RESOLUTION 88-9-27-88
RESOLUTION DESIGNATING THAT SEWER PLANT PASS
THRU REVENUES WILL BE USED FOR DEBT SERVICE
REQUIREMENTS FOR CAPITAL IMPROVEMENTS TO
WYLIE WASTEWATER TREATMENT PLANT AND
COLLECTION SYSTEM IMPROVEMENTS AND ONLY FOR
LIFE OF BONDS FOR THOSE IMPROVEMENTS:
WHEREAS, the Wylie City Council wishes to continue with its
program of compliance regarding the Texas Water
Commission's Administrative Enforcement Order
dated June 24, 1987; and
WHEREAS, to comply with orders of the Texas Water
Commission (TWC), the City has undertaken a
substantial financial commitment to bring the
City's wastewater treatment facilities into
compliance with the TWC mandate and stricter
environmental standards; and
WHEREAS, the City has undertaken a $2 million Capital
Improvement Program to update the City's
wastewater treatment plant thru NTMWD and Texas
Water Development Board; and
WHEREAS, the City is also addressing the wastewater
collection system problems mandated by the TWC
Enforcement Order thru long-term debt and
construction of new sewage collection mains and
lift stations; and
WHEREAS, the results of these programs will cause
substantial increases in City utility rates; and
WHEREAS, the City Council is considering a pass-thru charge
for the additional debt payments in the 1988-89
budget and subsequent years that is ear-marked for
the retirement of this debt; and
WHEREAS, the City Council reduced expenditure proposals in
the Utility Fund by over $50,000 in an effort to
minimize utility increases; and
WHEREAS, debt services requirements for the sewer plant are
$256,750. for fiscal year 1988-89 while another
$65,500 is required for debt service requirements
on mandated sewage collection system improvements;
and
WHEREAS, the Council wishes to have this sewer plant pass-
thru charge only for the life of the bonds for
sewer plant and collection system improvements
and the revenues from the pass-thru used for only
bond payments for these improvements in
accordance with the City Charter, Article VII,
Section 4, sub-paragraph E;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, COLLIN COUNTY, TEXAS:
That the sewer plant pass thru charges will be
for the term of bonds issued for the
improvements and expansion of the wastewater
treatment plant (NTMWD Contract Bonds 1988) and
collection system improvements, (Wylie C.O.'s,
1988).
BE IT FURTHER RESOLVED: That the revenues received from
the sewer plant pass thru charge will be
dedicated and utilized for the annual principal
and interest payments on these bonds and that the
pass-thru charge will be re-examined on at least
an annual basis and may be adjusted depending on
utility customer base and share of plant and
improvement expenses.
