AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ESTABLISHING A MAXIMUM
LA WFUL PRIMA FACIE SPEED LIMIT OF TWENTY (20) MILES PER HOUR ON BROWN
STREET (OLD HIGHWAY NO. 78) FROM A POINT FIVE HUNDRED (500) FEET WEST TO
A POINT FIVE HUNDRED (500) FEET EAST OF ITS INTERSECTION WITH EUBANKS
LANE/W. A. ALLEN BOULEVARD BETWEEN THE HOURS OF 7:30 A.M. TO 8:30 A.M.,
11:00 A.M. TO 12:30 P.M., AND 2:30 P.M. TO 4:30 P.M. ON SCHOOL DAYS;
ESTABLISHING A MAXIMUM LAWFUL PRIMA FACIE SPEED LIMIT OF TWENTY (20)
MILES PER HOUR ON STONE ROAD FROM A POINT THREE HUNDRED NINETY-FIVE
(395) FEET WEST OF ITS INTERSECTION WITH THE CENTERLINE OF ALLEN ROAD
TO A POINT FIVE HUNDRED (500) FEET EAST OF ITS INTERSECTION WITH THE
CENTERLINE OF ALLEN ROAD BETWEEN THE HOURS OF 7:30 A.M. TO 8:30 A.M.,
11:00 A.M. TO 12:30 P.M., AND 2:30 P.M. TO 4:30 P.M. ON SCHOOL DAYS; PROHIBITING
PARKING ON BROWN STREET AT ANY TIME FROM A POINT FIVE HUNDRED (500)
FEET WEST TO A POINT FIVE HUNDRED (500) FEET EAST OF ITS INTERSECTION
WITH THE CENTERLINE OF EUBANKS LANE/W. A. ALLEN BOULEVARD; PROVIDING
FOR THE ERECTION OF SIGNS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES
IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY
OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR
EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, upon the basis of an engineering and traffic investigation, the City
Council of the City of Wylie has determined that the prima facie maximum speed limit
in certain areas is greater than is reasonable or safe under the conditions found to
exist thereat due to the location of public or private schools in the vicinity, taking
into consideration the width and condition of the street and other circumstances, as
well as the usual traffic thereon; and
WHEREAS, the City Council has determined to declare a reasonable and safe
prima facie maximium speed limit thereat during certain hours of the school day and
to give notice thereof by the posting of appropriate signs and markers, NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1.
The following prima facie maximum speed limits hereafter indicated for motor
vehicles are hereby determined and declared to be reasonable and safe, and such maximum
speed limits are hereby fixed at the rate of speed indicated for motor vehicles traveling
upon the main street or highway, or parts thereof, and no motor vehicle shall be
operated along or upon said portions of said named streets or highway within the
corporate limits of the City of Wylie in excess of the speeds set forth as follows:
A. Twenty (20) miles per hour on Brown Street (Old Highway No. 78) from a
point five hundred (500) feet west to a point five hundred (500) feet east
of its intersection with the centerline of Eubanks Lane/W. A. Allen
Boulevard between the hours of 7:30 a.m. to 8:30 a.m., 11:00 a.m. to 12:30
p.m., and 2:30 p.m. to 4:30 p.m. on school days.
B. Twenty (20) miles per hour on Stone Road from a point three hundred
ninety-five (395) feet west to a point five hundred (500) feet east of its
intersection with the centerline of Allen Road between the hours of 7:30
a.m. to 8:30 a.m., 11:00 a.m. to 12:30 p.m., and 2:30 p.m. to 4:30 p.m. on
school days.
SECTION 2.
No person shall stop, park, or leave standing any vehicle, whether attended or
unattended, upon the paved or main traveled part of the highway on Brown Street (Old
Highway No. 78) from a point five hundred (500) feet west to a point five hundred (500)
feet east of its intersection with the centerline of Eubanks Lane/W. A. Allen Boulevard
at any time.
SECTION 3.
The speed limits and parking prohibitions contained herein shall not be effective
until signs giving notice of such regulations are posted upon or at the entrances to the
highway or part thereof affected as may be most appropriate in accordance with the
Uniform Manual on Traffic Control Devices promulgated by the State Department of
Highways and Public Transportation, and the City Manager or his designee is hereby
authorized and directed to cause to be erected such signs.
SECTION 4.
That all ordinances of the City in conflict with the provisions of this ordinance
be, and the same are hereby, repealed and all other ordinances of the City not in
conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall
not affect the validity of this ordinance as a whole or any part or provision thereof,
other than the part so declared to be invalid, illegal or unconstitutional.
SECTION 6.
Any person violating any of the provisions of this ordinance or the speed or
parking regulations contained herein shall be deemed guilty of a misdemeanor and, upon
conviction in the Municipal Court of the City of Wylie, Texas, shall be fined in an
amount not to exceed the sum of Two Hundred Dollars ($200.00) for each offense.
SECTION 7.
This ordinance shall become effective immediately from and after its passage and
the publication of the caption as the law and charter in such cases provide.
