ORDINANCE NO. 2005-16
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING
THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
WYLIE, AS HERETOFORE AMENDED, SO AS TO CHANGE THE
ZONING ON THE HEREINAFTER DESCRIBED PROPERTY,
ZONING CASE NUMBER 2005-07, TO PLANNED DEVELOPMENT
(PD) DISTRICT FOR COMMERCIAL USES AND SIGN
PROGRAM; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City
of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the
amendment of the Comprehensive Zoning Ordinance, have given the requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair hearing to
all property owners generally and to owners of the affected property, the governing body of the
City is of the opinion and finds that the Comprehensive Zoning Ordinance and Map should be
amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the same
is hereby, amended by amending the Zoning Map of the City of Wylie, to give the hereinafter
described property a new zoning classification of Planned Development (PD) District for single-
family residential uses, said property being described in Exhibit "A", Exhibit "B" and Exhibit
"c" attached hereto and made a part hereof for all purposes.
SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance be, and
the same are hereby, repealed and all other ordinances of the City not in conflict with the
provisions of this ordinance shall remain in full force and effect.
SECTION 3.
That the above described property shall be used only in the manner and for the purposes
provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the
granting of this zoning classification.

SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be
subject to the general penalty provisions of Section 1.5 of the Zoning Ordinance, as the same
now exists or is hereafter amended.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance
be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so declared to be
invalid, illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning
Ordinance as a whole.
SECTION 6.
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION 7.
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall
not be construed as abandoning any action now pending under or by virtue of such ordinance;
nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing
or to accrue, nor as effecting any rights of the municipality under any section or provisions of
any ordinances at the time of passage of this ordinance.

WHEREAS The City of Wylie Economic Development Corporation is the owner of a tract or
parcel ofland situated in the City of Wylie, Collin County, Texas, being part of the S.B. Shelby
Survey Abstract Number 820, being all of Lot 8 and part of Lots 9 and 10, Block A of Wylie
Industrial Park, an addition to the City of Wylie according to the plat thereof recorded in Volume
8, Page 55 of the Map Records of Collin County, Texas and being all of those certain portions of
Cooper Drive right-of-way described as "Parcel 1" and "Parcel 4" abandoned by City of Wylie
Ordinance Number 2004-40 recorded under County Clerk's File Number 2004-0182264, Deed
Records of Collin County, Texas and being all of that tract of land described in deed to Wylie
Economic Development Corporation recorded in Volume 4572, Page 3563 of the Deed Records
of Collin County, Texas and also being all of that tract of land described in deed to Wylie
Economic Development Corporation recorded in Volume 5815, Page 2219 of the Deed Records
of Collin County, Texas and being more particularly described as follows:
BEGINNING at a \Iz inch iron rod with cap stamped "LONE STAR" set for corner in the
northwesterly right-of-way line of State Highway Number 78 (a variable width right-of-way)
said iron rod being the most southerly corner of said Wylie Economic Development Corporation
tract (Volume 5815, Page 2219) and being the northeasterly corner of Lot 3R, Block A of the
Replat of 78 Corner Addition, Lots 2Rl & 3R, Block A, an addition to the City of Wylie
according to the plat thereof recorded in Volume P, Page 296 of the Plat Records of Collin
County, Texas
THENCE North 83033'00" West, along the southerly line of said Wylie Economic
Development Corporation tract (Volume 5815, Page 2219), passing at 77.86 feet westerly corner
of said tract and the southerly corner of said Lot 8 and along the northerly line of said Lot 3R and
the southerly line of said Lot 8 and Wylie Economic Development Corporation tract (Volume
4572, Page 3563), in all, a total distance of 217.87 feet to a \Iz inch iron rod found for corner at
the common southerly corner of said Lot 8 and Lot 7 of said addition, said iron rod also being in
the northerly line of said Lot 3R and the southwesterly corner of said Wylie Economic
Development Corporation tract (Volume 4572, Page 3563);
THENCE North 06027'00" East along the common line of said Lots 7 and 8 and along the

3563), passing at 200.00 feet the common northerly corner of said Lots 7 and 8 and the

terminus of said Cooper Drive right-of-way and a westerly line of said Wylie Economic

THENCE in a northwesterly direction along said curving easterly terminus of Cooper Drive
right-of-way and a westerly line of said Wylie Economic Development Corporation tract and
along a curve to the left whose chord bears North 20056'22" West, 50.00 feet, having a radius of
50.00 feet, a central angle of 60000' 18" and an arc length of 52.36 feet to an "X" cut in concrete
set for corner, being the southerly corner of said "Parcel 4";
THENCE South 68021 '44" West leaving said easterly terminus and along the southerly line of
said "Parcel 4" a distance of 10.66 feet to an "X" in concrete set at the beginning of a curve the
right;
THENCE in a westerly direction along said southerly line of "Parcel 4" and along said curve to
the right whose chord bears South 71057'20" West, 15.67 feet, having a radius of 125.00 feet, a
central angle of 070 11' 14" and an arc length of 15.68 feet to an "X" cut in concrete set for corner
and being South 12014'00" West along the southerly projection of the common line of said Lots
10 and 11 a distance of 19.22 feet from the common southerly corner of said Lots 10 and 11;
THENCE North 12014'00" East passing said common southerly corner and along the common

and 11 and the most northerly northwesterly corner of said Wylie Economic Development

THENCE in a easterly and northeasterly direction along said D.A.R.T. right-of-way and the
northerly line of said addition and said Wylie Economic Development Corporation tract and
along a curve to the left whose chord bears North 72058'15" East, 417.07 feet, having a radius of
1538.24 feet, a central angle of 15034'58", passing at 160.00 feet the northeasterly corner of said
Lot 10 and continuing a total arc length of 418.36 feet to a lf2 inch iron rod with cap stamped
"LONE STAR" set for corner at the northwesterly corner of that tract of land described in deed
to Mary Genene Hughes recorded in Volume 3997, Page 0865 of the Deed Records of Collin
County, Texas and being the northeasterly corner of said Wylie Economic Development
Corporation tract;
THENCE South 20048'20" East along the common line of said Wylie Economic Development
Corporation and Hughes tract, passing the southerly corner of said Hughes tract, the easterly
corner of said Wylie Economic Development Corporation tract (Volume 4572, Page 3563) and

"LONE STAR" set for corner in said northwesterly right-of-way line of State Highway Number
78, being the easterly corner of said Wylie Economic Development Corporation tract (Volume
5815, Page 2219) and the southerly corner of said Collin County, Texas remainder tract;
THENCE South 49059'51" West along the northeasterly line of said State Highway Number 78
and the southeasterly line of said Wylie Economic Development Corporation tract (Volume
5815, Page 2219) a distance of 511.41 feet to the POINT OF BEGINNING and containing
252,717 square feet or 5.802 acres ofland.

Conditions to the Planned Development Zoning District
404 South Highway 78
General Conditions:
1. The Purpose of this Planned Development (PD) District is to allow for off-
premIse slgnage.
2. This PD District request shall not affect any regulation found within the Code of
Ordinances, unless specifically provided herein.
3. All regulations of the existing Corridor Commercial (CC) District set forth in
Section 4.2.B of the Zoning Ordinance (as adopted February 27, 2002) are
included by reference and shall apply except as specifically provided herein.
Special Conditions:
1. The following uses shall be permitted as a function of the PD:
a. All uses allowed within the existing CC District; and
b. Off-premise signage shall be allowed under the following conditions:
1. A single entity (i.e. Baylor Healthcare System) 10cated on Lot 4, as
referenced on Exhibit "C", will be allowed to have signage on all
or part of a monument sign located on Lot 1.
11. Any business enterprise occupying all or part of Lot 1 will be
allowed to have signage on all or part of a monument sign located
on Lot 1, Lot 2, or Lot 3 with the condition that said enterprise can
only have signage on one (1) monument sign located on either of
Lots 1,2, or 3.
m. Any business enterprise occupying all or part of Lot 2 will be
allowed to have signage on all or part of a monument sign located
on Lot 1, Lot 2, or Lot 3 with the condition that said enterprise can
only have signage on one (1) monument sign located on either of
Lots 1,2, or 3.
IV. Any business enterprise occupying all or part of Lot 3 will be
allowed to have signage on all or part of a monument sign located
on Lot 1, Lot 2, or Lot 3 with the condition that said enterprise can
only have signage on one (1) monument sign located on either of
Lots 1,2, or 3.
