CALL TO ORDER
Announce the presence of a Quorum.
Chair Linda Jourdan called the meeting to order at 7:00 p.m. and stated that a
quorum was present. Board Members present were; Vice-Chair Marilyn Herrera,
Board Member Bill Baumbach, Board Member Jeff Ellis, and Board Member
Karyn McGinnis.
Staff members present were: Planning Director, Renae 011ie, Assistant Planner
Jasen Haskins, and Administrative Assistant Mary Bradley.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the September
22, 2008 Meeting.
A motion was made by Board Member McGinnis, and seconded by Board
Member Baumbach, to approve the Minutes from the September 22, 2008
Meeting with amendments to the motion on page 2 for ZBA Case 2008-08, to
state deny variance request without prejudice, with alternative available within
the scope of the Ordinance. The variance denied 3 — 2. Motion carried 5 — 0.
PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by
Charles Cheshire for a Variance to Section 3.1.A.3 and Section
3.4.F.3.a of the Zoning Ordinance requiring a minimum dwelling
size of 3,000 square feet and single family residential units to have
an exterior façade of 100% brick, stone, or masonry stucco (ZBA
2008-09).

Mr. Haskins stated that the property is located east and adjacent to 810 Hensley
Lane, and the applicant is Mr. Charles Cheshire. The applicant is requesting a
variance to Section 3.1.A.3 and Section 3.4.F.3.a of the Zoning Ordinance
requiring a minimum dwelling size of 3,000 square feet and single family
residential units to have an exterior façade of 100% brick, stone, or masonry
stucco.
The property is currently zoned AG/30, which allows light agricultural uses on
large lots that also may contain a residential dwelling.
The applicant provided pictures and Collin CAD information of the properties
within the immediate vicinity, stating that several structures are less than 3,000
square foot, and not constructed with brick or masonry.
The applicant is proposing to construct a 2,400 square foot dwelling with an
exterior material of hardi-plank (fiber cement siding). The applicant presents
information from Collin CAD and pictures depicting that the surrounding
residential structures are less than 3,000 square foot and not constructed with
brick or masonry. The applicant further states that the proposed residential
structure will be in keeping the same look and feel of the neighborhood.
Comment forms were mailed to twenty-five property owners within 200 feet of
this request, and no comment forms were returned in favor or in opposition.
Chairman Jourdan opened the Public Hearing.
Mr. Charles Cheshire, 810 Hensley Lane, Wylie, Texas, the applicant for the
subject property, stated that he purchased the land in 2000, and since that time
has constructed two residential houses surrounding the subject property. The
residential structure is nice and kept very clean, and desires to continue with the
proposed single-story residential structure. A 3,000 square foot residential home
is too much for what is needed at this time, but rather a 2,500 square foot
residential home would be consistent with surrounding residential structures.
Board Member Ellis questioned if the request could be designated as an infill lot.
Ms. 011ie stated that the Board Members could stipulate that the lot be
designated as an infill, which would allow requested variance. The subject
property is surrounded by various zoning districts, to the north is Wylie
Independent School District, to the east Light Industrial, and to the south is
floodplain. Based on the various zoning classifications, Staff does not classify
the property as an infill lot. The applicant is disputing the response from Staff,
and that is part of reason why the request is before the Board tonight.
Chairman Jourdan closed the Public Hearing.
The Board Members discussed the definition of an infill lot and the possible
development of surrounding undevelopable property, which a large portion is in

the floodplain. After the discussion, the majority of the Board Members agreed
that the property was an infill lot.
A motion was made by Board Member Ellis, seconded by Board Member
Baumbach, to Grant the request for a variance to Section 3.1.A and Section
3.4.0 of the Zoning Ordinance, to allow less than a 3,000 square foot residence
in Agriculture zoning and to allow materials other than 100% brick, with
stipulation that the property be designated as an infill lot because of
characteristic of the property, the property being located east and adjacent to 810
Hensley Lane. Motion carried 4 — 1.
Ms. 011ie stated that Sanden International was presented a certificate from City
Council for safeguards in place for keeping community green. Sanden
International has invited City of Wylie staff to come tour their facility on October
28, 2008, and all Board Members are invited to come as well.
Ms. 011ie also encouraged the Board Members to stroll around the Municipal
Complex and look at the artwork from fifth and sixth graders within the Wylie
Independent School District. This is in response to Community Planning Month
in October, with the theme as "Green Community."
ADJOURNMENT
A motion was made by Board Member Ellis, and seconded by Board Member
McGinnis, all Board Members were in consensus, and the meeting adjourned at
7:33p.m.
