Consider a recommendation to the City Council regarding a Final Plat for Newport Harbor Ground Storage and Pump Station, Block A, Lot 1, establishing an industrial lot on 1.1962 acres and designating utility easements on the property. The property is generally located north of Anchor Drive and Spinnaker Way adjacent to the Newport Harbor Subdivision. 3. Consider and act upon approval of a Conceptual Site Plan for a multi-family development on a single lot consisting of 1.350 acres, generally located at the southwest corner of Cotton Belt and Fleming Drives. Present with Chairman Johnston were, Commissioner Ramona Kopchenko, Commissioner Willie Osborne, Commissioner David Dahl and Commissioner John Manganilla. Commissioner Ruthie Wright, and Vice-Chairman Dennis Larson were absent. Staff present was Renae 011ie, Planning Director, Charles Lee, Senior Planner, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Dahl gave the invocation and Commissioner Manganilla led the pledge of allegiance, and Commissioner Kopchenko led the Texas pledge. CITIZENS COMMENTS Chairman Johnston opened the Citizens Participation. With no one approaching the Commissioners, Chairman Johnston closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the August 18, 2009, Regular Meeting. A motion was made by Commissioner Manganilla, and seconded by Commissioner Osborne, to approve the minutes from August 18, 2009 Regular Meeting, as submitted. Motion carried 5 —0. Minutes September 1, 2009 Wylie Planning and Zoning Board Page 1 of 4 REGULAR AGENDA Public Hearing 1. Hold a Public Hearing and consider a recommendation to the City Council, amending regulations to Zoning Ordinance No. 2001-48, Article 6, as it relates to the proposed addition of Section 6.4 and the creation of the South Ballard Overlay, including district boundaries and design standards and Article 5 as it relates to allowed Uses (ZC 2009-06). Mr. Haskins stated that the purpose of this revision is to create the boundaries and design standards of the South Ballard Overlay (SBO) District and to establish the allowable uses. As market and social conditions change so must our ordinance as it relates to land use, space, design and function. The proposed plan allows for a broad mixture of compatible uses and provides special development and design standards that create a multi-use, pedestrian friendly, sustainable place, that will enhance the architectural character of the area and be compatible with the Historic Downtown. The boundaries of the SBO shall be those lots generally bounded by SH78 on the north, Stone Road on the south, the eastern rear property line of those lots facing Ballard, Birmingham Street to the west, and the western lots facing First Street bordered by SH 78 and Butler Street. In addition, there is an internal boundary, referenced henceforth as the `Core', to allow for single-family uses within the District. As required by law, 261 notices were mailed to surrounding property owners. Twenty-one responses were received in favor and twenty-one responses were received in opposition. Ms. 011ie stated that for the benefit of the citizens attending the meeting, she briefly gave a comparison overview on what the proposed ordinance allows, and the uses that are currently prohibited within the current ordinance. She also summarized the regulations of Non-Conforming Uses. Commissioner Kopchenko recommended that "pavers" be included for sidewalk standards, when describing the type of accent concrete allowed. Commissioner Kopchenko expressed concern of classifying the architecture standards to Victorian Architectural period. The Commissioners discussed in length the definition of Victorian Architectural period. After the discussion, Commissioner Kopchenko stated that within the proposed ordinance, clarifying the Victorian style period ranging from 1837 — 1920. Ms. 011ie stated that in researching the Architectural Standards, the National Historical Society Commission defines the Victorian style from 1827-1901. Ms. 011ie also stated that the Victorian period is not a style, but rather an era or period in time. Chairman Johnston opened the public hearing. Minutes September 1, 2009 Wylie Planning and Zoning Board Page 2 of 4 Mr. John Yeager, 402 Woodhollow, property owner for property off Calloway and Jackson, and College Street, encouraged the Commissioners to consider the results of the proposed ordinance; will the proposed SBO hinder future development or promote future development; and have more flexibility within the ordinance. Mr. Yeager questioned the difference on a new building in comparison to the current ordinance and the proposed ordinance. Ms. 011ie stated the current ordinance prohibits new development from constructing a brick veneer with a rectangle shape. The new development would be required to have 100 percent brick with 20 percent stone, with offsets to avoid a plain box style building. The proposed ordinance requires the minimum height of a building to be thirty feet, allows brick, stone, or hardi-plank and there is flexibility in parking requirements. Mr. Raymond Cooper, 301 Dogwood, property owner of Wylie Christian Care Center, expressed two concerns for the proposed SBO District; one of the concerns was the property owners did not ask for the change; and the second concern was the people making executive decisions for the proposed SBO District do not have invested interest in making the decision objectively. Mr. Cooper stated that the proposed SBO District will impede progress and slow development. Mr. Bob Heath, 4506 E. Parker, owns several properties within the proposed area, and stated that there is a concern for the good of the citizens for the proposed SBO District and will encourage new development along Ballard. There is a demand for unique uses that would be allowed in the proposed district with flexible requirements. The proposed SBO District is a Long-Range plan, the development would not change within the next two to three years, but would improve the neighborhood within the next ten to fifteen years. He further agreed on the Victorian period on the Architectural Standards, which will enhance the neighborhood a lot and opens up a wide variety of architectural styles being not just Victorian. Ms. Alecia Rains, 401 S Ballard Avenue, questioned the meaning of existing property owners; if a homeowner wanted to enclose existing garage, is that allowed. Chairman Johnston stated that the proposed ordinance does not impact the existing property owners in that the owner can continue as is. The existing property owners will not have to move or change to commercial from residential. Ms. 011ie stated that with the proposed ordinance, enclosing garage is allowed. The current ordinance does not allow enclosing garage without a covered parking area. Chairman Johnston closed Public Hearing. The Commissioners discussed in length revising the Victorian style. Ms. 011ie cautioned the Commissioners not to limit or restrict the flexibility for Victorian period development and to be careful of wording. The ordinance needs to speak to both single-family residential and commercial uses. Existing single-family residential uses and zoning abuts site to north, east & west (PD-2000-20) and SF-10/24 residential is to the south. The proposed 2 million gallon water tank is approximately 36 feet in height. Screening and buffering from surrounding residential properties include an existing 6-foot chain link fence and additional landscaping consisting of 22 Junipers and 22 Wax Myrtle trees along the perimeter. Access to the site is provided from southern property line via the alley behind homes facing Anchor Drive. A final plat for the property is on the current agenda for your consideration. The Cotton Belt Duplexes Addition will accommodate five individual buildings 2,420 square feet in size. The subject tract was previously platted as Pinehurst Subdivision in 2005, but was never filed with Collin County. In addition, a site plan was approved for Pinehurst along with the Plat and has since expired. The proposed development will meet the necessary exterior façade requirements of a brick exterior and the required building articulation. Each entry features an approximately 80 square feet porch. New concrete paving will be poured to replace the existing asphalt and will extend Cotton Belt south to the DART rail line. All required parking will be met onsite. A Final Plat along with a Final Site Plan will be considered at a future date.
