08-13-1996 (City Council) Minutes Minutes of the Wylie City Council August 13,1996 CALL TO ORDER Mayor Swartz called the City Council Meeting to order, August 13, 1996 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, Cleo Adams, Reta Allen, Joel Scott, John Mondy and J. C. Worley. Bill Rushing, Police Chief gave an update on the FM1378 and FM544 traffic congestion due to the opening of the new Wylie High School. He also gave an update on the timing of the traffic lights. RECESS INTO WORKSESSION Mike Collins, City Manager stated that Council had requested additional information for brush and bulk pick-up. Information on the possibilities for pick-up and the options for financing the pick-ups were given to Council. ACTION ITEMS Second Reading of Ordinance, Receive Public Comment, and Act Upon Amending the Refuse Collection Contract to Add Brush and Bulk Pick-Up with Browning Ferris Industries (BFI) Mondy made the motion to table the brusk and bulk ordinance and to give the City Manager authority to work an agreement to benchmark a pick-up for the Labor Day Week. Allen seconded the motion. The motion was voted on and passed unanimously. Approval of a Contract for Meter Reader Services Collins stated that the part time meter reader has not been productive. Staff was made aware of a company that offers cities to used privatized meter readers. He stated that the full time reader will continue his position and help out part time with animal control and light duty maintenance. Tom Ise with TCS gave an overview of the services provided by the meter reader. He stated they will furnish a full time employee and a vehicle. Ise also stated that they guarantee no skips and an error rate not to exceed two errors per one thousand readings. Scott made the motion to approve the contract with TCS for meter reader services. Sparks seconded the motion. The motion was voted on and passed unanimously. Minutes of the Wylie City Council,August 13, 1996, Page 1 Resolution No. 96-16 Authorizing the Wylie Independent School District to Solicit from the Public Sealed Bids on Lot 2, Block B of the Creek Bend Industrial Park, Collin County, Texas Brady Snellgrove, Finance Director explained that this property has unpaid taxes and that the Collin County Commissioners Court ruled a judgement given to the school district to solict bids on the property for all of the concerned parties that taxes were owed. Mondy made the motion to approve the resolution authorizing the WISD to solicit bids. Scott seconded the motion. The motion was voted on and passed unanimously. Contract to Dale Wigington for the Operation of the Batting Cages at Community Park Mindy Manson, Assistant to the City Manager gave an overview of the lease agreement for the batting cages. She stated the term is reduced from 5 to 3 years. She also stated the Park Board recommends rental payment either to be $240 of 12% whichever is greater. Also she stated that Wigington ask to be permitted to sell snacks during hours of operations. Dale Wigington, proposed owner of the batting cages would like to propose lowering the $240.00 per month. Mondy made the motion to table the item and refer Mr. Wigington back to the Park Board to consider amendments to the lease agreement. Adams seconded the motion. The motion was voted on and passed unanimously. Contract for the Reconstruction of Approximately 1,100 Linear Feet of Alleys in the Butler and Dogwood Streets Area Greg MacLean stated that alleys were identifed for reconstruction, letters of notification were sent to property owners and a town hall meeting was held with only one person attending. He stated construction is estimated to begin as soon as possible and will take about six weeks to complete. He also stated ample notice will be given to the property owners in order for them to make arrangements for any inconveniences during construction. MacLean recommends McMahon Contracting, Inc. be awarded the contract for$79,525.85. Worley made the motion to award the contract to McMahon Contracting, Inc. and Mondy seconded the motion. The motion was voted on and passed unanimously. Ordinance No. 96-27 Amending the Zoning Classification of Property Described as Block 21, Lots 13, 14, 15 and 16 in the Railroad Addition, in the City of Wylie, Collin County, Texas, Locted at 103 South Second Street, from "R" Retail tgo "B-1" Business District with a Specific Use Permit; Amending the Comprehensive Zoning Ordinance (Ordinance No. 85-23A); Amending the Zoning District Map (Ordinance 91-12, Ordinance 91-13); and Repealing All Conflicting Ordinances; Containing a Serverability Clause; and Providing for an Effective Date Mike Phillips, Director of Community Development stated that Guy Poole requested from Retail "R"to Business 2 "B-2". He stated that staff recommended denial for B-2 but Minutes of the Wylie City Council,August 13, 1996, Page 2 recommended granting B-1 with specific use for outside sales relating to feed seed store businesses. He also stated that Planning and Zoning had recommended B-1 and attached a condition to not sell any animals weighing more than seven pounds. Phillips said that staff did not recommend the condition attached to the zoning and that screening will be required on the East and South side of the business. Guy Poole with Poole Feed & Supply requested that his property be rezoned so he can rebuild when the widening of Highway 78 is underway. Worley made the motion to approve the zoning request from R to B-1 with a specific use permit. Allen seconded the motion. The motion was voted on and passed unanimously. Final Plat for the Heath Addition Submitted by Robert Heath, Located South of Highway 78 and East of Eubanks Lane Phillips stated that this is the final plat for construction and this will give Robert Heath the opportunity to submit the plans for development. Scott made the motion to approve and Mondy seconded the motion. The motion was voted on and passed unanimously. Resolution No. 96-15 Accepting the Proposed Property Tax Rate for Fiscal Year 1996- 1997; Accepting the Calculation of an Effective Tax Rate; Establishing a Date for Public Hearing on the Proposed Tax Rate; and Providing for the Publication as Provided by the Texas Property Tax Code Sneligrove stated that the truth in taxation law required the vote to call for a public hearing on the proposed tax rate, which all voted yes. He also stated a public hearing would be held at the September 10th meeting. STAFF REPORTS Collins stated that a voice mail system was being researched. He also stated that several staff members would be touring the Presbyterian Healthcare Systems Emergency Center. Collins said staff would be meeting with a company interested in locating to the area. CITIZENS PARTICIPATION Roger Smith,speaking for the crossing guards, would like to see striping and flashing lights at the Birmingham Elementary School. He would also like to have the option to have a flag or a stop sign.
