09-10-1996 (City Council) Minutes Minutes of the Wylie City Council September 10,1996 CALL TO ORDER Mayor Swartz called the City Council Meeting to order, September 10, 1996 at 7:00 p.m. with the following Councilmembers present: Wanda Sparks, Cleo Adams, Reta Allen, Joel Scott, John Mondy and J. C. Worley. PROCLAMATIONS U. S. Constitution Week Mayor Swartz read a proclamation declaring September 17-23, 1996 as U. S. Constitution Week. Betty Stephens accepted the proclamation on behalf of the Daughters of the American Revolution. September 1996 as PTA Month Mayor Swartz read a proclamation declaring September 1996 as PTA Month in Public Schools. PTA Presidents and school representatives from Akin Elementary, Hartman Elementary and Wylie High School accepted the proclamation. Celebrate Character Mayor Swartz read a proclamation declaring August 1996 through May 1997 as Celebrate Character. Representatives from each school were present to accept the proclamation. PRESENTATIONS TCI Cablevision Joan Holtzclaw with TCI Cablevision gave an overview of the services available to Wylie customers. She stated that TCI was continuing to upgrade the services in Wylie. Minutes of the Wylie City Council, September 10, 1996, Page 1 PUBLIC HEARINGS Public Hearing for Proposed Tax Rate and Operating Budget for Fiscal Year 1996- 1997 Brady Snellgrove, Finance Director gave a brief overview of the operating budget and tax rate for Fiscal Year 1996-1997. Mayor Swartz opened the public hearing and there was no public comment. The public hearing was closed. First Public Hearing for the Annexation of 47.21 Acres in the Richard Newman Survey, Abstract No. 1072 in Dallas County, Texas and Owned by C. J. and Hortense Thomsen Mike Collins, City Manager gave an overview of the proposed annexation. He stated that a developer had an agreement with the owner of the property to develop the property. Collins also stated that this acreage was a pocket surrounded by property already in the city. Mayor Swartz opened the public hearing and there was no public comment. The public hearing was closed. Public Hearing and Consider Zone Change Request by Ron Heffner from "R" Retail to "B-1" Business District for Property Located at 202 S. Ballard, Block 23, Lots 2B, -- 3B, 4B, 4C, 5A, 5B, 6A, 6B in the Railroad Addition Kelly Shaw, City Planner, gave a brief description of the zoning change and the location. He stated that Alaskan Air Conditioning and Hearing Inc. conforms to the requirements of B-1 zoning. He also stated that staff recommends approval on the zone change request. Mondy made the motion to approve the zone change from "R" to "B-1". Worley seconded the motion. The motion was voted on and passed unanimously. ORDINANCE NO. 96-29 AMENDING THE ZONING CLASSIFICATION OF PROPERTY DESCRIBED AS BLOCK 33, LOTS 2B, 3B, 4B, 4C, 5A, 5B, 6A AND 6B IN THE RAILROAD ADDITION, IN THE CITY OF WYLIE, COLLIN COUNTY, TEXAS, LOCATED AT 202 SOUTH BALLARD AVENUE, FROM "R" RETAIL TO "B-1" BUSINESS DISTRICT; AMENDING THE COMPREHENSIVE ZONING ORDINANCE (ORDINANCE NO. 85-23A);AMENDING THE ZONING DISTRICT MAP (ORDINANCE NO. 91-12, ORDINANCE NO. 91-13); AND REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE;AND PROVIDING FOR AN EFFECTIVE DATE. ACTION ITEMS Final Payment to East Texas Construction Company for Work Completed in the Premier Business Park Collins stated that work had been completed on the Premier Business Park. He stated the project included a new 37' wide concrete street with underground drainage facilities, a new 8" water main along Hensley Lane with a new 12"water main extension along Sanden Blvd. to Highway 78. He also stated that the final acceptance of Premier Industrial Park would initiate the one year maintenance bond. Mondy made the motion to Minutes of the Wylie City Council, September 10, 1996, Page 2 approve the final payment to East Texas Construction Company. Scott seconded the motion. The motion was voted on and passed unanimously. Authorize City Manager to Enter Into a Contract with J. D. Schick Contractors for the Renovation of the Community Center Mindy Manson, Assistant to the City Manager, gave an overview of the Community Center Renovation. She stated that one bid was received at $245,000 which was over the allocated budget. Scott Roberts, with Creative Architects stated that because of the holiday, the short time given to receive bids, and due to contractors and subcontractors having plenty of other jobs. Mondy made the motion to authorize the city manager to enter into a contract with J. D. Schick Contractors not to exceed $200,000. Worley seconded the -motion. The motion was voted on and passed unanimously. STAFF REPORTS Collins stated that all the property owners on Steel Road had been notified of the proposed temporary road repair. He stated all but two have returned the written notification giving their approval. Collins stated that Jack Jones, Supt. of Public Works is in the process of evaluating the need for sidewalks on Kirby Street by Hartman Elementary. EXECUTIVE SESSION Executive Session was held under Section 551.075 Conference with Employees to receive information and question employees regarding pending litigation, City of Parker v. City of Wylie, Cause No. 219.458.96, District Court of Collin County, Texas 219 Judicial District. Executive Session was held under Section 551.072 Deliberations about Real Property concerning the Knickerbocker Project Negotiations with the Wylie Economic Development Corporation and the City of Wylie.
