AN ORDINANCE CITY COUNCIL CITY OF WYLIE, TEXAS,
AMENDINGI 'S CODE OF ORDINANCES,ORDINANCE NO. 21- 7,AS
AMENDED,CHAPTER 10(ALCOHOLIC ),TO ADD SC 1 -
22 TO AUTHORIZE EXTENDED HOURS FOR THE SALE OR DELIVERY OF
ALCOHOLIC BEVERAGES IN ACCORDANCE I CHAPTER 105 OF THE
TEXAS ALCOHOLIC BEVERAGEC ING A SEVERABILITY
CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR A CRIMINAL PENALTY A FINE NOT TO
EXCEEDSUM OF FIVE HUNDRED DOLLARS ( . ); AND
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LI ,TEXAS:
SECTION 1. That Chapter 10 of the Code of Ordinances of the City of Wylie, Texas be and the
same is hereby amended in part to add section 10-22, to read as follows:
"See. 1 -22. Extended Hours.
The City hereby adopts extended hours for the sale or delivery of alcoholic beverages pursuant to
Texas Alcoholic Beverage Code, Sections 105.03(d) and 105.05(d), such that the holder of a retailer late
hours certificate issued by the Texas Alcoholic Beverage Commission may sell,offer for sale andlor deliver
alcoholic beverages between midnight and 2:00 a.m. on any day, subject to compliance with applicable
law."
SECTION 2. That all provisions of the ordinances of the City of Wylie in conflict with the
provisions of this Ordinance be,and the same are hereby repealed,and all other provisions of the ordinances
of the City of Wylie not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 3. That should any sentence,paragraph, subdivision,clause,phrase or section of this
ordinance be adjudicated or held to be unconstitutional, illegal or invalid, the same shall not affect the
validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be
invalid,illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole.
SECTION 4. That any offense committed before the effective date of this Ordinance is governed
by the prior law and provisions of the Code of Ordinances, as amended, in effect when the offense was
committed and the former laws continued in effect for this purpose.
SECTION 5. That any person, firm or corporation violating any of the provisions or terms of
this Ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the City
of Wylie as heretofore amended and upon conviction shall be punished by a fine not to exceed the sum of
Five Hundred Dollars ($500.00) for each offense, and each and every day such violation shall continue
shall be deemed and constitute a separate offense.
SECTION 6. This Ordinance shall take effect immediately from and after its passage and
publication of caption as a law and charter in such cases provide.
