Ordinance 1983-47 / ,I ORDINANCE NO. /i 3-1//'1 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO. 81-5), TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. \.JHEREAS, the Ci ty Zoni ng Commi ss i on and the City Council of the Ci ty of Wyl ie, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zonini'ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that the said change of zoning which is on application of C. T. Bp-r.kham should be granted and the Comprehensive Zoning Ordinance of the City of Wylie should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be and the same is hereby amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described property a new zoning district classification to-wit: SF-?- Sin~le Fa~ily (Wyndham Estates) Said property being described as follows: BEING a tract of land in the Francisco de la Pina Survey, Abstract No. 688, situated in the City of Wylie, Collin County, Texas, and also being a part of that certain 186.10 acre tract of land conveyed to Arapaho East, Inc. by W.T. Beckham by deed recorded in Volume .1032, Page 225 of the Deed Records of Collin County, Texas, and being more particularly describeo as follows: BEGINNING at 8 point on the West right-of-way line of Kreymer Lane, said point being North 0 05' West 185.0 feet from the centerline of Old Highway No. 78; THENCE North 89037' West, 690.0 feet; THENCE NORTH, 296.81 feet; THENCE WEST, 1015.27 feet; THENCE NORTH, 664.78 feet to a point on a North line of the 186.10 acre tract; THENCE North 890561 East along said line of the 186.10 acre tract, 186.25 feet to an angle point; THENCE South 890581 East, continuing along said line, 147.80 feet to a corner of the 186.10 acre tract; THENCE North 00031 West along a West line of the 186.10 acre tract, 586.94 feet; THENCE EAST, 1369.46 feet to a point on the West right-of-way line of Kreymer Lane; ORDINANCE NO. CONT'd. Page 2 SECTION 2. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in confl i ct with the provi s ions of thi s ordi nance sha 11 rema in ln full force and effect. SECTION 3. That the above described property shall be used only in the IlICinner Clnd for the purposes provided for in the Comprehensive Zoning Ordinance of the City as amended herein by the granting of this zoning classificatiorl. SlCTION 4. That should any paragraph, sentence, subdivision, clause, IJlirasl: Dr section of this ordinance be adjudged or held to be unconstitutional, inL'tjdl or invalid, the same shall not affect the validity of this ordinallce ciS i:i \'lllule or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as hereto- fore dlllended, and upon conviction shall be punished by fine not to exceed the sum of two llundred dollars ($200.00) for each offense, and that each day suctl violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper develop- ment and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides. Page lA THENCE South 00051 East along said West right-of-way line of Kreymer Lane, 1553.28 feet to the PLACE OF BEGINNING, and containing 49.1953 acres of land, more or less.
