WHEREAS, the City Council of the City of Wylie, Texas ("City Council"), investigated and determined that it would be advantageous and beneficial for the citizens of the City of Wylie, �'exas ("Wylie") to exchange certain tracts of land being developed by Woodbridge Properties, LLC with the City of Sachse, Texas("Sachse"); and WF-iEREAS, the City Council, under the authority of its Charter and various sections of the Loca1 Government Code, further investigated and determined that it would be advantageous and beneficial to Wylie and its inhabitants to an�ex the below-descn'bed property (the `�roperty") to Sachse; and WHEREAS, the City Council finds that all requisites relative to consideration and adoption of this Ordinance have been complied with in conjunction with the Boundary Exchange Agreement pursuant to Chapter 43 of the Local Government Code; and WHEREAS, prior to conducting the public hearings, the City Council also mvestigated and determined that the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and contiguous to the existing city limi�ts of Wylie; and W.F�REAS, before the publication of the notice of the first public hearing regazd'mg the annexation of the Property, the City Council directed the appropriate persons to prepare a service plan that provides for the extension of full municitpal services to the Property to be annexed; and V�HEREAS, the City Council finds that the service plan has been prepared 'm full compliance with Section 43.056, Local Government Code, and has been made available for public mspection aad was available for explanatian to the inhabrtants of the Property at the public hearings; and WHER�AS, the City Council fmds that the field notes close the boundaries of the Property being aunexed; and O�.�D�� 00314 WHEREAS, the City Council has conducted at least two (2) public hearings at which persons interested in the annexation were given an opportunity to be heard regard'mg the � proposed annexation and the proposed service plan; and WHEREAS, the City Council finds the public hearings were conducted on or after the fortieth (40th) day but before the twentieth (2(?th) day before the date of institution of the annexation proceedings; and WHEREAS, the City Council finds it has con�leted the annexation process within ninety (90) days after the City Council instituted annexation proceedings; and WHEREAS, the City Council finds that all legal notices , hearings, procedures and publishing requirements for annexation have been performed and completed in the manner and form set forth by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TI� CITY OF WYI�IE, TEXAS: SECTION I: The fmdings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: The Property descnbed as follows and all public streets, roadways and alleyways located within or contiguous to the same is hereby annexed to Wylie, to-wit: BEING a 3.21 acre tract of land, more or less, situated in the Richard Newman Survey, Abstract No. 660 an being part of the 195.939 acre tract of land descn'bed 'm deed to Belco Equities, Inc., recorded in Collin County Clerk File No. 95-0003093, and being more particularly descnbed by metes and bounds in E�ubit "A" attached hereto and "mcorporated herem for all purposes. SECTION 3: The Service Plan for the Property is attached hereto as Extubit `B" and made a part hereof for all purposes. SECTION 4: That from and after the passage of this Ordinance, the Property shall be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and privileges of a11 of the citizens of Wylie and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the City Charter and the laws of the State of Texas. SECTION 5: That the offcial map and boundaries of Wylie aze hereby amended to include the Property as part of the City of Wylie, Texas , and that a certified copy of this Ordinance shall be filed in the county clerks's office of Collin County, Texas. SECTION 6: It shall be tmlawful for any person, f�rm, corporation or business entity to make use of the Property in some manner other than as authorized by this Ordinance and Wylie's Comprehensive Ordinance No. 91-24, Chapter 12, Exhibit A, and any amendmeuts thereto; and ft ����� 00315_ shall be unlawful for any person, firm, corporation or business entity to construct on the Property any building that is not in confornuty with the permissibk use under this Ordinance and Wy1ie's Comprehensive Zoning Ordinance No. 91-24, C$apter 12, Exlu`bit A, and any amendments � thereto. �F.rTION 7: Any person, firm, corporation or business entity violating this Ordinance or any provision of Wylie's Comprehensive Zoning Ordinance No. 91-24, Chapter 12, E�ibit A, or as amended, shal� be deemed guihy of a misdemeanor, and upon conviction thereof shall be fined a sum exceeding Two Thousand Dollars ($2000.000). Each continuing day's violation under this Ordinance shall constitute a sepazate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie f�om filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and fiederal law. SECTYON S: Should any section, subsection, sentence, clause or phrase of this (?rdinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain m full force and effect. Wylie hereby declazes that it would have passed this Ordinance, and each section, subsection, c}ause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. SECTION 9: All ordinances in conflict with this Ordinance are repealed to the exteitt they are in conflict, and any remaining portions of the conflicting ordinance shall remain m fiill force and effect. SECTION 10: The caption af this Ordinance shall be published 'm accordance with the law and the City Charter of Wylie. This Ordinance shall be in full force and effect from and after its adoption by the City Council, unless otherwise required by law aztd then shall be in full force and effect upon such compliance.
