Ordinance 1980-09 ORDINANCE NO. fo-o 1 AN ORDINANCE PROVIDING FOR ANNEXATION OF THE 1.5 ACRE TRACT OF LAND UPON WHICH THE CITY OF WYLIE WILL INSTALL AN ELEVATED WATER TANK; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EFFECTIVE DATE. WHEREAS, State Law authorizes cities to annex property upon which water utilities facilities are constructed and WHEREAS, the City of Wylie desires to annex the elevated water tank site which is located adjacent to present city limits, NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the 1.5 acre tract of land described as follows is hereby annexed to and made an itegral part of the City of Wylie, Texas: Being a tract of land situated in Collin County, Texas, on Old Highway No. 78, South of Wylie, and being a part of the Allen Adderberry Survey, Abstract No. 23, and being a part of a tract of land conveyed to Marvin K. Collie by Nancy Morris Collie by deed recorded in Volume 534, Page 223, of the Deed Records of Collin County, Texas, and also described in deed conveying 25 per cent undivided interest to C. Truett Smith as recorded in Volume 489, Page 297 of the Deed Records of Collin County, Texas, and being a part of a tract of land conveyed to Good Financial Corporation, Trustee by deed recorded in Volume 820, page 47, of the Deed Records of Collin County, Texas, and being more particularly described as follows: BEGINNING at a point for corner in the easterly right-of-way line of Old Highway No. 78 (30 teet from centerline), said point being 30.00 feet North 89 551 East and 1522.47 feet North from the Southwest corner of said Allen Adderberry Survey; THENCE North 220.00 feet along said easterly right-of-way line of Old Highway No. 78 to a point for corner in the North line of said Marvin K. Collie tract; THENCE North 890 501 East 297.00 feet along the North line of said Marvin K. Collie tract to a point for corner; THENCE South 220.00 feet to a point for corner; THENCE South 890 501 West 297.00 feet to the POINT OF BEGINNING and containing 65,340 square feet, more or less, or 1.5000 Acres As recorded in Volume 1053, Page 878 in Collin County Deed Records. SECTION 2. In the event any provision of this ordinance is declared invalid by a court of competant jurisdiction the same shall not affect the remaining provisions thereof. SECTION 3. That this ordinance shall take effect upon its adoption and that notice of such adoption shall be published one time in the official publication of the City.
