Ordinance 1988-40 ORDINANCE NO. 0 t '-f{J BEING AN ORDINANCE OF THE CITY OF WYLIE A HOME RULE SUBDIVISION OF THE STATE OF TEXAS. AMENDING ORDINANCE 83-18 BY ADDING TO SECTION 6 PARAGRAPH 6.02 SUB PARAGRAPH B A NEW NUMBER 4 PERMITTING THE COLLECTION OF PERIMETER STREET FEES ON NEW LOTS ON AN INDIVIDUAL BASIS. PROVIDING SEVERABILITY CLAUSE, PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE, PROVIDING A PUBLICATION CLAUSE AND DECLARING AN EFFECTIVE DATE: WHEREAS: There are certain subdivisions in the City were approved prior to the enactment of perimeter street fee requirements and: that the WHEREAS: These areas are subject to additional thus being subject to the perimeter requirements and: subdivision street fee The City Council realizes collection of the full subdivision would be therefore: that in certain cases the fee at the time of such financially prohibitive WHEREAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, COLLIN COUNTY, TEXAS THAT SECTION 1. SECTION 2. SECTION 3. Ordinance 83-18 Section 6 Paragraph 6.02 sub paragraph (B) is hereby amended by added thereto a number 4 to read as follows: 4. When the City Council determines after recommendation by the Planning & Zoning Commission, that the collection of the full perimeter street fee would create a prohibitive financial hardship, the amount due shall be collected as a condition of the Building Permit on each lot when that lot is improved by the addition of a structure, or at the time of street improvement which ever comes first. REPEALING CLAUSE - That all ordinances of the city in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SEVERABILITY CLAUSE Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the remaining portions of this ordinance. SECTION 4. PENALTY Any person firm or corporation violating any of the provisions or terms of this ordinance shall be subject to a fine not to exceed the sum of Five Hundred ($500.00) for each day such violation shall continue to exist shall constitute a separate offense. SECTION 5. PUBLICATION CLAUSE This ordinance shall take immediately from and after its passage and publication of its caption, as the law in such cases provides.
