Ordinance 2001-19 ORDINANCE NO. &00 1- /~ AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE NOS. 90-10,97-2 AND 97-4, REGARDING IMPACT FEES TO BE ASSESSED BY THE CITY OF WYLIE, TEXAS; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Wylie, Texas (the "City Council") has previously adopted Ordinance Nos. 90-10 and 97-4 of the City of Wylie, Texas ("Wylie") establishing an impact fee to be assessed by Wylie; and WHEREAS, Wylie has fully complied with Chapter 395, Local Government Code, concerning the notice, adoption, promulgation and methodology necessary to adopt land use assumptions and a capital improvement plan establishing impact fees and has properly adopted Ordinance Nos.90-1O, 97-4, and Resolution 97-2; and WHEREAS, the City Council desires to amend the land use assumptions and amend the capital improvement plan and the amount of impact fees for water and sewer; and WHEREAS, Wylie has reviewed the land use assumptions and capital improvement plan, and the impact fees for water and sewer adopted under Ordinance Nos. 90-10, 97-4, and Resolution 97-2 of Wylie in compliance with Chapter 395, Local Government Code; and WHEREAS, Wylie has, within sixty (60) days after the date it received the proposed land use assumptions, the capital improvement plan and assessment of impact fees adopted an order setting a public hearing to discuss and review the same and determine whether to amend them; and WHEREAS, on or before the date of the first publication of the notice of the hearing on the proposed amendments, including the amount of the proposed impact fee per service unit, such information was made available to the public; and WHEREAS, the City Council held a public hearing to discuss the proposed amendments to the land use assumptions, capital improvement plan and impact fees for water, sewer and thoroughfares; and WHEREAS, the Advisory Committee, created under Section 395.058, Local Government Code, filed its written comments on the proposed amendments to the land use assumptions, capital improvement plan and impact fees for water, sewer and thoroughfares before the fifth (5th) business day before the date ofthe public hearing on the amendments; and WHEREAS, within thirty (30) days after the date of the public hearing on the proposed amendments to the land use assmnptions, the City Council, is approving amendments to the land use assumptions, capital improvement plan, and impact fees for water and sewer charged per service unit; and WHEREAS, Wylie has fully complied with Chapter 395, Local Government Code, to approve the proposed land use assmnptions, capital improvement plan, and impact fees for water and sewer charged per service unit; and WHEREAS, the City Council finds that it is in the best interest of the citizens of Wylie to adopt such land use assumptions and capital improvement plan and amend the impact fee for water and sewer. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION I: Findings Incorporated/Compliance with Law. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. This Ordinance is adopted pursuant to the provisions of Chapter 395, Local Government Code, and Article 11, Section 5, of the Texas Constitution. The City Council finds that Wylie has fully complied with the notice, adoption, promulgation and methodology necessary to adopt updated and revised land use assumptions and capital improvement plan and establish amended impact fees as set forth herein. SECTION 2: Land Use Assumptions Update. The proposed land use assumptions have been reviewed and evaluated, and the City Council finds that the proposed land use assumptions, which is attached hereto and incorporated herein for all purposes as Exhibit" A", should be and are approved. SECTION 3: Capital Improvements Plan Update. The proposed capital improvements plan has been reviewed and evaluated, and the City Council finds that the proposed capital improvements plan, attached as Exhibit "B", should be and is approved. SECTION 4: Amendment to Ordinance No. 97-4. Ordinance No. 97-4, Section IV is hereby amended to read as follows : The proposed impact fees have been reviewed and evaluated, and an impact fee of $/ :l.r/2/per service or Living Unit Equivalent (LUE) for water supply, treatment, and distribution facilities is hereby imposed in accordance with the LUE for water set out in Table 3A, Exhibit "B" attached hereto and incorporated herein for all purposes. An impact fee of $ :L 44" per service unit or LUE for sanitary sewer collection and treatment facilities is hereby imposed in accordance with the LUE for sanitary sewer set out in Table 3B, Exhibit "B". SECTION 5: Inconsistent or Conflicting Ordinances. This Ordinance shall be and is hereby declared to be cumulative of all the Ordinances of Wylie, and this Ordinance shall not operate to repeal or affect any other Ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this Ordinance, in which event, such conflicting provisions, if any, and such other Ordinances or Ordinances are hereby repealed. SECTION 6: Severability. Should any section, subsection, clause or phrase of this Ordinance be declared unconstitutional or invalid by any court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full for force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clauses and phrases be declared unconstitutional or invalid. SECTION 7: Effective Date.
