Ordinance 1980-14 ORDINANCE NO. g 0- I tf AN ORDINANCE AMENDING ORDINANCE NUMBER 71-11 PRE- SCRIBING RULES AND REGULATIONS GOVERNING PLATS, PLANS AND SUBDIVISIONS OF LAND WITHIN THE CORPORATE LIMITS OF THE CITY OF WYLIE, TEXAS, OR WITHIN ITS JURISDICTION; AMENDING SEVERAL SECTIONS OF THE ABOVE ORDINANCE BE ADDITIONS TO VARIOUS SEC- TIONS OF THE ORDINANCE; AND BY DELETION OF CERTAIN REGULATIONS FROM THE ABOVE ORDINANCE; PROVIDING FOR A PENALTY OF NOT MORE THAN TWO HUNDRED DOLLARS ($200.) FOR EACH VIOLATION THEREOF; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. SECTION 1. Section 9-14-2 is hereby amended by adding to paragraph (E), 2. "The Planning Commission and City Council shall act on the preliminary plat within thirty days from the date such plat was filed with each body for their approval." SECTION 2. Section 9-14-2: the following sentence shall be added to paragraph (E), 4. "The Planning Commission and City Council shall act on the final plat within thirty days from the date such plat was filed with each body for their approval." SECTION 3. Section 9-14-5: the following sentence will be inserted after the end of the first sentence of the first para- graph: "The Planning Commission and the City Council shall act on the final plat within thirty days from the date such plat was filed with each body for their approval." SECTION 4. Section 9-14-6: General plat requirements, shall be amended to read as follows: a. Paragraph (A), 11. "Major street right-of-way widths shall be as shown on the City's Thoroughfare Plan. The minimum width of a median between through traffic lanes shall be fifteen feet face to face of curbs, and the minimum width of a median adjacent to a left turn lane shall be five feet. Residential and minor streets shall have a minimum pavement width of twenty-six feet (face to face of curbs) and a right- of-way width of fifty-feet." Page 1 "Collector streets, especially around schools shall be a minimum of thirty-six feet in pavement width on sixty feet of right-of-way. Collector streets shall be located about half way between parallel major thoroughfares and not to exceed approximately one-half mile away from a major thorough- fare or in another collector street." "Collector streets which are continous and straight in align- ment shall have a minimum pavement width of forty feet on sixty feet of right-of-way." "Streets in industrial areas shall have a minimum of forty- four feet in pavement width on sixty-four feet of right-of- way minimum." b. Paragraph (B), 1. Shall be amended to read: "Alleys shall be provided in commercial and industrial districts, and shall be paved with reinforced concrete", except that the City may waive this requirement where other definite and assured provision is made for service access, such as off- street loading, unloading, and parking consistent with and adequate for the uses proposed." c. Paragraph (B), 2.\IAlleys shall be provided in all reSl- dential areas, and shall be paved with reinforced concrete". d. Paragraph (B), 3. Shall read as follows: "The minimum width of an alley shall be twenty feet in an industrial and commercial areas and fifteen feet in residential. Alley turn- outs shall be paved to the property line and shall be at least ten feet wide face to face of curbs at that point. Paving radius where alleys intersect thoroughfares shall be ten feet and shall be five feet at intersection with all other streets." e. Paragraph (B), 6. Shall read as follows: "Alley paving shall be a minimum of ten feet wide in residential areas and sixteen feet wide in commercial and industrial areas." 5. Section 9-l4~7: Improvements a. Paragraph (B), 1. Shall read as follows: "1. Concrete Paving: All streets thoroughfares, alley's, driveway's and turn-outs shall be paved with concrete, properly and contin- uously reinforced, with integral curbs." Page 2 b. Paragraph (B), 2. Shall read as follows: "a. Residential Street and Alley Paving All residential streets and alleys shall be paved with a six-inch thickness of three thousand pounds p.s.i. reinforced concrete pavement, with a six-inch thick lime stabilized base where the subbase material has a plasticity index of twelve or higher. b. Collectors Streets and Commercial or Industrial Alley Paving All collector streets, and alleys in commercial or industrial areas, shall be paved with a six-inch thickness of three thousand five hundred pounds p.s.i. reinforced concrete pavement, with a six-inch thick lime stabalized base where the subbase material has a plasticity index of twelve or higher. c. Thoroughfare Paving All thoroughfares shall be paved with an eight-inch thickness of three thousand five hundred pounds p.s.i. reinforced concrete pavement, with a six-inch thick lime stabalized base where the subbase material has a plasticity index of twelve or higher." c. Paragraph (D), 3.b. Section 9-l4-10: Other requirements, (A) changes and variations, shall be amended by the addition of the fol- lowing sentence at the end of paragraph (A): "The Wylie Zoning ordinance provides for separation of residential areas from commercial or industrial areas by the erection of a sight barrier fence up to six feet in height. The final plat for a proposed subdivision, in cases where there will be a separa- tion of residential property from commercial or industrial property, shall indicate upon the final plat the location and height of proposed fences to be installed." SECTION 7. Any person, firm or corporation who shall violate any of the provisions of this ordinance or who shall fail to comply with any provision hereof shall be guilty of a mis- demeanor and, upon conviction, shall be subject to a fine not to exceed two hundred dollars, and each day that such violation continues shall constitue a separate offense and shall be punishable accordingly. SECTION 8. All ordinances or parts of ordinances inconsis- tent with or in conflict herewith are hereby repealed. SECTION 9. If any section or part of any section, paragraph or clause of this ordinance is declared invalid or unconsti- tutional for any reason, such declarations shall not be held to invalidate or impair the validity, force or effect of any other section or subsections, part of section, paragraph or clause of this ordinance.
