Ordinance 2000-13 ORDINANCE NO. ~()()- ( 3 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ESTABLISHING FEES FOR THE COLLECTION AND REMOVAL OF SOLID WASTE AND RECYCLABLE MATERIALS; AMENDING ORDINANCE NO. 98-16; AND FURTHER REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A PENALTY CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City has renegotiated its contract for solid waste collection with its current contractor Browning-Ferris Industries (BFI); and, WHEREAS, the new agreement with BFI provides for changes in rates for certain services, including an increase in rates for residential and commercial collection services; and, WHEREAS, the City Council has determined that the rates the City is charging its residential customers for collection services and the rates that BFI is charging its commercial customers should be adjusted to reflect these increases; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, as follows: SECTION I That Ordinance No. 98-16 be, and it hereby is, amended as follows: Section 9.01 - Residential fee; deposits. (a) The collection and removal of solid waste and recyclable materials in approved containers from residential premises once per week shall be made for a fee 01'9.86 per residential unit for each calendar month. (c) The rate for each unit of a smgle family detached or duplex (not master metered) shall be $9.86 per month. (d) The rates for Duplex, Multi-family, Trailer Park shall be $9.86 per unit per month. Section 9.02 - Commercial polycart collection fees. (a) Collection of one 90 gallon polycart twice per week shall be billed at the rate 01'$11.50. (b) Each additional polycart shall be billed at the rate 01'$4.03. Ordinance No. ~OO~!.-3 Page 1 Section 9.03 Commercial Dumpster Charges shall be as follows: 2 cu. yd.- IX $ 42.56/mo.; 2X $ 90.87/mo.; 3X $120.78/mo. 3 cu. yd.-IX $ 58.66/mo.; 2X $ 109.27/mo.; 3X $169.09/mo. 4 cu. yd.- IX $ 87.42/mo.; 2X $139. 18/mo.; 3X $196.69/mo. 6 cu. yd.-IX $ 102.37/mo.; 2X $166.78/mo.; 3X $247.30/mo. 8 cu. yd.- IX $125.38/mo.; 2X $215.09/mo.; 3X $286.41/mo. Extra pickup rates shall be as follows: 2-4 cu. yd.- $32.21 each additional pickup. 6-8 cu. yd.- $36.81 each additional pickup. Section 9.04 Special Charges: Compactor Containers, disposal only- $287.56 per haul Roll-Off Containers, disposal only- $258.80 per haul Roll-Off Daily Rental- $7.19 per day Roll-Off Delivery/Exchange- $77.03 Front End Delivery/Exchange- $51.35 Polycart Purchase/Replacement- $60.00 each Returned Check Charge- $20.00 Additional Residential Cart- $3.00 per month Past Due Service Charge- 1.5 per cent Tire collection/disposal- $5.00 each Section 9.05 Fees for Special Collection of Brush and Bulky Waste Items Special collection of brush and bulky items, in excess 01'2 cubic yards per month, will be made available to residents at the rate 01'$72.00 per hour for time spent on collection, with a minimum charge 01'$15.00 per collection. SECTION II In the event of non payment of charges for the above services City shall have the right to deny further service to such non paying person or customer. SECTION ill Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part or parts as declared to be invalid, illegal, or unconstitutional. Ordinance No.~f)()-/3 Page 2 SECTION IV This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION V That all other ordinances and code provisions in conflict herewith are hereby repealed to the extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not in conflict herewith shall remain in full force and effect. SECTION VI The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue, nor as effecting any rights of the municipality under any section or provisions of any ordinances at the time of passage of this ordinance.
