AN ORDINANCE OF THE CITY OF WYLIE, TEXAS
ORDINANCE NO. 7~-~o
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ABANDONING AN
UNUSED ALLEY: PROVIDING THAT SUCH ABANDONMENT SHALL BE
THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY
ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE
A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY
CLERK OF COLLIN COUNTY, TEXAS; AND PROVIDING AN
EFFECTIVE DATE:
WHEREAS, the property described herein is an alley between Lots 6, 7 and 9, and Lots
1, 2, 3, 4 and 5 of Block 15 of the Railroad Addition, located South of
Highway 78 between Third and Fourth Street, with Oak Street bordering the
South property line.
WHEREAS, the adjacent property owner, Richard Parker, has requested that the said
alley be abandoned so that the City of Wylie might quitclaim the property to
the current grantor; and
WHEREAS, the City of Wylie has determined that the alley described herein is no longer
needed for public purposes, utilities or access;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1 That the alley described on Exhibit "A" attached hereto is no longer or
necessary for public purposes, utilities or access; and should be abandoned
in favor of Richard Parker, adjacent property owner. The alley being
abandoned herein is described as follows, to-wit:
That portion of the alley shown on Exhibit "A": attached hereto and made a
part hereof of all purposes.
SECTION 2 That this abandonment ordinance shall constitute a Quitclaim Deed in favor
of Richard Parker, property owner, and a certified copy of the same may be
filed in the Deed Records of Collin County, Texas to indicate such
abandonment.
SECTION 3 The abandonment provided for herein shall extend only to the public right,
title and interest which the City of Wylie, Texas may have in and to said
alley, and shall be construed to extend only to such interest that the
governing body of the City of Wylie, Texas, may legally and lawfully
abandon.

SECTION 4 The fact that the above described alley is no longer needed or necessary for
public purposes,utilities or access; and that such alley should be abandoned
in favor of the adjacent property owner, creates an urgency and an
emergency in the preservation of the public health, safety and welfare, and
requires that this ordinance shall take effect immediately from and after its
passage, as the law in such cases provided.
DULY PASSED BY THE CITY COUNCIL OF THE CITY OF WYLIE, COLLIN COUNTY,
TEXAS ON THIS DAY OF DECEMBER, 1995.

ALLEY DESCRIPTION
Being a tract of parcel of lane situated in Block 15 of the Railroad Addition, an Addition
to the City of Wylie, Collin County, Texas, and being more particularly described as
follows:
Beginning at a 1/2 inch iron rod found in the north right-of-way of Oak Street (70'
R.O.W.) for the southeast corner of Lot 6, Block 15 of the Railroad Addition, an
Addition to the city of Wylie, Collin County, Texas;
Thence, NOD" 00' 00" E, a distance of 265.71 feet to a 1/2 inch iron rod found for the
northeast corner of Lot 8, Block 15 of said Addition, being on the southerly right-of-way
line of State Highway No. 78.;
Thence, N 510 18' 17" E, along said right-of-way line, a distance of 25.63 feet to a 1/2
inch iron rod set for the most westerly Northwest corner of Lot 1, Block 15 of said
Addition;
Thence, N 90000' 00" W, along said right-of-way line, a distance of 20.00 feet to the
Point of Beginning and containing 5,474 square feet or 0.126 acres of land.
