'!J. -' '1 RESOLUTION NO. 99-? -,;)5- q,;:)-V A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS DECLARING AN URGENT NEED AND PRIORITY FOR THE WIDENING AND IMPROVEMENT OF HIGHWAYS SH 78 AND FM 544 INTO AND THROUGH THE CITY OF WYLIE, FURTHER DECLARING THE CITY'S WILLINGNESS TO ASSIST IN SUCH PROJECTS AND COMMITTING THE CITY TO FUND A PORTION OF THE RIGHT-OF-WAY ACQUISITION AND A PORTION OF THE UTILITY RELOCATION NECESSARY AND INCIDENT THERETO. WHEREAS, the City of Wylie has long awaited and anticipated the widening and improvements of Highways SH 78 and FM 544, having been given assurances that the improvements to both roads was to be commenced in the near future, with such assurance dating back to the late 1970's in relation to SH 78 at which time the City was told construction would begin within two years; and, WHEREAS, said improvements are vital not only to the general welfare of Wylie and Collin County, but also to continued development of the entire North Texas Region; and, WHEREAS, the need for such improvements has been growing each year, as the migration from North Dallas and other areas of the Metroplex increased the population of the general area manyfold, to the point where such improvements are an absolute necessity for improving traffic congestion, maintaining air quality, and facilitating economic development; and, WHEREAS, requisite public hearings and environmental hearings have been conducted and approved; and, WHEREAS, final right-of-way maps for both said projects are completed and available to facilitate accurate acquisition of right-of-way and utility relocation; and, WHEREAS, the City of Wylie is willing to make commitments to fund substantial portions of the costs of right-of-way acquisition and utility relocation which may be necessary for both such projects; NOW, THEREFORE, BE IT RESOLVED BY THE WYLIE CITY COUNCIL, as follows: 1. The City of Wylie hereby expresses it's position of continuing commitment to take all such reasonable actions which it may lawfully take to facilitate widening and improvements to SH 78 and FM 544 within the City of Wylie. ...."" The commitment herein stated shall specifically include, without limitation, the City's committing to the following funding assistance, to wit: SH 78 10% of Right-of-Way acquisition costs 10% of Utility relocation costs FM 544 100% of Right-of-Way acquisition costs 100% of Utility Relocation costs said costs being for relocation and acquisitions necessary within the corporate limits of the City of Wylie. 3. The actual payment of such costs and facilitation of such acquisitions, as set forth in the preceding paragraph shall be contingent upon receipt of a firm commitment by the State Highway Department and/or North Texas Counc il of Governments tha t such construction will be commenced within the twelve month period following such commitment. 4. The City Manager is hereby empowered and authorized to enter into agreements and execute such documents as may be necessary to hasten commencement of such improvements.
