1952 Ordinances AN ORDINANCE CLOSING AN ALLEY FACING BROWN- STREET ON THE NORTH AND JEFFERSON STREET ON SOUTH, SAID ALLEY BEING 20 FEET WIDE EAST AND WEST AND 325 FEET LONG NORTH AND SOUTH AND BEING DESIGNATED AS THE WEST ALLEY IN BLOCK NUMBER ELEVEN (11), IN THE BROWN AND BURNS ADDITION TO THE; CITY OF WYLIE: TEXAS, AND DECLARING AN EMERGENCY. WHEREAS, on or about January A D 1893, a map or plat of the City of Wylie was made showing the Brown and Burns addition to the town of Wylie,Collin County,Texas,and said Map or Plat showed the above described alley in Block Eleven(ll) Brown and Burns Addition to the said town of Wylie,Texas, running North and South 325 feet by 20 feet East and West, and Whereas such alley was never at any time dedicated as an alley for the public use by Brown and Burns, a firm composed of John Burns and W T Brown) and Whereas,the City of Wylie never at any time accepted said alley either orally or in writing, and the said alley has been abandoned by City of Wylie for more than 50 years and has never at any time been used,enjoyed,occupied, and traveled as an alley by the public or privately, and Whereas said alley is of no further public use or interest to the people of Wylie, Texas, or to the public generally as an alley, and Whereas, the City of Wylie, and to Texas, does not now claim any lnterest or right in said alley and whereas said Map or Plat of the City of Wylie,Texas,was made and resurveyed by N.Werenshield, Civil Engineer of Dallas,Texas, on - day of Apr1l A D 1904, BE IT ORDAINED by the City Counoil of the City of Wylie,Texas: Section 1. That said 20 foot alley fronting Brown Street on the North and Jefferson Street on the South,being 20 feet wide East and West and long 325 feet North and South and situated in Block No.Eleven(11) of the Brown and Burns Addition to the City of Wylie,Collin County,Texas, and being designated as the West alley in said Block Number Eleven (11), as shown by the Map or Plat of said City, and Addition, and being described by metes and bounds as follows towit: BEGINNING at the Northwest corner of lot No.60 in said Block No.11, in said Brown and Burns Addition to the eity of Wylie,Texas, a stake, which stake is located on the South side of Brown Street; Thence South along the West boundary lines of Lots No's 60,61,62,63 and 64. 325 feet to the north boundary line of Jefferson street, a stakeJfl'hence West 20 feet along the north side of said Jefferson street to the SouthEast corner of lot NO.65l a stake,Thance North along the East boundary lines of lots No's 6566,67,68 and 6 to the South boundary line of Brown Street, a stake,Thence East along the south boundary line of Brown street, 20 feet to the place of beginnlng;be and the same- is hereby ordered closed and is closed and"the City of Wy1ie,Texas, shall have no further interest in the same. Section.2. All Ordinances and parts of Ordinances in confliot with the provisions of this Ordinance are hereby repealed to the extent of such conflict only. Section 3. The importance of this Ordinance to the people of Wylie, Texas,and the publlic interest in the same,creates an emergency and an imperative public necessity that the Constitutional rule requiring Ordinances to be read on three several days and/ or three several times in the City Council of the City of Wylie be and the same is hereby suspended, and said rule is hereby suspended and this Ordinance shall take effect and be in force from and after its passage,and it is so ordained.
