RESOLUTION NO. .J , ,
A RESOLUTION amending Resolution No. 94-36 ordering a
bond election to be held in the city of Wylie,
Texas, making provision for the conduct of the
election and resolving other matters incident and
related to such election.
WHEREAS, on the 13th day of December, 1994, the City Council
of the city of Wylie, Texas ordered a bond election to be held
within the City on February 18, 1995; and
WHEREAS, the City council has determined such resolution
ordering the bond election should be amended and restated to
provide for the ballot propositions, proper notice of the bond
election, etc-; now, tberefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS:
SECTION 1: Sections 1 through 4 and Section 6 through 10 of
Resolution No. 94-36 passed and adopted by the City Council on
December 13, 1994, shall be and are hereby amended and restated to
read as follows:
"SECTION 1 ~ An election sball be held on the 18th day of
February, 1995, in the City of Wylie, Texas, which date is not less
than fifteen (15) nor more than ninety (90) days from the date of
the adoption hereof and the holding of the election on such date
rather than on a uniform election date is hereby found to be in the
public interest. At such election, the following measures shall be
submitted:
PROPOSITION NUMBER 1
"SHALL the City Council of the City of wylie,
Texas, be authorized to issue general obligation bonds of
the city in the principal amount of $3,000,000 for
permanent public improvemente and public purposes, to
wit: street improvements including drainage, curbs,
gutters and alleys; such bonds to mature serially or
otherwise over a period not to exceed FORTY (40) years
from their date, to be issued and sold in one or more
series at any price or prices and to bear interest at any
rate or rates (fixed, floating, variable or otherwise) as
shall be determined within the discretion of the City
Council at the time of issuance or sale of the bonds; and
whether ad valorem taxes shall be levied upon all taxable
property in the City sufficient to pay the annual
interest and provide a sinking fund to pay the bonds at
maturity?"

PROPOSITION NUMBER 2
"SHALL the city council of the city Of Wylie,
Texas, be authorized to issue general obligation bonds of
the city in the principal amount of $4,000,000 for
improvements and extensions to the City's water and sewer
system including but not limited to an ele~ated water
tower and appurtenant facilities; such bonds to mature
serially or otherwise over a period not to exceed FORTY
(40) years from their date, to be issued and sold in one
or more series at any price or prices and to bear
interest at any rate or rates (fixed, floating, variable
or otherwise) as shall be determined within the
discretion of the City council at the time of issuance or
sale of the bonds; and whether ad valorem taxes shall be
levied upon all taxable property in the city sufficient
to pay the annual interest and provide a sinkin9 fund to
pay the bonds at maturity?"
"SECTION 2: paper ballots shall be used for said election,
which ballots shall be prepared in accordance with the V.T.e.A.
Election Code so as to permit the electors to vote "FOR" or
"AGAINST" the aforesaid measures which shall appear on the ballot
substantially as follows:
PROPOSITION NUMBER 1
"THE ISSUANCE OF $3,000,000 GENERAL OBLIGATION BONDS
FOR STREET IMPROVEMENTS"
PROPOSITION NUMBER 2
"THE ISSUANCE OF $4,000,000 GENERAL OBLIGATION BONDS
FOR WATER AND SEWER SYSTEM IMPROVEMENTS AND
EXTENSIONS INCLUDING BUT NOT LIMITED TO AN ELEVATED
WATER TOWER"
"SECTION 3: The City shall be divided into two election
precincts for this election and the polling places designated for
each election precinct and the persons hereby appointed to serve as
Presiding Judge and Alternate Presiding ..Judge for each polling
place are shown in Exhibit "A", Which is attached hereto and
incorporated herein by reference as a part hereof for all purposes.
Each presiding Judge shall appoint not less than two (2) nor
more than eight (8) qualified clerks to serve and assist in holding
said election; provided that if the Presiding Judge herein
appointed actually serves, the Alternate Presiding Judge shall be
one of the clerks.
on election day, the polls shall be open from 7:00 A.M. to
7:00 P.M.

Early voting shall be conducted at the City secretary's office
in the Wylie city Hall, 2000 Highway 78 North, Wylie, Texas
(Mailing Address: P.O. BOJe 428, Wylie, Texas 75098-0428), in
accordance with the provisions of V.T.C.A., Election Code. Early
voting for this election shall begin January 30, 1995, and end
February 14, 1995, and the hours designated for early voting by
personal appearance shall be from 8:00 A.M. to 5:00 P.M. on each
day, except Saturdays, Sundays and official state holidays.
Additionally, temporary branch offices for early voting by
personal appearance shall be established and provided on the
following days/dates at the locations identified and during the
hours specified:

"SECTION 4: All resident qualified electors of the City shall
be permitted to vote at said election, and on the day of the
election, such electors shall vote at the polling place designated
for the Election Precinct in which they reside. This election
shall be held and conducted in accordance with the provisions of
V.T.C.A., Election Code and Chapter 1 of Title 22, V.A.T.C.S., and
as may be required by law, all election materials and proceedings
shall be printed in both English and Spanish."

"SECTION 5: A substantial copy of this reso'lution shall serve
as proper notice of said election. Said notice, including a
spanish translation thereof, shall be posted at three (3) public
places within the city and at the City Hall not less than fourteen
(14) full days prior to the date on which said eleotion is to be
held, and be published on the same day in each of two successive
weeks in a newspaper of general circulation in said city, the first
of said publications to appear in said newspaper not more than
thirty (30) days and not less than fourteen (14) full days prior to
the day of the election."
SECTION 2: Save and accept as amended above, said Resolution
No. 94-36 calling the bond election to be held on February 18, 1995
is hereby ratified, confirmed and approved in all respects, and
Sections 5, 11, 12, and 14 are hereby renumbered to be Sections 6
through 10.
