Ordinance 1983-48 \ \ _. , ,) ORDI NANCE NO. 178 /f J' AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS HERETOFORE AMENDED (ORDINANCE NO. 81-5), TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. \'iHEREAS, the City Zoning Commission and the City Council of the City of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning"ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that the said change of zoning which is on application of C.-.I. Rpdhilm________ should be granted and the Comprehensive Zoning Ordinance of the City of Wylie should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be and the same is hereby amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described property a new zoning district classification to-wit: RII~; np~~-l (Wynrlhilm Estates) Said property being described as follows: BEING a tract of land in the Francisco de la Pina Survey, Abstract No. 688, situated in the City of Wylie, Collin County, Texas, and also being a part of that certain 186.10 acre tract of land conveyed to Arapaho East, Inc. by W. T. Beckham by deed recorded in Volume 1032, Page 225 of the Deed Records of Collin County, Texas, and being more particularly described as follows: BEGINNING at the intersection of the South right-of-way line of State Highway No. 78 with the West right-of-way line of Kreymer Lane, said point being the beginning of a curve to the left having a tangent bearing of due SOUTH; THENCE along the West right-of-way line of Kreymer Lane: SOHtherly along said curve to the left having a central angle of 32 28135", a radius of 480.0 feet and a tangent of 139.80 feet, an arc distance of 272.07 feet to a point of reverse curve; THENCE along the West right-of-way line of Kreymer Lane SOHtherly along a curve to the right having a central angle of 32 23135", a radius of 420.0 feet and a tangent of 121.99 feet, an arc distance of 237.45 feet; THENCE South 00051 East, 17.35 feet along the West right-of-way line of Kreymer Lane; THENCE WEST, 1369.46 feet to a point on a West line of the 186.10 acre tract; THENCE North 00031 West along said line of the 186.10 acre tract, 500.0 feet to a point on the South right-of-way line of State Highway No. 78; ORDINANCE NO. CONT1d. Page 2 SECTION 2. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the Ci ty not in confl i ct with the provi s ions of thi s ordi nance sha 11 rema in 1 n full force and effect. SECTION 3. That the above described property shall be used only in the IlldllJier and for the purposes provided for in the Comprehensive Zoning Ordinance O! tilt: City as amended herein by the granting of this zoning classification. SLCTION 4. That should any paragraph, sentence, subdivision, clause, IJlil'il':,c or section of this ordinance be adjudged or held to be unconstitutiolldl, iIIL~~J.l1 or invalid, the same shall not affect the validity of this ordinance d':, l:1 11110Ie or any part or provision thereof other than the part so decided to be invdlid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as hereto- fore i:lIllended, and upon convi cti on shall be puni shed by fi ne not to exceed the SUIll of tlvO hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned lonlng classification in order to permit its proper develop- ment and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides.
