ZC 2009-04 (R. 011ie, Planning Director) Executive Summary At its July 28th meeting, Council tabled the subject request to allow staff additional time to visit with property owners to ensure that those affected are fully aware of the impact of the proposed changes. Staff met with the Downtown Merchants Association and presented an overview of the proposal. Part of the discussion included the advantages/disadvantages as mentioned by those citizens in attendance at the July 7th Planning and Zoning Commission meeting. In addition, staff stated the overall vision for the Downtown Historic District and by preserving the historic feel and allowing a mixed use low intense commercial type environment would benefit in keeping downtown vibrant. 3. Hold a Public Hearing and consider, and act upon, amending the zoning from Commercial Corridor (CC) District to Commercial Corridor with Specific Use Permit (SUP) for a 250-foot Radio Tower (CC-w/SUP) District to be located along the northwestern portion of Wylie Municipal Complex. ZC 2009-05 (R. 011ie, Planning Director) Executive Summary The City is proposing to construct a 252' tall Radio Tower. Radio, Television or Microwave Tower as defined by the ordinance is allowed by SUP only within the Corridor Commercial zoning district. The Zoning Ordinance requires a Special Use Permit as a means for developing certain uses in a manner in which the proposed use will be compatible with adjacent property and consistent with the character of the area. Special use permits are required where site specific impacts may exist that require additional review to ensure compatibility between uses. General Business 4. Consider, and act upon, Ordinance No. 2009-22 renaming Valley Stream Circle to Cedar Valley Drive in the Bozman Subdivision. (R. 011ie, Planning Director) Executive Summary On very rare occasions it becomes necessary to rename or renumber a street to ensure the health, safety and general welfare of the citizens of the City of Wylie is to rename a street. Due to public safety concerns, staff is requesting a street name change within the Bozman Subdivision, The subdivision was final platted in 2003 and created 278 residential lots with 22 common area lots. Valley Stream Drive is a double loaded street with twenty-one (21) residential single-family dwellings. The addresses range from 1301 through 1324.Valley Stream Drive curves into Valley Stream Circle. There are twenty-eight(28)residential single- family dwelling units along Valley Stream Circle. The homes on Valley Stream Circle are addressed from 1300 to 1333. With the confusion of the street names and numbers, it can and will delay emergency response. Over the course of several months,there have been a number of incidents where public safety has been dispatched to the subdivision and actually went to the wrong street. 5. Consider and act upon Ordinance No. 2009-23 creating a construction work zone for traffic and temporarily reducing the rate of speed on FM 1378 from Brown Street to Parker Road. (C. Holsted, City Engineer) Executive Summary On May 26,2009,Council awarded a construction contract to L H Lacy Company for the reconstruction of FM 1378 from Brown Street to Parker Road. Lacy has started construction of the outfall storm sewer lines and will begin work in the road right of way within a few days. Due to the proximity of the workers and equipment to the existing travel lanes, it is necessary to reduce the speed on the roadway to 35 miles per hour. The ordinance is written such that when the project is completed, the speed limit will revert to the pre-construction limit of 45 miles per hour. INVOCATION & PLEDGE OF ALLEGIANCE Mayor Hogue gave the invocation and Mayor ProTem Byboth led the Pledge of Allegiance. PRESENTATION • Presentation of the "Battle of the Badges". (J. Duscio, Police Chief/R. Corbin, Fire Chief) Mayor Hogue presented the third annual Battle of the Badges Award to the Wylie Police Department. He explained that the first year the Wylie Police Department received the trophy with the most blood donations and the second year the Wylie Fire Rescue Department had the most contributions. This year, over 100 volunteers gave blood at the event, which ended in a tie. One donor broke the tie leaving the Wylie Police Department as the 2009 winner. Mayor Hogue thanked both departments for conducting the event which saves lives for many people. He also thanked Carter Blood Care for their administration of the event. Minutes August 11, 2009 Wylie City Council Page 1 • Present, and place on file, a Performance Agreement between the Wylie Economic Development Corporation and Sanden International (U.S.A.), Inc. (S. Satterwhite, WEDC Executive Director) Wylie Economic Development Corporation Executive Director Satterwhite addressed council stating that the WEDC Board of Directors approved a Performance Agreement between the WEDC and Sanden International (U.S.A.) on July 17, 2009. He explained that with the assistance of the WEDC, Sanden will be undertaking an $8.5 million expansion/upgrade to an existing compressor manufacturing line. The expansion will take place in two phases; the first phase ($5.8 million) will be completed by April 1, 2010 with the second phase ($2.7 million) complete by April 1, 2011. He explained that following receipt of documentation required within the agreement, Sanden will be reimbursed $200,000 for Phase I expenditures and $100,000 for Phase II expenditures. He noted that in addition to providing documentation supporting the expenditure of $8.5 million, Sanden must maintain no less than 275 production employees, pay all property taxes due for the prior year, and maintain an appraised value for real and personal property of no less than $58 million. Satterwhite stated that in an effort to ensure that the upgraded manufacturing line is functional as well as ensuring that the public investment was utilized properly, Sanden must provide documentation supporting the production of no less than 340,000 compressor units by April 1, 2012 attributed to the proposed real and personal property improvements. He noted that, should Sanden be in default of this provision, all incentives funded will be required to be returned to the WEDC. • Present, and place on file, the FY2009-2010 Budget of the Wylie Economic Development Corporation. (S. Satterwhite, WEDC Executive Director) Wylie Economic Development Corporation Executive Director Satterwhite presented the FY 2009-2010 Budget of the Wylie Economic Development Corporation. He reported that in line with Finance Department estimates, sales tax is projected at $1.475 million. Assuming flat receipts for the balance of the fiscal year, WEDC sales tax receipts for FY 2008-2009 are projected at $1.324 million resulting in a conservative estimate for FY 2009-2010 of a 2.31% gain over prior year. Sales tax attributable to Woodbridge Crossing has been estimated at $151,800. There is however an offsetting entry ($129,030) within the WEDC Incentives budget based upon an existing Performance Agreement between the WEDC and Direct Development. Other revenue sources include $119,400 in rental income from WEDC properties on Industrial Court and $3,000 in interest earnings. He noted, the WEDC will begin FY 2009-2010 with an estimated $710,865 cash reserve. Satterwhite explained that WEDC has budgeted for $2,308,685 in expenses. Of total expenses budgeted, Personnel Services represents 10.2%, Operating 3.4%, Travel & Recruitment 1.5%, Advertising & Community Development 3.8%, Debt Service 10.2%, Land Acquisition 17.3%, Audit & Legal 1%, and Incentives & Related Expenditures 52.8%. Of the three core components within the WEDC Budget, Land Acquisition, Debt Service, and Incentives represent 80% of the proposed expenditures for FY 2009-2010. Minutes August 11, 2009 Wylie City Council Page 2 Satterwhite explained that while the WEDC utilizes a zero based budget strategy, with Council approval a minimum of $1.07 million could be amassed from Land, Miscellaneous Incentives, and other budget areas for an individual project worthy of that level of investment. Additionally, the WEDC utilizes properties within Premier Plaza and Premier Industrial Park as an incentive for industrial relocation/expansions. Consider, and act upon, Resolution No. 2009-23(R) accepting the proposed property tax rate for fiscal year 2009-2010 and accepting the calculation of the effective tax rate as provided by the Texas Property Tax Code. (L. Vaughan, Finance Director) Staff Comments Finance Director Vaughan addressed council stating that in accordance with the "Truth in Taxation" laws of the State of Texas, the effective and rollback tax rates and other statements and schedules must be published. The proposed budget is based on a tax rate of $0.8989 per $100 valuation. This year's effective tax rate is $0.921992 and the rollback tax rate is $0.971237. Any change in the proposed tax rate will require revision of the proposed budget. Since the proposed tax rate is less than both the effective and rollback tax rate, no public hearings on the tax rate are required. Mayor Pro Tern Byboth asked Finance Director Vaughan if accepting this proposed property tax rate for fiscal year 2009-2010 would tie the council to the amount in the proposed budget as discussed in the prior work sessions. Ms. Vaughan replied that the total costs in the proposed budget would need to remain the same moving forward in order for this tax rate to be finally approved. A public hearing on the proposed 2009-2010 Budget will be held on August 25, 2009. Final approval of both the budget and tax rate will be held September 8, 2009 at the Regular City Council Meeting. McAnnally, Building Official) Staff Comments Building Official McAnnally addressed council stating that staff is presenting the proposed sign ordinance to repeal and replace the existing sign ordinance setting forth new sign regulations in the City of Wylie, Texas. The ordinance seeks to standardize the City of Wylie regulations for sign heights and display areas throughout our jurisdiction. This ordinance has been reviewed and prepared by our City Attorney's office. He explained that the recommended version of the ordinance incorporates the three additional instructions provided by Mayor/Council originated during the July 7, 2009 Joint Work Session. These include: Section 3, Number 2: Appendix A was changed to Appendix C in order to properly reference our current Fee Ordinance. Section 6, Number 5 -A business or nonprofit entity may erect a maximum of three flags per tract of land, only one of which may include the flag for the business and/or nonprofit entity. A flag showing the emblem or logo of a business or nonprofit entity must be located on the same tract of land as that business or nonprofit entity. No flag shall show the emblem or logo of a business or nonprofit entity that is located on a separate tract of land. Sign display intervals not to exceed one for every eight seconds. Mr. McAnnally explained that this sign ordinance is an effort by the City of Wylie Building Inspections to enhance the sign regulations for a more business friendly environment by allowing improvements in advertising and resulting in better business traffic, community aesthetics, public traffic safety and an attempt to limit future unsightly storm or wind damage to new signage in our gateway commercial corridors. Discussion The City of Wylie currently operates three water delivery points from the North Texas Municipal Water District (NTMWD). Delivery Point#1 is comprised of four pumps located on top of a wet well along the outside wall of the original NTMWD Water Treatment Plant. The Water Distribution System Master Plan Update, completed in 2005, assumed that the pumps could be moved to a separate structure and connected to the existing wet well. On February 28, 2006 an engineering agreement was approved for improvements to the three water delivery points. Upon further conversation with NTMWD over the past year, it has been determined that an air gap must be provided between the City of Wylie pumps and the NTMWD supply which the current configuration does not provide. Also, the addition of an air gap will require the construction of a ground storage tank. A new tank site has been selected on Brown Street just west of Eubanks Lane. On March 30, 2009 the City requested that NTMWD participate in the cost of relocating the delivery point. The District agreed to participate in the amount of$475,000 above their normal participation in the cost of construction and installation of a meter and control valve vault. As a result of the design changes, additional funds are necessary to complete the project. The original contract included $85,000 for the design of the pump station and $20,000 has been spent to date. The proposed amendment request $135,000 for the pump station design, $80,000 for the ground storage tank design, $45,000 for the design of the water line along Brown Street, and $30,000 for field surveys, platting, and geotechnical investigation. Water Impact Fees will be used for the increase in design services and the approximate fund balance is $730,000. The projected construction cost for the project is $4,000,000 which will be funded through a combination of the 2007 Certificates of Obligation which included $985,000 for the pump station improvements, water impact fees, and utility fund balance. The scope of the improvements is as follows: 1) The pump station building shall be designed as a slab on grade structure to provide space for five vertical turbine pumps with a rated capacity of approximately 10.7 MGD. 2) Facilities are to include a split face CMU building with a built-up roof, skylights for access to pumps and motors, pump control valves, surge relief valve, transit time meter, and related valves and piping to accommodate the proposed pump configuration. 3) The pump station site shall include a reinforced concrete access drive and parking area for maintenance personnel. 4) An 8-ft. brick screening shall be provided on the sides of the site facing East Brown Street and the future City Park. 5) An irrigation system shall be designed for the grassed areas within the site. 6) Electrical design shall include an air-conditioned electrical control room for the motor control center, switches and SCADA for monitoring and controls for the City of Wylie. August 18, 2009 City of Wylie-Newport Harbor, Nortex and NTMWD Pump Station Improvements Professional Engineering Services Agreement Amendment No. 2 Part 1H: Design Phase Water Distribution Line Preparation of plans and specifications for construction of the a 24-inch water distribution line, along East Brown Street from the proposed State Highway 78 water distribution line to the existing 8-inch water distribution line at Eubanks Lane. Design phase services include: 1) Construction Plan Sheets prepared at a scale of not less than 1"=40' 2) Special Details 3) Cover Sheet, Location Map and Sheet Index 4) Assistance in Preparation of Highway and Utility Permits if Necessary 5) Provide Preliminary Plans for City Review and Franchise Utility Companies Review 6) Attendance At Two Design Review Meetings 7) Formulation Of An Opinion of Probable Construction Cost 8) Preparation of Specifications and Contract Documents We propose to provide Basic Services as described under Part 2: Bidding Phase, and Part 3: Construction Phase in the original agreement for the East Brown Street Pump Station, Ground Storage Reservoir and Water Distribution Line. Field Surveys, Plat Preparation and Geotechnical Investigations are not included in Basic Engineering and are proposed to be provided as described under Part 4: Additional Services in the original agreement. Exclusions from the original agreement also apply to this amendment. We propose replacing the original Exhibit"C"with the Revised Exhibit"C" attached to this amendment. Amendment No. 1 to the Professional Engineering Services Agreement for the Newport Harbor Pump Station,Nortex Pump Station and NTMWD Pump Station Improvements projects reduced the original budget cost for the NTMWD Pump Station Improvements from $85,000 to $50,000. This reduction allowed an increase for the Nortex Pump Station Improvements budget cost from$59,000 to $94,000 related to changes in scope on the Nortex Pump Station Improvements project. Last year, work was stopped on the NTMWD Pump Station Improvements project, as requested. A total of$20,000 has been invoiced for basic design. The$30,000 remaining in the NTMWD Pump Station Basic Engineering budget is applied to the East Brown Street Pump Station Basic Engineering budget. ZC 2009-04 Discussion REQUEST TO REMOVE FROM TABLE At its July 28th meeting, Council tabled the subject request to allow staff additional time to visit with property owners to ensure that those affected are fully aware of the impact of the proposed changes. UPDATE Staff met with the Downtown Merchants Association and presented an overview of the proposal. Part of the discussion included the advantages/disadvantages as mentioned by those citizens in attendance at the July 7th Planning and Zoning Commission meeting. In addition, staff stated the overall vision for the Downtown Historic District and by preserving the historic feel and allowing a mixed use low intense commercial type environment would benefit in keeping downtown vibrant. The general consensus of those merchants in attendance was that there is no downside to extending the district north of Brown and welcomed the change. A follow-up letter was mailed on August 14th to the property owners who expressed an opinion at the July 7th meeting asking for additional input and to offer clarity on the proposed zoning change. As of August 20th two written responses opposing the request had been received by Planning. Staff had the opportunity to speak with a representative for St. Anthony's Catholic Church in regards to their opposition of the request. The church's stance is that they feel inclusion of the church would limit their options for the use of the land. Staff reiterated the guidelines associated with development within the DTH, including reduced parking, light commercial and residential uses comingling, and protection of the old white wood frame church building. It is staff's opinion that the proposed change is fully understood and still opposed by the church. Page 1 of 2 Page 2 of 2 Planning Commission Discussion The Commissioners discussed the current housing make up of the subject area. There are 12 single family dwelling units located within the subject area, of which 5 conform to the current SF-10/24 Approximately 8 structures are conforming to historic design standards. Of the residential structures along Ballard, there are currently two houses vacant. The Commission questioned the reasoning for the requested change. With the higher traffic volume along Ballard and Brown staff reiterated that the area lends itself for a more light commercial type uses as opposed to strictly single-family development. Extending the Downtown Historic District north of Brown would be the simplest approach to allow for more of a mixed use district that is more cohesive with existing downtown district. A few members of the Commission were concerned with the potential increase of traffic that would come to the area with allowing commercial development. While others were concerned with losing the value of the historic flavor and desired to continue the aesthetics of the historic district. Citizens commented that the DTH guidelines were too restrictive and expressed concerns with allowing commercial uses to abut residential properties. While others spoke in favor of the request in that it was a good mechanism to put in place to preserve the historic qualities of the area. Properties owned by Saint Anthony's Catholic Church were discussed at length. The Commission discussed the option of including or excluding the church property within the DTH boundary. The church currently owns 4 parcels/lots (8.3975 acres) within the proposed expansion including a single family dwelling of approximately .5485 acres on the northwest corner of Ballard and Brown. The concept is to maintain and protect the aesthetics of the area as it relates to the vintage look of historical eras. Staff further expressed that allowing the expansion of the DTH would indeed preserve the nature of the existing residential structures and regulate any new development in the subject area. Fifty-seven (57) notifications were mailed to property owners within 200 feet in accordance with State Law. As of July 1, 2009, twelve (12) responses were received; four(4) in favor and eight(8) against the request. A motion was made to approve the requested zoning. The motion failed 3-3. Another motion was made to deny the requested zoning change. The Commission voted 4-2 to recommend denial of the proposed amendment. Consideration The subject area is currently zoned SF-10/24 requiring a minimum dwelling size of 2,400 s.f. with a minimum lot size of 10,000 s.f. as well as a 100%masonry exterior. Extending the DTH would allow commercial uses within residential structures. The extension of DTH to the north will permit new single-family development while allowing existing single- family dwellings to continue and would grant limited commercial development to occur within certain guidelines, and would preserve the historic and architectural qualities of the area while preventing new development that is not cohesive to the existing neighborhood. Because the Commission is recommending denial, it will take a three-fourths majority vote of the Council to reverse the Commission's vote. Currently, the 7.14-acre tract is being used for municipal administrative services, including two temporary modular buildings for Building, Inspections, Code Enforcement and Planning & Zoning services. The specific location of the tower is proposed just to the southwest of these modular buildings adjacent to Centennial Drive. It is anticipated that this site will be converted into City of Wylie, Public Safety Building and Operations Headquarters upon completion of new Wylie Civic Center complex under construction at this time. The radio tower will allow public safety operations (Police & Fire) substantial communication capabilities and coverage within the community and surrounding areas. In addition, this element and upgrade to the City's communication system maintains ISO Class I classification and provides Wylie with regional emergency preparedness capabilities. Page 1 of 2 Page 2 of 2 PLANNING COMMISSION DISCUSSION The Commission discussed what options are available for the tower in regards to aesthetics including screening. One option discussed was to install a brick wall around the structure as opposed to the chain link fence being proposed. The screening would shield from view the base of the tower and the propane tanks. It was further stated that the propane tanks will be located underground and not visible. Ten (10) notifications were mailed to property owners within 200 feet in accordance with State Law. As of July 31, 2009 zero (0) responses were received in regards to the requested zoning change. A representative of 5 tracts spoke not against public safety, but suggested that the tower be enclosed with brick and that the Commission strongly consider the aesthetics or considers rezoning to less restrictive commercial corridor standards. Zoning request signs were provided and properly placed in accordance with Article 8, Section 8.1.3 Posting property for zoning changes. The Commission voted 6-1 to recommend approval as submitted. Recommendation Motion to approve Ordinance No. 2009-22 renaming Valley Stream Circle to Cedar Valley Drive in the Bozman Subdivision. Discussion Applicant: City of Wylie On very rare occasions it becomes necessary to rename or renumber a street to ensure the health, safety and general welfare of the citizens of the City of Wylie is to rename a street. Due to public safety concerns, staff is requesting a street name change within the Bozman Subdivision, The subdivision was final platted in 2003 and created 278 residential lots with 22 common area lots. Valley Stream Drive is a double loaded street with twenty-one (21) residential single-family dwellings. The addresses range from 1301 through 1324. Valley Stream Drive curves into Valley Stream Circle. There are twenty-eight (28) residential single-family dwelling units along Valley Stream Circle. The homes on Valley Stream Circle are addressed from 1300 to 1333. With the confusion of the street names and numbers, it can and will delay emergency response. Over the course of several months, there have been a number of incidents where public safety has been dispatched to the subdivision and actually went to the wrong street. There is no set policy on the renaming of residential streets other than if the request is for surnames of people or the names of corporations or businesses, which requires City Council approval. However, since this request involves several residential dwellings we are seeking direction and approval from Council. No major thoroughfares are affected by the change. Safety issues are the primary concern for the request. The proposed street name of Cedar Valley Drive has been reviewed with Public Safety. 911 Dispatch and all city maps must be updated to reflect all street name changes. The process undertaken in renaming of Valley Stream Circle was to first draft a letter of intent to change the Page 1 of 2 Page 2 of 2 street name and mail to all affected property owners. The letter encouraged the property owner to offer feedback to the Planning Department prior to the meeting. As of August 17, 2009, two responses opposing the request and one in favor of the requested name change were received. Consideration Staff contacted local entities to inquire on the documents they require to officially change a street name. 1. The Postmaster stated that upon receipt of the amended plat and/or Ordinance from the City there would be no further documents required. 2. The County Clerk suggested a "Ratification of Plat" be filed with the county referencing cabinet and page of previously filed plat. The Ratification could be in the form of a letter or a revised plat showing the new street name. 3. Title companies do not require any documentation, as they reference property by legal description not by address. 4. Property owner would be responsible for making the necessary changes for their personal contact details (i.e., stationary,banking, DMV, etc). 5. New street signs would cost approximately $200 to make. Installation would be performed by City of Wylie. Staff recommends that if the request is approved that an Ordinance be adopted to implement the change. The Ordinance would also be the provision to adjust official maps of the City. SECTION 3: Severability. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 4: Savings/Repealing Clause. I ABSOLUTELY OBJECT TO CHANGING THE NAME AND DEMAND THAT THE STREET NAME REMAIN: VALLEY STREAM CIRCLE. It is quite obvious that the Pizza and other food delivery people as well as alarm company employees, repair men,cable people,UPS,the Wylie Police (they had no difficulty finding my address when responding to a call)and others never have any problem finding my address. Perhaps the emergency responders need to review a map of the area and become more familiar with and aware of the street names rather than suggesting such a drastic change in the lives of the many people who call this street home. Emergency responders are just as likely to confuse Cedar Valley Drive with the next street over which is named Cedar Branch Drive. I had the opportunity to purchase a home on that street. did not like the street name. Changing the name SOUNDS like a very simple thing to do, however it would require a significant amount of time,effort and MOST of all EXPENSE if this change were made. I assume that the City of Wylie would be covering all expenses related to such a change as well as reimbursement for each homeowner's time to effect the change in street name for each individual's personal, business and legal documents and accounts, should it be executed. A street name change will require a change to the deed/title to our homes,which will require some legal intervention to make the changes in the legal description and location of our homes and there will be costs to change address on drivers license's,charges for new checks with the address change and on other official records. Additionally,a great amount of time will be required to change the address with all creditors, business associates,State and Government offices, etc. Some could be done online or by USPS (there will be cost for postage)but others will have to be managed by phone,which can require long hold times and a lengthy time required to get the change completed.This might require the individual to take time off work to complete these tasks since they are not work related; therefore the individual should be reimbursed for missed time from work to take care of an unnecessary change implemented by the City of Wylie. Valley Stream Circle is at the end of Valley Stream Drive—which"Circle" indicates. Perhaps a larger street sign indicating the Valley Stream Circle could be posted for those emergency responders who get confused rather than the drastic measure of changing the street name. However any GPS will take one right to the street. Do the Wylie Emergency personnel not have access to GPS?One would assume all emergency vehicles would have this(GPS)capability since most personal vehicles and even cell phones have it today. Forgive me, but this sounds like the emergency personnel made an error and are now concerned about possibility liability,so their answer is to change the street name rather than taking the appropriate steps to assure that they do not make the mistake again. I wonder if any of you have considered the impact that a name change for an established street would have on the residents of that street. On some days, we debated paying for it and eating it ourselves. We could not get Time Warner Cable because they absolutely could not find our house! They would arrive at 1320 Valley Stream every time and then leave! They receive our mail as well and vice versa. When I spoke with you on the phone, you had mentioned that most people were not in favor of the name change. Establishment of Speed Limit. For the above-described zones the prima facie maximum speed limit of 35 miles per hour is hereby established. SECTION 4. Duration of Construction Zone. Such speed limits will be effective for a period of two (2) years or until the signs which are to be erected pursuant to Section 5 below are removed by the City of Wylie, whichever is sooner. Thereafter, the speed limit in the said construction zones will revert to the pre-construction speed limit of 45 miles per hour. The City of Wylie or its designee is hereby directed to erect signs marking the above-described construction zones to indicate that the area is a construction work zone, to indicate where the zone begins and ends, and which state "fines double when workers present." SECTION 6. Penalty Provision. Any person violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum of not less than One Dollar ($1.00) nor more than Five Hundred Dollars ($500.00). The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin a violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 7: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 8: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 9: Effective Date. This Ordinance shall become effective immediately upon its adoption and publication as required by law and the Charter of Wylie.
