RESOLUTION FOR THE CITY OF WYLIE, TEXAS
SUPPORTING THE AMENDED WASTEWATER COLLECTION
SYSTEM CONSTRUCTION PLAN AND SCHEDULE, AND
THE AFFIRMATION OF THE CONTRACT SALES
AGREEMENT WITH NORTH TEXAS MUNICIPAL WATER
DISTRICT FOR CONSTRUCTING THE WASTEWATER
COLLECTION SYSTEM IMPROVEMENTS:
WHEREAS, The City Council agrees that it is in the best interest
of all of the citizens of Wylie to comply with the
Texas Water Commission (TWC) Enforcement Order,
provision L, (requires the City of Wylie to eliminate
all "Pump and Haul" operations and undersized sewer
facilities); and,
WHEREAS, The City Council agrees that it is in the best interest
of all of the citizens of Wylie and the surrounding
area to responsibly collect and transport wastewater to
the Wylie wastewater treatment plant; and,
WHEREAS, The City Council agrees that it should adopt a revised
wastewater collection system improvement plan (plan)
; and,
WHEREAS, The City Council agrees that the City of Wylie is cur-
rently undergoing a financially difficult period; and,
WHEREAS,
The City Council agrees that there is
need to secure and use the assistance

Water District should apply to the Texas Water Develop-
ment Board for funding for the wastewater collection
system improvements; and,
WHEREAS, The City Council agrees that the proposed revised
wastewater collection system improvements will require
an extension of the time schedule of the conditions
specified in the June 24, 1987 Enforcement Order;
therefore, requiring the City to request a time
extension on the completion of these improvements so as
to meet the conditions of the enforcement order;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1 REVISED PLAN
In an effort to meet the requirements of the TWC
Enforcement Order the City Staff has prepared a revised
plan, the attached Exhibit A, which addresses the
deficient conditions noted in the Enforcement Order.
This plan addresses the incompleted capital
improvements program required by the Enforcement Order
at an estimated cost of $1,800,000. This plan, if
approved, will act to eliminate the existing pump and
haul method of transporting wastewater and address
existing collection system inadequacies.
SECTION 2 WASTEWATER COLLECTION SYSTEM CONSTRUCTION SCHEDULE
The attached Exhibit B, Wastewater Collection System
Construction Schedule (schedule), is the schedule to be
submitted to the Texas Water Commission for approval
and will be carried out with the utmost diligence.

SECTION 3 FINANCING
Furthermore, North Texas Municipal Water District is
authorized to apply for funding from the Texas Water
Development Board for the estimated amount of
$1,800,000 for the construction of the wastewater
collection system improvements.
SECTION 4 CONTRACT SALES AGREEMENT WITH NORTH TEXAS MUNICIPAL
WATER DISTRICT
The Contract Sales Agreement with North Texas Municipal
Water District executed June 25, 1987 is hereby
reaffirmed, especially the commitment to pledge the
necessary utility system revenues and, if necessary,
property tax revenues for the purposes of meeting debt
service payments to North Texas Municipal Water
District for the retirement of the bonds.
SECTION 5 REQUEST FOR A TIME EXTENSION TO MEET THE CONDITIONS OF
THE TEXAS WATER COMMISSION ENFORCEMENT ORDER
The City of Wylie respectfully requests that the TWC
grant a reasonable time extension for completing the
proposed amended wastewater collection system
improvements (Exhibits A & B) submitted by the City on
or before January 20, 1989 to the TWC Staff. The
reasons for this request are as follows:
The original plan did not adequately address the needs
for reliably solving the existing facility deficiencies
(i.e. undersized lift station pumping capacities at the
Park Lift Station and the Southfork Mobile Horne
Community Lift Station System, and the insufficient
capacity for added growth in the Rush Creek Lift
Station District) .
Moreover, the Staff has struggled with the dilemma of
finding a palatable financing and construction plan
that could be included in the ongoing collection system
improvements and paid for through the existing
operating budget and capital improvement plan given the
fact that the water and sewer rates have been increased
sixty-four percent (64%) in eighteen (18) months to
fund the wastewater treatment plant expansion and the
initial stages of the wastewater collection system
improvements.
However, financing with existing resources was not
feasible; therefore, Staff finally resolved to
recommend the additional debt borrowings necessary to
fund the revisions to the plan.
