Resolution 94-25 RESOLUTION NO. t1/-d~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, ACCEPTING A PRELIMINARY AGREEMENT REGARDING THE DEVELOPMENT OF A TRI-CITY ANIMAL RETENTION CENTER; PROVIDING FOR THE SITE LOCATION, PROVIDING FOR THE ACQUISITION OF LAND AND AGREEING TO PRELIMINARY TERMS FOR THE DETERMINATION OF SHARED COSTS WHEREAS, the cities of Wylie, Sachse, and Rowlett have identified independent animal shelter needs in their respective communities that are common to each city; and WHEREAS, the cost of providing an animal retention facility for each individual community would be more burdensome than the development of a common shelter to be jointly shared by all three cities; and WHEREAS, the cities of Wylie, Sachse, and Rowlett have identified an urgent need for a satisfactory solution to the issue of animal retention; and WHEREAS, the cities of Wylie, Sachse, and Rowlett have mutually agreed to share responsibility in the search and solution of common community needs NOW THEREFORE BE IT RESOLVED by the City Council of the City of Wylie, Texas, that: SECTION 1. The City of Wylie does hereby agree to the joint development and use of an animal retention facility with the cities of Sachse and Rowlett with preliminary terms as established herein. SECTION 2. Such facility is agreed by the City of Wylie to be located within the City limits of the City of Sachse in a location mutually agreeable to and reasonably accessible by the three cities involved. SECTION 3. The cities of Wylie, Sachse, and Rowlett, will share in the cost of funding the land acquisition, architectural design, engineering, and all construction costs by percentage to be determined as follows by the latest population estimates of the North Texas Council of Governments until further revised: Wylie Sachse Rowlett 9,050 6,500 30,250 19.76% 14.19% 66.05% SECTION 4. That said pro-rata percentages shall be reviewed every TWO(2) years for population variations for the evaluation of shared cost for facility construction and will be exclusive of operation and maintenance costs. SECTION 5. That operating and maintenance costs shall be shared by the three cities involved based on the level of usage (number of animals transported) by each participating city. SECTION 6. That a Board of Directors consisting of representatives of each participating city shall oversee the general operations of the facility and shall hire an administrator to operate and maintain the facility on a regular basis. Each respective City Council will retain budgetary control over the facility. SECTION 7. That the City of Wylie does hereby agree to the retention of an architect to begin preliminary design of the facility and does also hereby agree to allow the purchase of land and to proceed with an estimated construction cost of $290,000 to $350,000. SECTION 8. That each individual participating city maintains funding and budgetary responsibility for its pro-rata portion of the development costs and its on-going portion of general operating costs. SECTION 9. That a Tri-City Committee is hereby authorized to actively seek and acquire grant money to defy portions of the cost of the project if possible.
