CALL TO ORDER
Mayor Swartz called the City Council Meeting to order, July 9, 1996 at 7:30 p.m.
with the following Councilmembers present: Wanda Sparks, Reta Allen, Cleo Adams, Joel
Scott and J. C. Worley. John Mondy arrived during Executive Session.
OATHS OF OFFICE
Newly Appointed and Reappointed Board and Committee Members
Susan Shuler, City Secretary administered oaths of office to the newly and
reappointed boards and commission members. Mayor Swartz presented the board
members with certificates of appreciation.
PRESENTATION
Presentation of Library Design Phase
Danelle Wrightson, with Phillips Swager Associates gave an overview of the library
design phase. She stated that the children's section would have a Railroad Depot theme.
CONVENE INTO EXECUTIVE SESSION
Executive Session Under Section 551.071 Consultation with Attorney
Executive Session was held to consult the City Attorney regarding pending litigation,
City of Parker v. City of Wylie, Cause No. 219.458.96, District Court of Collin County, Texas
219 Judicial District.
Executive Session was held to consult with the City Attorney and seek advise on
contemplated litigation and potential settlement with Texas By Products a/k/a Griffin
Industries.

ACTION ITEMS
Contract with Texas By Products a/k/a Griffin Industries and a Resolution
authorizing the Mayor to Execute
Mondy made the motion to authorize the Mayor and City Secretary to execute an
agreement with Texas By Products to cease operations as a rendering plant. Allen
seconded the motion. The motion was voted on and passed unanimously.
Public Hearing and Consider Approval of an Ordinance Changing the Zoning at
Ballard and Parker to Multi Family
Gary & Lynn Tuggle, 103 Fairmount, Wylie, Texas -They do not want apartments
in their neighborhood. They feel it will increase the traffic.
Chris Taylor, 129 Fairmount, Wylie, Texas - He is opposed to apartments. He
does not want the zone change. The current apartments are not pleasing. He wants nicer
homes built in that area.
Connie Monk, 111 Fairmount, Wylie, Texas - Has lived here 10 years. She does
not see how apartments will improve the area. Does not want an increase in crime.
Ms. Schweppe, 113 Fairmount, Wylie, Texas - Does not want the apartments.
She feels it will bring crime to the community.
Tom Pritzkay, 400 E. Gaston, Wylie, Texas - Speaking on behalf of numerous
residents in the Pointe North Addition. He does not feel that apartments now are being
taken care of and that code enforcement is not taking care of the current violations. He
feels property value would decrease and that traffic would increase. He thinks this would
be a potentially dangerous traffic area.
D. Strait, 104 Windsor, Wylie, Texas - Does not want this zone change.
Mary Shaddox, 109 Fairmount, Wylie, Texas - She has nothing against
apartments but she is opposed to the rezoning of this property. She feels this would over
crowd the elementary schools. She said crime would increase and people will abandon
cars. She feels the apartments will take away from the spacious area.
William Downs, 601 Parker Road, Wylie, Texas - He opposes the apartments.
He said the most current buildings built to codes would turn people off. He said until codes
are adjusted we would like the low rent district. Mr. Downs stated this 16 acres would allow
for 320 units which will accommodate 1,120 people all to city code. He thinks this is
inappropriate. He also thinks it is in inappropriate for someone to buy property, place a
for sale sign and then come to Council to ask them to raise the value.

Rhonda Berryhill, 634 N. Ballard, Wylie, Texas - When she bought her property,
she checked the zoning of the area surrounding her property. She stated apartments can
be nice but after years they deteriorate. She feels apartments do bring crime and wants
it left single family.
Richard Parker, Wylie, Texas - He stated he has lived here all of his life. He feels
Wylie is in dire need of more multi-family housing. He wants the property used as
residential but multi-family. His property is as far North in the city limits of Wylie. He
stated his property buffered from the rest of the City of Wylie and other residential housing
by 250' with no residential housing within the 200' notification. He owns 22 acres South of
this property, zoned residential. Multi family zoning would give him the opportunity to
extend utilities through the 22 acres onto Espinoza's property and tie Ann Lane into Parker
Road. He would like the zoning change considered.
Mr. Parker was asked what the design of these apartments were going to be, wood
or brick veneer and what the rent would be? Mr. Parker stated the rent would be about
$525 per month. Another question asked "What kind of screening?" Parker stated that the
building requirements are in the zoning ordinance.
Public hearing was closed and it was so noted that the proposed ordinance as
written had an error showing approval by the planning and zoning. City Secretary Shuler
noted that the ordinance if approved would reflect that planning and zoning denied the
request.
Scott made the motion to deny the request from agriculture to multi family but that
staff review very quickly the multi family placements and if Mr. Parker wants to re-approach
Planning and Zoning he can do so. Mondy seconded the motion. The motion was voted
on and passed unanimously.
Approval of Minutes from June 18 and June 25, 1996
Scott made the motion to approve the minutes and Mondy seconded. The motion
was voted on and passed unanimously. The motion was voted on and passed

Consider Approval of an Ordinance Requiring Sprinkler Systems in New
Construction
Allen made the motion to table and Mondy seconded the motion. The motion was
voted on and passed unanimously.
Consider Approval of an Ordinance Designating Certain Areas of the Community
Park as No Parking Areas
ORDINANCE NO. 96-26 PROVIDING FOR DESIGNATED NO PARKING ZONES
ALONG CERTAIN PORTIONS OF COMMUNITY PARK IN THE CITY OF WYLIE,
TEXAS ALLOWING FOR THE ACCESS OF EMERGENCY VEHICLES;

PROVIDING FOR NOTIFICATION BY THE INSTALLATION OF SIGNS AND
MARKINGS; PRESCRIBING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE; PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY
CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE
PUBLICATION OF THE CAPTION HEREOF.
Mindy Manson, Assistant to the City Manager, gave an overview of the parking area
and how dome post and cable will be installed. She stated this was being done to allow
access for emergency vehicles. Adams made the motion to approve the ordinance and
Sparks seconded the motion. The motion was voted on and passed unanimously.
First Reading of an Ordinance Amending the Refuse Collection Contract to Add
Brush and Bulky Pick Up
Mayor Swartz read the heading of the ordinance.
Consider Contract for Meter Reader Services
Mondy made the motion to table and Allen seconded the motion. The motion was
voted on and passed unanimously.
Authorizing the Mayor or City Manager and the City Secretary to Execute Contract
Agreements with Railway Entities for Utility and Access Crossings and Related Work
in Association with Capital Improvement Projects
Scott made the motion to approve and Allen seconded the motion. The motion was
voted on and passed unanimously.
STAFF REPORTS
Mike Collins, City Manager, stated that signalization for the FM544 and 1378 was
on schedule to be put in place by the first of August.
Brady Snellgrove stated that Council was give the April and May expenditures and
he would be happy to answer any questions that Council might have for him.
