Ordinance 1983-24 51.160 ORDINANCE NO. g----3;<1 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDIMG ~,-'7 rl~l ,',: 512 THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO. 81-5), TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF~HIS ORDINhNCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the City Council of the City of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordi~~nce and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that the said change of zoning which is on application of HAROLD SPENCE should be granted and the Comprehensive Zoning Ordinance of the City of Wylie should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be and the same is hereby amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described property a new zoning district classification to-wit: SF-2 / OAKS NO. 4 ADDITION Said property being described as follows: WHEREAS, HAROLD SPENCE, is the owner of a tract of land situated in the Francisco de la Pina Survey, Abstract Number 688, Collin County, Texas, and being all of the land conveyed to Harold Spence by deeds recorded in 'Volume 1639, Page 606 and Volume 1639, Page 932 of the Deed Records of Coll in County, Texas and being more particularly described as follows: BEGINNING ata point for corner in the Southerly right-of-way line of Old Hwy. No. 78 t701 R.O.W.), said point being the Northeasterly corner of Lot 2, block B of Oaks Addition No.1, an additi'on to tne Ci'ty of Wylie, according to the plat recorded in Cabinet uCu, Page 420 of tne Plat Records of Collin County, Texas; THENCE, South 89041~51'' East, along the S'outherly rtght-of-way line of Old Hwy. No. 78, a distance of 553.69 feet te a point for corner; THENCE, South 000 05' 02\1 East, a distance of 1370.72 feet to a poi,nt for corner in the Northerly line of Rush Creek Estates, an addttion to the Ci.'ty of WYlie; THENCE, South 760 311 51\1 West, along said Northerly line, a distance of 324.87 feet to a point for corner; THENCE, North 770 17' 1011 West, a distance of 112.42 feet to a_point for corner; THENCE, North 670 39' 15\1 West, a distance of 115.09 feet to a point for corner; THENCE, North 860 44' 15\1 West, a distance of 34.04 feet to a point for corner, said point being the Southeasterly corner of Oaks Addition No.2, an addition to th e City of Wyl ie according to the plat recorded in Cabinet I'C", Page 489 of the Plat Records of Collin County, Texas; , THENCE, North 000 251 45" East, a'long the Easterly addition line of Oaks Addition A '"", tr. ,-'l 5'" ...' 1'(li 'J " ," '~'. ..... No. and continuing along the addition line of Oaks Addition No.1, a distance of 1378.91 feet to the point of beginning and containing 18.145 acres of land, more or less. (790.409 sq. ft.) . That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as hereto- fore amended, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper develop- ment and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides.
