1955 Ordinance-Contract with City of Garland
ORDINANCE NO.
AN ORDINANCE ENTERING INTO CONTRACT WITH THE CITY OF GARLAND,
DALLAS COUNTY, TEXAS FOR THE DEVELOPMENT OF A PARK AND PICNIC
AREA AT LAKE LAVON FOR RECREATIONAL FACILITIES FOR THE
INHABITANTS OF THE CITY OF GARLAND AND THE CITY OF WYLIE AND
PROVIDING FOR THE EXPENDITURE OF CITY FUNDS IN CONNECTION
THEREWITH.
WHEREAS, on the 11th day of June, 1954 the City Council of
the City of Garland, Dallas County, Texas passed its Reso-
lution No. 171, a true copy of which is attached hereto and
marked " Exhibit A " ;
WHEREAS, it is the desire of the City Council of the City
of Wylie, Collin County, Texas, to enter into a contract
to jointly develop the park and picnic area identified in
said Resolution, to be used for recreational purposes by the
inhabitants of both the City of Garland and the City of Wylie;
WHEREAS, the City Council of the City of Garland has expressed
a willingness to share the necessary expenses as follows, to-
wit: the City of Garland 90%; the City of Wylie 10%;
WHEREAS, the City Council for the City of Wylie wishes to
cooperate in said enterprise to the extent of $100.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF WYLIE, TEXAS:
That application be made to the Federal Government
jointly with the City of Garland for a license to develop
an area adjacent to Lavon Lake, such area to consist of 50
acres of land, more or less, the exact location of same to be
determined by joint action of the City of Garland City Coun-
cil and this City Council.
BE IT FURTHER RESOLVED that this Council work with and.
cooperate with the City Council of the City of Garland in
the development of any area for which a license is granted
by the Federal Government.
BE IT FURTHER RESOLVED that 10% of the expenditures
necessary for the development of said area shall be borne
by the City of Wylie, Texas, same to be paid from the gen-
eral funds belonging to said City.
BE IT FuRTHER RESOLVED that a committee of TWO
members
be appointed by the Mayor of the City of Wylie, Texas to
work with and cooperate with the proper officials of the
City of Garland in the development of said area, and that
the tenure of office for said committee shall be the same
as the Mayor of the City of Wylie.

"EXHIBIT A"
RESOLUTION NO. 171
WHEREAS, it has come to the attention of the City Council of the
City of Garland that a license may be issued by the Federal Gov-
ernment for requested land adjacent to Lavon Lake for the purpose
of providing a park and picnic area for the people of Garland and
for the people of the City of Wylie if application therefor is
made; and
WHEREAS, there is not now any land of similar location and desir-
ability for such purpose available to the citizens of Garland;
and
WHEREAS, it is the opinion of the City Council that such a park
and picnic area would provide the people of our town with needed
and desired recreational facilities; and
WHEREAS, the City Council believes that such an area would be of
benefit to all of our citizens; and
WHEREAS, the City Council of theCity of Wylie has indicated a
desire to enter into a license agreement with the Federal Govern-
ment jointly with our City; and
WHEREAS, it is the opinion of this Council that such joint license
would be of mutual benefit:
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GARLAND:
THAT application be made to the Federal Government jointly with
the City of Wylie for a license to develop an area adjacent to
Lavon Lake, such area to consist of 50 acres of land, more or less,
the exact location of same to be determined by joint action of the
City of Wylie City Council and this City Council.
BE IT FURTHER RESOLVED that this Council work with and cooperate
with the City Council of the City of Wylie in the development of
any area for lrlhich a license is granted by the Federal Government.
BE IT FURTHER RESOLVED that the expenditures necessary for the
development of said area be divided between the City of Garland
and the City of Wylie on a basis to be jointly agreed upon.
BE IT FURTHER RESOLVED that the share of expenditures which is
determined to be the pro rata part which should be paid by the
City of Garland, be paid out of the proper funds of the City of
Garland.
