Ordinance 1983-09 ORDINANCE NO. ff3 -1 AN ORDINANCE ABANDONING THE SHORT SECTION OF ALLEY RUNNING NORTH AND SOUTH BETWEEN JACKSON AND BIRMINGHAM STREETS AND BETWEEN CALLOWAY AND HIGHWAY 78; RESERVING THE ALLEY AS A UTILITY EASEMENT; AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR SURFACE RIGHTS TO THE ALLEY; CONTAINING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That, in accordance with Article 1016, Vernon's Texas Civil Statutes, the alley lying in a north-south direction between Jackson and Birmingham Streets and Calloway and State Highway 78, be and it is hereby abandoned, for purposes of public right-of-way use a san a 11 ey. SECTION 2. That the Mayor be, and he is hereby authorized, to execute a quitclaim deed to the adjacent and abutting property owner or owners of this alley for purposes of surface use only. SECTION 3. That the City hereby retains jurisdiction of said alley for purposes and uses necessary as a utility easement, thereby continuing the maintenance, repair and operation of public utilities within said alley, both beneath ground level and in the air above the ground. SECTION 4. That a certified copy of this ordinance be filed in the office of City Secretary and in the office of County Clerk at the Court House in McKinney, Texas. SECTION 5. That the cost of preparation of any quitclaim deed which may be executed by the Mayor, be paid for by the abutting property owner or owners.
