ORDINANCE NO. P-lOL::Oz.
AN ORDINANCE REPEALING ARTICLE VI, ATHLETIC FIELDS,
CHAPTER 78 SECTIONS 78-231 THROUGH 78-242 OF THE WYLIE
CODE OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
The Code of Ordinances of the City of Wylie be amended as follows:
SECTION 1
The following Sections of Chapter 78 Article VI, Athletic Fields shall be repealed in their
entirety: Section 78-231, Administration, purpose, objectives of articles; Section 78-232, Sports
season; Section 78-233, Athletic field allocation; Section 78-234 Athletic field reservations;
Section 78-235 Athletic field reservation time slots; Section 78-236 Athletic field reservation
usage fee; Section 78-237 Athletic field light usage fee; Section 78-238, Athletic field
marking/chalk usage fees; Section 78-239, Athletic field reservation for baseball/softball
tournament use; Section 78-240, Responsibility for equipment and marking; Section 78-241,
Cancellations; Section 78-242, Responsibility for cleanliness; Section 78-243 Use of funds.
SECTION 2
If any portion of this ordinance shall conflict with any portion or all of an existing ordinance of
the City of Wylie, the City Council hereby declares that this ordinance shall prevail, and that it
is hereby attempting to repeal any conflicting provisions of an existing ordinance of the City.
SECTION 3
It is hereby declared to be the intention of the City Council of the City of Wylie that the
sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if
held invalid by any judgment or decree of a court of competent jurisdiction, such
unconstitutionality of invalidity shall not affect any other remaining phrase, clause, sentence,
paragraph or section of this ordinance.
SECTION 4
This ordinance shall be in full force and effect from and after its adoption by the City Council
and publication of its caption as the law and the City Charter provide in such cases.
SECTION 4
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not be
construed as abandoning any action now pending under or by the virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to
accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.
