Ordinance 1999-33 ORDINANCE NO. gg"3? AN ORDINANCE OF THE CITY OF WYLIE, AFFECTING PARTICIPATION OF CITY EMPLOYEES IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM GRANTING THE ADDITIONAL RIGHTS AUTHORIZED BY SECTION 854.002(g) OF TITLE 8, TEXAS GOVERNMENT CODE, AS AMENDED; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the 74th Legislature of the State of Texas, meeting in Regular Session, passed House Bi112168, which inter alia, amended Section 854.202(g) of the Texas Government Code that allows Texas Municipal Retirement System ("TMRS") cities to adopt retirement eligibility at any age with 20 years of service credit, and WHEREAS, Governor George W. Bush approved House Bi112168 after its passage, and House Bill 2168 took effect September 1, 1995, and WHEREAS, all legal notices have been given in the manner and form set forth by law, and all other requirements, including a public hearing, have been fulfilled, and WHEREAS, the City Council of Wylie, Texas ("City Council") has investigated and determined that it would be beneficial and advantageous to the employees of the City of Wylie to grant retirement eligibility at any age with 20 years of service credit, and WHEREAS, the City Council adopted the Fiscal Year 1999-2000 budget on September 14, 1999, which included funds for the adoption of retirement eligibility at any age with 20 years of service credit; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Wylie, Texas, as follows: Section 1. Pursuant to the provisions of Section 854.202(g) of Subtitle G of Title 8, Texas Government Code, as amended, which Subtitle shall herein be referred to as the "TMRS Act," the City of Wylie, Texas, adopts the following provisions affecting participation of its employees in the Texas Municipal Retirement System ("System"): (a) Any employee ofthe City who is a member of the System is eligible to retire and receive a service retirement annuity if the member has at least 20 years of credited service in the System performed for one or more municipalities that have adopted a like provision under Section 854.202(g) of the TMRS Act. (b) Prior to adopting this ordinance, the governing body of the City has (1) prepared an actuarial analysis of member retirement annuities at 20 years of service; and (2) held a public hearing pursuant to the notice provisions ofthe Texas Open Meetings Act, Chapter 551, Texas Government Code. (c) The rights hereinabove authorized shall be in addition to the plan provisions heretofore adopted and in force at the effective date ofthis ordinance pursuant to the TMRS Act. Section 2. This ordinance shall become effective on the first day of January in the year 2000.
