Resolution 93-20 RESOLUTION NO. 9~ c)o A RESOLUTION OF THE CITY OF WYLIE, TEXAS ESTABLISHING PROCEDURES AND POLICIES FOR CITY STAFF TO FOLLOW WHEN AN APPLICATION FOR USE AND/OR OCCUPANCY OF PROPERTY IS RECEIVED DURING THE PENDENCY OF PROCEEDINGS BEFORE PLANNING AND ZONING COMMISSION WHICH COULD RESULT IN CHANGING THE ALLOW ABLE OR SPECIFIC USES FOR THE PROPERTY IN THA T CLASSIFICATION WHEREAS, the City routinely receives applications for uses within a particular zoning classification which are not one of the specified allowed uses; and, WHEREAS, upon receipt of such application the appropriate person on the City Staff must make a decision as to whether the intended use is of either not allowed, or possibly allowed as a use of a similar nature and character of the intended uses; and, WHEREAS, the decision of whether such intended use is allowed, or not, may be effected by the outcome of an review proceedings then pending before the Planning and Zoning Commission (P&Z) and/or the City Council and therefore if an application is received during the pendency of any such review actions it would be consistent with orderly development and use of properties within the City to delay taking action on such application pending the outcome of the review proceedings then in progress; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, as follows: I. In those instances where the staff shall receive an application for occupancy of the property and there is at that time proceedings pending whereby P & Z and City Council will be considering changing the zoning ordinance in such a fashion that it would effect the granting of the application, the staff shall delay taking action on such application until final resolution of the review proceedings by City Council. II. This Resolution and the procedures herein established shall become effective immediately on the passage hereof.
