional. SECTION 7: Effective Date. This Ordinance shall become effective upon its passage and publication as required by the City Charter and by law. Screens shall have a mesh size not smaller than V. inch (6.4 mm). Nonmotorized louvers and grilles shall be fixed in the open position. Motorized louvers shall be interlocked with the appliance so that they are proven to be in the full open position prior to main burner ignition and during main burner operation. Means shall be provided to prevent the main burner from igniting ifthe louvers fail to open during burner start-up and to shut down the main burner if the louvers close during operation. (Reason: This is the generally accepted practice in the region, consistent with amendment to IFGe.) ***Section 2407.11; change Exception 8 to read asfollows: G2407.11 (304.11) Combustion air ducts. Combustion air ducts shall comply with all of the following: Ordinance No. 2008-12 Repealing Ordinance No. 2005-64; Adopting the 2006 Edition of the International Residential Code Ordinance Page 18 510792.vl 1. Ducts shall be constructed of galvanized steel complying with Chapter 16 or of a material having equivalent corrosion resistance, strength and rigidity. Exception: Within dwellings units, unobstructed stud and joist spaces shall not be prohibited from conveying combustion air, provided that not more than one required fireblock is removed. 2. Ducts shall terminate in an unobstructed space allowing free movement of combustion air to the appliances. 3. Ducts shall serve a single enclosure. 4. Ducts shall not serve both upper and lower combustion air openings where both such openings are used. The separation between ducts serving upper and lower combustion air openings shall be maintained to the source of combustion air. 5. Ducts shall not be screened where terminating in an attic space. 6. Horizontal upper combustion air ducts shall not slope downward toward the source of combustion air. 7. The remaining space surrounding a chimney liner, gas vent, special gas vent or plastic piping installed within a masonry, metal or factory-built chimney shall not be used to supply combustion air. Exception: Direct-vent gas-fired appliances designed for installation in a solid fuel-burning fireplace where installed in accordance with the manufacturer's instructions. 8. Combustion air intake openings located on the exterior of a building shall have the lowest side of such openings located not less than 12 inches (305 mm) vertically from the adjoining grade level or the manufacturer's recommendation. whichever is more stringent. (Reason: To recognize the manufacturer's installation requirements, consistent with amendment to IFGe.) **Section G2408.3; delete. (Reason: This provision does not reflect standard practice in this area.) ***Section G2408.4; change to read asfollows: G2408.4 Clearances from grade. Equipment and appliances installed at grade level shall be supported on a level concrete slab or other approved material extending a minimum of3 inches (76 mm) above adjoining grade or shall be suspended a minimum of6 inches (152 mm) above adjoining grade. (Reason: Consistent with current local practice. For piping carrying gas at a pressure that exceeds 200 inches of water column (52.2 kPa) (7.5 psi). the test pressure shall be not less than one and one-halftimes the proposed maximum working pressure. (Reason: To provide for lesser pressures to coordinate with the use of more accurate diaphragm gauges.) **Section G24l7.4.2; change to read asfollows: G24l7.4.2 (406.4.2) Test duration. The test duration shall be held for a length of time satisfactory to the Code Official, but in no case for be--oot less than -W-fifteen (15) minutes. Shutoff valves installed with corrugated stainless steel (CSST) piping systems shall be supported with an approved termination fitting, or equivalent support. suitable for the size of the valves. of adequate strength and quality. and located at intervals so as to prevent or damp out excessive vibration but in no case greater than 12-inches from the center of the yalye. Supports shall be installed so as not to interfere with the free expansion and contraction of the system's piping. fittings. and valves between anchors. All valves and supports shall be designed and installed so they will not be disengaged by movement of the supporting piping. (Reason: To provide proper security to CSST valves. These standards were established in this region in 1999 when CSST was an emerging technology.) **Section G2421.1; add a second paragraph and exception to read asfollows: Access to regulators shall comply with the requirements for access to appliances as specified in Section M1305. Exception: A passageway or level service space is not required when the regulator is capable of being serviced and removed through the required attic opening. (Reason: To require adequate access to regulators.) **Section G2439.5; add a sentence to read asfollows: The size of duct shall not be reduced along its developed length nor at the point of termination. When extra bends are installed. the maximum length of the duct shall be reduced 2 1/2 feet (762 mm) for each 45-degree (0.79 rad) bend and 5 feet (1524 mm) for each 90-degree (1.6 rad) bend that occur after the first two bends. measuring in the direction of airflow. Exception: Where the make and model of the clothes dryer to be installed is known and the manufacturer's installation instructions for such dryer are provided to the code official, the maximum length of the exhaust duct, including any transition duct, shall be permitted to be in accordance with the dryer manufacturer's installation instructions. and provided that a 4 inch by 6 inch sign red in color with white letters is permanently affixed to the structure stating the following: Warning: Dryer must be approved for vent length not to exceed 40 feet Total Developed Length (TDL). Duct Size: (Number) Total Developed Length: (Number) (Reason: To make more consistent with regional practice. Dryer technology has improved to the point where a large number of makes and models of dryers are capable of handling greater dryer vent length.) **Section G2445.2; change to read asfollows: G2445.2 (621.2) Prohibited use. One or more unvented room heaters shall not be used as the sole source of comfort heating in a dwelling unit. Exception: Existing approved unvented heaters may continue to be used in dwelling units. in accordance with the code provisions in effect when installed, when approved by the Code Official unless an unsafe condition is determined to exist as described in International Fuel Gas Code Section 108.7 of the Fuel Gas Code. Drainage fittings shall be used on all parts ofthe vent below the floor level and a minimum slope of one-quarter (1/4) inch per foot (20.9 mm/m) back to the drain shall be maintained. The return bend used under the drainboard shall be a one (1) piece fitting or an assembly of a forty-five (45) degree (0.79 radius), a ninety (90) degree (1.6 radius) and a forty-five (45) degree (0.79 radius) elbow in the order named. Pipe sizing shall be as elsewhere required in this Code. The island sink drain. upstream of the return vent. shall serve no other fixtures. An accessible cleanout shall be installed in the vertical portion of the foot vent.
