AN ORDINANCE PROHIBITING THE BURIHNG OF TRASH, GARBAGE, REFUSE, AND OTHER DEBRIS IN TP.E CI'rY LIMITS OF TEE CITY OF ViJYLIE, TEXAS, PROVIDING AN EXC}~PTION THERETO, REPEAL- ING ALL ORDINANCES IN CONFLICT THEREWITH, PROVIDING FOR SEVERABILITY, AND PROVIDING A PENALTY THEREFOR. BE IT ORDAINED BY 'rEE CITY COUNCIL OF THE CITY OF VVYLIE: Section 1. That upon the effective date of this ordinance it shall thereafter be unlawful for any person, firm or corpora- tion to burn trash, garbage, refuse or other debris within the City Limits of Wylie, Texas. Section 2. That as an exception to this ordinance, it shall be lawful to burn trash in a state approved enclosed incinerator. Section 3. That as an exception to this ordinance, it shall be lawful for municipal employees or the Wylie Fire Department under the supervision or with consent of the Fire Marshall burn trash, rubish, etc, and vacant lots. Section 4. All ordinances heretofore passed by the City Council of the City of Wylie in conflict herewith are hereby repealed. Section 5. Should any section or portion of this ordinance be declared invalid, such declaration shall not affect the i-L ordinance a~~whole or any part thereof, except the section or portion so declared to be invalid. Section 6. Anyone violating the provisions of any section of this ordinance shall be guilty of a misdemeanor and upon conviction shall be s~bject to a fine of not less than $1.00 nor more than $200.00. The fact that the public health, safety, and welfare is jeopardized by the burning of trash and other debris in the City Limits of the City of Wylie creates an emergency and this ordinance shall become effective upon publication thereof in the Wylie News or the 1st day of February, 1964, whichever date is later.
