AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS
HERETOFORE AMENDED (ORDINANCE NO. 81-5), TO CHANGE THE ZONING ON THE
HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN
STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE
SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the
granting of zoning changes under the zoning ordinance and zoning map, have given
requisi te notices by publication and otherwise, and after holding due hearings and
affording a full and fair hearing to all property owners generally, the said Governing
Body is of the opinion that said change of zoning which is on application of Melvin
St. John should be granted and the Comprehensive Zoning Ordinance of the City of
Wylie should be amended in the exercise of its legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie,
Texas, be and the same is hereby amended by amending the Zoning Map of the City
of Wylie, to give the hereinafter described property a new zoning district classification,
to-wit:
"MH" Mobile Home District

Said property being described as follows:
A tract of land located 230 feet South of RICHARD D. NEWMAN SURVEY,
ABSTRACT NO. 660 and 230 feet South of centerline of Public Road and
on the \.Jest side of Branch of Muddy Creek South of the City of Hyl ie
Sewer Treatment Plant and being a part of a 84.803 acre tra~t and a
part of a 43.401 acre tract and being more particularly described as
follows:
COMMENCING at the Northeast corner of said 43.401 acre tract in the
North line of said A-660 in the centerline of Public Road at its
intersection with Branch of Muddy Creek; Thence South 2 deg. 47 min.
West with said creek branch, 171.70 feet to point for corner; Thence
South 17 deg. 03 min. West with said creek 60.75 feet to Place of
Beginning;
THENCE North 89 deg. 00 min. West parallel to centerline of
County Road and survey line, 1162.84 feet to point for corner;
THENCE North 85 deg. 15 min. West parallel to the centerline of
Public Road 659.48 feet to point for corner on the West line of
said 43.401 acre tract, said point being located Southerly
230 feet from centerline of said Public Road;
THENCE South with the West line of said 43.401 acre tract 1081.83
feet to the Southwest corner of said 43.401 acre tract for corner;
THENCE South 88 deg. 45 min. East with South line of said 43.401
acre tract, 1278.90 feet to iron stake for corner;
THENCE North 0 deg. 56 min. East with the East line of said
43.401 acre tract 279.69 feet to point in creek for corner;
THENCE Northwesterly with the meanderings of a Branch of Muddy
Creek and the East line of said 43.401 acre tract as follows;
1. North 37 deg. 10 min. East 588.32 feet;
2. North 42 deg. 17 min. East 154.75 feet;
3. North 30 deg. 38 min. East 98.90 feet;
4. North 17 deg. 03 min. East 90.76 feet to the
Place of Beginning, and containing 36.39 acres of land,
more or less.
SECTION 2. That all ordinances of the City in conflict with the provision of
this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions ;of this oroinance--shall remain in full force and
effect.
SECTION 3. That the -above described property shall be used only in the manner
and for the purposes provided for in the Comprehensive Zoning Ordinance of the City,
as amended herein by the granting of this zoning classification.
SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid,
the same shall not affect the validity of this ordinance as a whole or any part or
provision thereof other than the part so decided to be invalid, illegal or unconsti tutional
and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole.
SEC TION 5. That any person, firm or corporation violating any of the provisions
or terms of this ordinance shall be subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction
shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for
each offense, and that each day such violation shall continue to exist shall consti tute
a separate offense.
SECTION 6. It is necessary to give the property described herein the above
mentioned zoning classification in order to permit its proper development and in order
to protect the public interest, comfort and general welfare of the City. Therefore,
this ordinance shall take effect immediately from and after its passage and publication
of its caption, as the law in such cases provides.
