Present with Chairman Larson were Vice-Chairman Phillip Johnston, Commissioner Ramona Kopchenko, Commissioner Willie Osborne, Commissioner John Manganilla and Commissioner Ruthie Wright. Mr. Lee stated that the purpose for the replat was to dedicate the necessary utility easements to accommodate the development of the property. The property totals 27.07 acres and consists of seven (7) commercial lots. Chairman Johnston opened the Public Hearing. Mr. Haskins stated that staff has considered expanding the Downtown Historic District (DTH) to include the properties on Ballard north of Brown. Several factors have been considered for the expansion. As traffic continues to increase on Ballard, and the properties north of Brown are not compatible with high traffic counts. In addition, current property owners as well as potential developers have contacted staff with interest in allowing commercial and/or residential uses on property north ofBrown. The DTll would uJ|ovv single-family residential uses and light commercial uses within a residential structure. The expansion would extend and preserve the pedestrian friendly atmosphere and architectural character of the DTB. Fifty-seven (57) notifications were mailed to property owners nitbin2OO feet. Fifteen responses were received with fire in favor and ten against the request. The Catholic Church submitted a response against the request, however, the understanding was that permission would have to come from Diocese in Dallas, and until word was received from them, the response would have tobe against the request. The Church owns property on both sides ofBallard. Vice-Chairman Larson questioned the number of structures that fit within the regulations of the proposed DTll. Mr. Haskins stated that there are approximately fire residential structures that are fifty-fire years old. The structures were mostly constructed from 1050 through 1993. Expanding the DTBto include the properties north of Brown onBallard would not only preserve the structures that were built prior to 1940, but also uJ|ovv light commercial uses within a residential structure and create a more pedestrian friendly environment. Vice-Chairman Larson expressed concern of traffic and parking for the proposed zoning change. Commissioner Kopcbenko expressed favorable desire to more fbrnmuzl with the proposal, and recommended having a trolley togo throughout the [)T}l. Chairman Johnston opened the Public Hearing. Minutes July 7. 2OO8 Wylie Planning and Zoning Board Page 3of8 Ms. Christine Walk, 408A Jackson, spoke in opposition of the request, and stated that businesses butting up to the residential uses are not feasible with traffic. Mr. Ed Howrey, 111 E Brown St, spoke in opposition of the request, and stated that the regulations for DTH were too restrictive. Ms. Rita Smith, 401 and 404 N Ballard, spoke in opposition of the request, and stated that the DTH regulations were very restrictive. Ms. Janie Bartlett, Pastoral Assistant, St Anthony Catholic Church, spoke in opposition of the request, and stated that the Diocese did call and are absolutely against the request. Mr. Red Byboth, 2722 FM 544, spoke in favor of the request, and stated that the desire to maintain the look and preserve the architectural style and vintage. Ms. 011ie stated that the proposed request would preserve the homes, the architectural styles, and the historical aspects of the existing structures. The DTH would regulate the colors, but not as restrictive as the concern previously expressed. The request is not just to allow for commercial but to protect and preserve the existing historical structures and the wood frame homes. Mr. Mike Gneist, 311 S Second Street and owns property located Lot 5, Russell Addition #1, spoke in favor of the request due to allowing a small business as well as a residential use in the same structure. Mr. Bob Heath, 4506 E Parker Road, spoke in favor of the request and stated that the concept does not affect the residential uses, if anything the request will protect the residents. Chairman Johnston closed the Public Hearing. Vice Chairman Larson questioned which properties the Catholic Church owned. With the Catholic Church stating that they did not want to be rezoned, does the motion need to exclude their property. Ms. 011ie stated that the Church owned property on both sides of the Ballard. A motion was made by Commissioner Kopchenko, and seconded by Commissioner Wright, to recommend approval to the City Council, amending regulations to Zoning Ordinance No. 2001-48, Article 6, as it relates to the proposed expansion of the Downtown Historic District to include property on Ballard Avenue north of Brown up to approximately 419 North Ballard on the west and Block 1 Tract 48 of the Truett Abstract on the east. Motion failed 3 — 3, with Chairman Johnston, Vice Chairman Larson and Commissioner Osborne voting in opposition. A motion was made by Vice-Chairman Larson, and seconded by Commissioner Osborne, to recommend denial to the City Council, amending regulations to Zoning Ordinance No. 2001-48, Article 6, as it relates to the proposed expansion of the Downtown Historic District to include property on Ballard Avenue north of Brown up to approximately 419 North Ballard on the west and Block 1 Tract 48 of the Truett Abstract on the east. Minutes July 7, 2009 Wylie Planning and Zoning Board Page 4 of 6 Motion carried 4 — 2, with Commissioner Wright and Commissioner Kopchenko voting against. Planning and Zoning Commission adjourned for a break and reconvened as a joint work session with City Council. Chairman Johnston called the meeting back to order at 7:3 5pm. Mayor Hogue called the City Council meeting to order, stating that all of Council was present. Councilman David Goss gave the invocation and Councilman Carter Porter led the Pledge of Allegiance. JOINT WORK SESSION WITH CITY COUNCIL 1. Hold a Joint Work Session with the Planning and Zoning Commission to consider amendments to Zoning Ordinance No. 2001-48 and to the Official Zoning Map, as it relates to the proposed addition of Section 6.4 and the creation of the South Ballard Overlay, including district boundaries and design standards and Article 5 as it relates to allowed Uses. Generally bounded by Stone Road on the south, Butler Street on the north.ZC2009-01 Ms. 011ie addressed Council stating that staff is seeking direction on the process to move forward with adopting an ordinance to create the South Ballard Overlay District. This overlay allows the city to create, in the South Ballard area, a place that will be economically and geographically viable while also retaining the rich history, community values, and citizen friendly atmosphere that embodies Wylie. Ms. 011ie reported that at the May 26, 2009 meeting, Council requested a joint work session with the Planning and Zoning Commission to further discuss the intent of the Overlay District, including the design regulations and boundaries. She explained that the proposed SBO boundary, as previously presented, was divided into two separate distinct areas. A Commercial Boundary consisting of those lots fronting Ballard including lots south of Butler and north of College Street, and a Residential Boundary consisting of lots along Jackson, east of Birmingham, north of Stone and south of College Street. Several visuals of architectural building designs and lot frontage were displayed to better show the concept of how the proposed SBO could develop. The area is currently a mix of zoning consisting of Commercial, Single Family, and Multi-Family uses. Planning Director 011ie explained that in order to facilitate these types of developments, a Form-Based approach to zoning would best serve the area. Form-Based zoning involves focusing on place making, where not only the form of the building is important but so is the form of the areas surrounding the buildings. By concentrating on place making, Form-Based zoning adds another element by shaping the spaces around the buildings to create a unique sustainable area that features a pedestrian intense, shopping and living environment with a larger mix of uses within one district. Minutes July 7, 2009 Wylie Planning and Zoning Board Page 5 of 6 City Manager Mindy Manson suggested that the parcels located on east of Ballard over to First Street be included in the boundary of the Overlay. Council and Commission Direction Direction from the Wylie City Council members, and Planning and Zoning Commission after some discussion included: Research the Ballard Overlay to include property boundaries on South Ballard from Highway 78 to Stone and west to Birmingham. Include parcels located on east of Ballard over to First Street be included in the boundary of the Overlay Research a minimum of 6,000 square feet lot size as it relates to the intent of the ordinance Research forms of transportation for pedestrians crossing S.H. 78 from the Downtown Historic District to the South Ballard Overlay. Research the possibility of a Victorian architectural style, allowing for more possibilities and a longer time period. Discussion The applicant is the City of Wylie. In addition to providing staff with an up to date (current) site plan, the purpose is to reflect the addition of a 252-foot radio tower and associated accessory building. The property is zoned Commercial Corridor(CC). An SUP is required for Radio Tower uses within CC zoning District. Zoning Case 2009-05 on the current agenda is a request for an SUP to allow for the proposed radio tower and this item is the related site plan in conjunction with that request. The tower will serve as an integral element in providing enhanced public safety capabilities by expanding area communication coverage in times of emergencies and/or natural disaster. Located on approximately 7.14 acres, the one story 33,000 square foot municipal complex was developed in the mid- 1980s and has served as the central administrative offices since that time. The existing landscaping & architectural regulations are in general compliance with the ordinance. In anticipation of completion of new city hall facilities, this site is proposed to serve as the City's Public Safety Building. As reflected on the site plan, the proposed 252-foot monopole tower and 275 square foot accessory building is to be located at the far northeast corner of the property on approximately 2,743 sq. ft. The structures with associated generator &tank will be enclosed within a 6-foot high chain-link fence. In summary, the purpose of this site plan is to reflect a proposed 252' monopole-type radio tower and accessory structure in conjunction with Zoning Case 2009-05 (SUP-Request)and provide the City with an updated site plan of the property. This item is recommended for approval subject to City Council's approval of ZG2009-05 and compliance with Building Codes and Federal Communications Regulations. ZC 2009-09 Discussion Owner: City of Wylie Applicant: City of Wylie The Zoning Ordinance requires Planning & Zoning Commission and City Council oversight (SUP) for Radio, Television or Microwave Tower structures within Commercial Corridor(CC)districts. The City of Wylie is requesting an SUP to allow for a 252-foot Radio Tower to be located along the northwestern portion of Wylie Municipal Complex, located at 2000 N. Hwy 78. Currently, the 7.14-acre tract is being used for municipal administrative services, including two temporary modular buildings for Building, Inspections, Code Enforcement and Planning & Zoning services. The specific location of the tower is proposed just to the southwest of these modular buildings adjacent to Centennial Drive. It is anticipated that this site will be converted into City of Wylie, Public Safety Building and Operations Headquarters upon completion of new Wylie Civic Center complex under construction at this time. The radio tower will allow public safety operations (Police & Fire) substantial communication capabilities and coverage within the community and surrounding areas. In addition, this element and upgrade to the City's communication system maintains ISO Class I classification and provides Wylie with regional emergency preparedness capabilities. In summary, the request for an SUP to allow for a 252-foot Radio Tower within the CC zoning district will allow for enhanced public safety and emergency services operations within the community. As a result of the 2005 Bond approval and subsequent construction of new city hall, it is anticipated that the current site under consideration will be converted to City of Wylie Public Safety Building; therefore, staff recognizes the appropriateness to allow for radio tower at this site subject to compliance with associated Zoning,Building Code and Federal Communications regulations. Direction to Planning Staff on drafting an ordinance amendment to Zoning Ordinance, Article 7. In evaluating the City of Wylie's landscaping regulations Staff is seeking input and direction from P&Z Commission in an effort to update and improve upon minimum standards and clarify requirements for new residential and non-residential developments. Partially due to an effort in preservation of the community's natural resources, promotion of flexibility in current design practices and establish minimum criteria for non-residential development; staff recommends and suggest the Commission consider the following guidelines, data and information and offer input to Staff for possibly subsequent consideration of an ordinance amendment. The purpose for minimum landscaping regulations. (Outline) The purpose for establishing minimum landscaping regulations is to insure that as development occurs it should be consistent with the character and value of community's ecological and natural environment and safeguard against possible unnecessary influences and/or impacts. What we currently have in place. (Overview) Adopted in September 2003, the current Zoning Ordinance does address minimum landscaping, tree preservation as well as site design, architectural standards and a host of development related regulations for residential, commercial and industrial properties. Upon evaluation of landscaping regulations within the ordinance, it does not address several specific items. 1. Allowance for a variety of native, drought -resistant vegetation, having positive influences upon the natural environment. 2. Flexibility of innovative landscaping elements and design themes as alternatives to minimal standards. Page 1 of 2 Page 2 of 2 3. Minimum ground cover vegetation, shrubbery and trees for commercial properties. What & Why revisions are necessary In light of recent state and regional conservation initiatives and emergence of innovative aesthetic -green design techniques staff is recommending additional verbiage be added to Article 7, General Development Regulations, Section 7.7, Landscaping Requirements (F) Standards and Specification to allow for a listing of those generally accepted species of native, drought -resistant plants and vegetation and allowance for non -vegetative innovative landscaping elements that may be visibly and aesthetically acceptable. Staff continues to research state, local and regional (public & private) organizations and experts soliciting input pertaining to a best -fit for City of Wylie's recommended revisions to landscaping regulations as well as considerations as to how this revision will impact the development community. In summary, the City's existing Ordinance adequately addresses landscaping regulations, however; through continuing effort of evaluating the adopted Zoning Ordinance, Planning Staff became aware of the need for improvements in allowing for flexibility and clarity regarding minimum landscaping requirements for residential and non-residential development. This proposed amendment adheres to and is consistent with the Council's recently adopted Water Conservation Plan; which includes water conservation and lawn & landscape irrigation measures. (April 28, 2009) Staff recommends additional verbiage and listing of accepted native, drought resistant species be added to Article 7, clarity for non-residential minimum requirements and flexibility in allowing for innovative landscaping features and elements as options as opposed to standard design requirements. Department Director Initial Date RO 07-30-09 K Work -Session Summary of Proposed Landscape Amendment Currently, the Zoning Ordinance provides for minimum guidelines and regulations pertaining to installation and maintenance of landscaping features for new development within the City of Wylie. The purpose for this abbreviated review and outline of those regulations is to assist Staff and the Planning & Zoning Commission in determining whether or not revisions are necessary to accommodate native, drought -resistant vegetation and innovative design elements and techniques as well as minimum standards for non-residential properties as they develop. Article 3: Figure 5.9 New Residential Development Requirements; provides several elements regarding minimum landscaping guidelines. For example, `New single family residential lots shall provide for an established lawn with two trees in front and 5 shrubs'. Other elements include sidewalk lighting, entry features as well as perimeter screening, open space and the placement of trees along perimeter walkways. Article 3 also provides a list of preferred and recommended trees and shrubs for landscaping and screening purposes as well as a list of trees discouraged for this purpose. • Article 4: Non -Residential District Design District Regulations provides for minimum base and desirable landscaping standards and guidelines. For example, Figure 4.7 establishes minimum 20% of site be landscaped with minimum for front yard buffers and other screening elements. This Section also addresses parking lot (tree & shrubbery spacing) landscaping standards, street frontages and visibility triangles. Although standards for non-residential developments is fairly adequate; it does not provide for or identify ground cover, tree and/or shrubbery types and species. • Article 7: General Development Regulations, Sections 7.7 Landscape Requirements provides specific purposes for minimum landscaping regulations and ties these to the City's adopted Comprehensive Plan. This Section also provides for when and where regulations are applicable, general design guidelines, submission requirements, and maintenance & enforcement mechanisms. After a thorough evaluation and review of the City's landscaping regulations and with input from professional arborist and licensed landscape architects; staff is seeking additional input from the Commission. Staff is recommending the Commission offer input and direct staff to initiate a public hearing text amendment to the Zoning Ordinance, Section 7.7 Landscaping Requirements and specifically incorporate `North Texas Smartscape' program into this Section. http://www.txsmartscape.com/NorthCentralTX/main.asp The amendment and addition of North Central Texas Smartscape program into the City's landscape requirements will allow for utilization of drought resistant native vegetation consistent with the region and it will provide for over 237 native and adaptive vegetative plants selected by a team of local experts. In summary, benefits from a proposed amendment to the Zoning Ordinance regarding the landscaping regulations will allow for property owners and new development the flexibility and clarity in sustaining an aesthetically, economical, and ecological natural and built environment consistent with adopted Comprehensive Plan.
