CALL TO ORDER
Chairman Larson called the meeting to order at 6:30PM. Present with Chairman Larson
were Vice-Chairman Phillip Johnston, Commissioner Ramona Kopchenko,
Commissioner Willie Osborne, and Commissioner Tim Bennett. Commissioner John
Manganilla and Commissioner Ruthie Wright arrived at 6:33PM.
Staff present was Renae 011ie, Planning Director, Jasen Haskins, Assistant Planner, and
Mary Bradley,Administrative Assistant.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Bennett gave the invocation and Vice-Chairman Johnston led the pledge
of allegiance.
CITIZENS COMMENTS
Chairman Larson opened the Citizens Participation. With no one approaching the
Commissioners Chairman Larson closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the May 5, 2009,
Regular Meeting.
A motion was made by Vice-Chair Johnston, and seconded by Commissioner Osborne,to
approve the minutes from May 5, 2009 Regular Meeting, as submitted. Motion carried 5
—0, with Commissioner Manganilla and Commissioner Wright arriving after the vote.

Public Hearing
1. Hold a Public Hearing and consider a recommendation to the City
Council, amending the zoning from Light Industrial (LI) District to
Corridor Commercial (CC)District for two tracts of land generally located
north and south of Alanis approximately 475 feet west of Century Way.
ZC 2009-03.
Mr. Haskins stated that the subject tracts were originally one tract totaling 8.9558 acres.
In September 2003 the City purchased 1.224 acres for Right-of-Way to expand and align
Alanis to SH 78. Both tracts total 7.7328, with approximately one acre north of the new
Alanis alignment and the remainder south of Alanis.
The applicant is requesting both tracts of land to be rezoned from Light Industrial to
Commercial Corridor. Although the applicant has not submitted a Concept Plan or a Site
Plan, they have indicated an interest to construct a General Merchandise retail use.
General Merchandise or Food Store greater than 5,000 square feet is not allowed by right
within Light Industrial, but is allowed by right within Commercial Corridor.
The property north of Alanis is adjacent to Commercial Corridor zoning district. The
land use map indicates medium density Residential on the south tract and Light Industrial
on the north tract. With the widening and future expansion of Alanis to a four-lane
divided thoroughfare, there is potential for additional zoning changes. Similar zoning
cases allowing Commercial Corridor and Community Retail zoning along the newly
widened and expanded Alanis Corridor have been approved by the Commission and City
Council.
Thirty-seven (37) notifications were mailed to property owners, with five responses
returned,with three in favor and two in opposition of the request.
Commissioner Osborne asked for clarification for the difference between Light Industrial
and Commercial Corridor. Mr. Haskins stated that Light Industrial type of use is not for
public interaction or for consumer on site. Commercial Corridor allows public
interaction, and for consumer coming in and out.
Chairman Larson opened the public hearing.
Ms. Carla Smith, 438 Ewing Way, adjacent property owner, expressed concern of the
screening between the retail use and residential property. Ms. 011ie stated that when a
Site Plan is submitted for development, the Zoning Ordinance requires setbacks and a
type of screen wall between residential and commercial.
Mr. David White, 2801 Vinson Road, represented property owner of the subject property,
stated that the property owner is considering constructing a Dollar Store, totaling no more
than 7,000 square feet building.

Chairman Larson closed the Public Hearing.
A motion was made by Commissioner Kopchenko, and seconded by Commissioner
Osborne, to recommend approval to the City Council, amending the zoning from Light
Industrial (LI) District to Corridor Commercial (CC) District for two tracts of land
generally located north and south of Alanis approximately 475 feet west of Century Way.
ZC 2009-03. Motion carried 7—0.
ADJOURNMENT
A motion was made by Vice-Chair Johnston, and seconded by Commissioner Wright, to
adjourn the meeting at 6:45PM. All Commissioners were in consensus.
