'- RESOLUTION NO. 7 1- 164 A RESOLUTION OF THE CITY OF WYLIE, TEXAS, REQUESTING THE DESIGNATION OF THE NORTH TEXAS MUNICIPAL WATER DISTRICT AS THE REGIONAL WASTE WATER TREATMENT AGENCY FOR THE EAST FORK OF THE TRINITY RIVER AND PROVIDING FOR CERTAIN CONDITIONS IN THE ORGANIZATION OF THE REGIONAL WASTE WATER TREATMENT AGENCY. WHEREAS, the City of Wylie has a vital interest in waste water treatment in the East Fork of the Trinity River Basin due to environmental and economic considerations~ and WHEREAS, the City of Wylie is responsive to the concept of a Regional Waste Disposal System for the good of the inhabitants of the entire region~ and WHEREAS, the City of Wylie desires that the North Texas Municipal Water District be named as the Regional Waste Water Agency in order that the most beneficial results are possible for all the cities of the region: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE: SECTION I. That, after careful deliberation and consultation with other cities of this region, the City of Wylie requests the designation of the North Texas Municipal Water District as the Regional Waste Water Treatment Agency for the East Fork of the Trinity River for the following reasons: A. The NTMWD has the legal authority to implement a Regional Waste Water Treatment System under the existing Statures of the State of Texas. B. The NTMWD has served most of the region with potable water for many years and has a vital and proven interest in pollution control in the East Fork Watershed. c. The NTMWD is democratically constituted and provides representation to its member cities on a fair and equal basis and has proven its responsibility and .:-.-..-_.....=_"';..;:.:,;,=.~-iI~:.::..-~',.~.:;:;;;~.,~..;,J:.~~".......,....."...........l.'-..- .L- ,.vi.....- .. ... "'I Page 2. responsiveness to the cities it serves as customers. D. The NTMWD provides the most economical vehicle for a Regional Waste Water Authority because of its existing staff and facilities. E. The NTMWD has the unquestioned financial ability and financial integrity to fund a regional system. SECTION II. That the cities of this region negotiate with the North Texas Municipal Water District toward the establish- ment of a regional entity to operate a regional waste water system and that such entity be composed of representatives from each municipality that contributes effluents to said system. SECTION III. That the following conditions be considered in the negotiations referenced in Section II: A. That uniform rates prevail to the system's members. B. That a city be reimbursed for its waste water treat- ment facilities when the authority assumes control of or phaseds out said facilities. C. That the Regional Authority shall have no licensing or permit control over any city's waste water customers. D. That the effluent produced by the plants in the region under the control of the Regional Agency be available to all member cities on some reasonable basis and that consideration be given to the participating cities for waste water flows contributed to the system which may be sold or reused. Hackler, Mayor Oneida Gallagher, City Secretary RESOLUTION WHEREAS, THE WYLIE HIGH SCHOOL BAND has strived to bring a uniqueness to its performance1 and WHEREAS, these performances have helped to develope pride ~n the Wylie School System and the City of Wylie1 and WHEREAS, the City of Wylie supports the activities of the band; NOW THEREFORE, BE IT RESOLVED that public recognition be given the Wylie High School Band and acknowledgement of a job WELL DONE is herewith expressed by the City Council. ~t t~~1 c.l-L.../ C.
