Ordinance 1984-65 ORDINANCE NO. ?//'- &3--- AN ORDINANCE REGULATING THE PARKING OF VEHICLES ON THE EAST AND WEST SIDES OF FIFTH STREET BETWEEN OAK STREET AND MASTERS STREET; PENALTY AND SEVERABILITY; DECLARING AN EMERGENCY: WHEREAS, in order to ensure to the people the maximum use and benefits of the public streets of the City and yet retaining the maximum degree of safety to prevent injury to persons and property, it is deemed necessary to prescribe regulations and controlling both vehicular and pederstrain traffic; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: ARTICLE I. DESIGNATION IINO PARKING": There shall be no parking at any time designated on Fifth Street between Oak and Masters on both the east and west sides of the streets. That no parking signs shall be installed on both the east and west sides of Fifth Street between Oak and Masters Streets. ARTICLE II.PENALITY AND SEVERABILITY: Section 1. Penalty: Any person violating any of the provlslons of this Ordinance shall be deemed guilty of a Class C misdemeanor, and upon conviction, shall be subject to a fine of not more than that established by Texas State Law. Each day the violation continues shall be considered a separate offense. Section 2. Severability: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of unconstitu- tional or invalid phrases, clauses, sentences, paragraphs, or sections. ARTICLE III. DECLARING AN EMERGENCY: The fact that there are no adequate controls creates a hazard and endangers the health, safety, and welfare of the City of \~ylie, it is hereby declared to be an emergency and this Ordinance shall take effect upon final passage hereof, and installation of such traffic control divices.
