Resolution 97-16 RESOLUTION NO. 9
A RESOLUTION OF THE CITY OF WYLIE, TEXAS, ESTABLISHING A CITIZENS
CHARTER REVIEW COMMITTEE; PROVIDING FOR THE SCOPE AND
AUTHORITY OF THE COMMITTEE; AND PROVIDING FOR THE APPOINTMENT
OF THE MEMBERS
WHEREAS, the City Council for the City of Wylie, Texas believes that the Home -Rule
Charter establishing the Council- Manager form of government has served this community and its
residents very well; and
WHEREAS, under the provisions of the Home -Rule Charter, the City Council, consisting
of the Mayor and Councilmen elected by and responsible to the people, appoint a city manager
(who shall be responsible to the City Council for the administration of the government of the city).
All powers of the city shall be vested in the City Council and shall be exercised in the manner
prescribed by the Charter, ordinance, the state constitution or the statutes of this state; and
WHEREAS, a Home -Rule Charter was originally approved by the voters of Wylie in
January of 1985 and revisions approved in January of 1992; and
WHEREAS, the City Council believes that as a matter of a sound public policy that a
Cnarter Review Committee should be appointed to review the Charter and determine if the
document is responsive to and meets the needs of a rapidly growing community; and
WHEREAS, the City Council believes that the citizen members of the committee should be
representative of the entire city; and
WHEREAS, the City Council believes that a committee formed to actively review the Charter
would be a positive step toward enhancing the City of Wylie; and
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Wylie, Texas that:
SECTION 1. Membership The City Council may appoint fourteen (14) members of the
Wylie community. The City Council shall appoint a chair and vice -chair to lead this committee.
An outside consultant shall be used as a facilitator and the City Secretary shall serve as the staff
liaison. Any City Council member may serve as ex- officio, non voting member of the committee.
SECTION 2. Meetings The Charter Review Committee shall set the meeting
dates and times at the first meeting. A Public Hearing will be held at a Charter Review
Meeting to receive public comments from the Citizens of Wylie. The City Council will also
hold a Public Hearing before final acceptance of the changes from the Committee are
submitted to the voters. Notice of meetings shall be posted at the Municipal Complex at
least 72 hours in advance of each meeting as required by the Texas Open Meetings Act.
SECTION 3. Authority The Charter Review Committee shall be a recommending
body with no budget or administrative authority.
SECTION 4. Charge The Charter Review Committee is charged with the
following:
(a) discuss and consider amendments to the City Charter
(b) any changes shall be recommended by majority vote of the Committee for
consideration by the City Council
c) any changes to the Charter must be submitted for the Council's approval no
later than February 24, 1997
(d) the City Council reserves the right to amend or deny any recommendations
made by the Committee
(e) any changes proposed to the Charter will be submitted to the voters of the
City of Wylie at the May 2, 1997 Municipal Election with Early Voting
beginning April 15 and ending April 28, 1997
SECTION 5. This resolution shall take effect immediately upon its passage by the
City Council of the City of Wylie.
