CALL TO ORDER
Chairman Phillip Johnston called the meeting to order at 6:57PM. Present with Chairman
Johnston were, Commissioner Willie Osborne, Commissioner David Dahl,
Commissioner Ramona Kopchenko and Commissioner John Manganilla. Vice Chairman
Dennis Larson and Commissioner Ruthie Wright were absent.

INVOCATION& PLEDGE OF ALLEGIANCE
Commissioner Dahl gave the invocation and Commissioner Kopchenko led the Pledge of
Allegiance and Texas Pledge.
CITIZENS COMMENTS
Chairman Johnston opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Johnston closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the October 20, 2009,
Regular Meeting.
A motion was made by Commissioner Osborne, and seconded by Commissioner
Manganilla, to approve the minutes from October 20, 2009 Regular Meeting, as
submitted. Motion carried 5—0.

REGULAR AGENDA
Public Hearing
1. Hold a Public Hearing and consider a recommendation to the City Council
regarding a request to rezone a tract from Agricultural/30 to Light Industrial with
Specific Use Permit (SUP) for an Auto Repair, Major use on 1.777 acres (L.K.
Pegues Survey, Abstract No. 703) generally located east of Hooper Road and
approximately 410 feet south of Steel Road. ZC 2009-07
Ms. 011ie stated that the subject property is currently zoned Agricultural/30, and is
located east of Hooper Road and approximately 410 feet south of Steel Road.
The applicant is requesting for a change in zoning to Light Industrial with Specific Use
Permit. The applicant proposes automotive paint and body repair facility, which is
defined in the Zoning Ordinance as Automotive Repair, Major use.
The applicant proposes to develop a 3,375 square foot, one story body shop on the front
portion of the property. The overhead bay doors will be oriented towards the north and
south. Access will be provided via Hooper Road and screened with a seven foot chain
link fence.
If approved, the Zoning Exhibit will serve as the preliminary plat and the site plan is on
the current agenda for your review.
Eleven notifications were mailed with one written response in opposition and one neutral,
neither for nor against the request,but expressed concerns.
Chairman Johnston expressed concern of screening for outside storage. Ms. 011ie stated
that the Zoning Ordinance requires screening from a public street within the Light
Industrial District.
Chairman Johnston opened the Public Hearing.
Mr. Sohrab Sohrabi, 7503 Blossom Lane, Frisco, Texas 75034, represented the applicant,
stated that the facility will hold about 12 to 15 vehicles, and there are three parking
spaces that will be screened by a fence, and all will be out of view of the public. The
property has an existing barn that will not be remodeled at this time.
Mr. and Mrs. Charles McGurley, 326 Hooper Road, adjacent property owner to the
subject property, expressed several concerns, i.e., drainage, parking and layout of the
building. Chairman Johnston stated that the Site Plan is on the current agenda and the
drainage, parking and layout of the building will be addressed at that time. Ms. 011ie
stated that the current item is for zoning of the property.
Chairman Johnston closed the Public Hearing.
A motion was made by Commissioner Manganilla, and seconded by Commissioner
Osborne, to recommend approval to the City Council regarding a change in zoning from

Agricultural/30 (A/30) District to Light Industrial-SUP (LI/SUP) District for an Auto
Repair Major use, on a 1.71 acre tract (L.K. Pegues Survey, Abstract No. 703) generally
located east of Hooper Road and approximately 410 feet south of Steel Road. Motion
carried 5—0.
Action Agenda
1. Consider and act upon approval of a Site Plan for Hooper Road Body
Shop on one lot on 1.717 acres, generally located east of Hooper Road and
approximately 410 feet south of Steel Road.
Ms. 011ie stated that the proposed Site Plan is in correlation of the rezoning request for
Light Industrial classification with an SUP for major auto repair, which was considered
on the current agenda.
The applicant proposes to develop a 3,375 square foot single story auto body shop on
1.717 acres. The property abuts the Regency Industrial District, and the immediate area
is transitioning from agricultural into light industrial and commercial uses.
The subject site does include a natural drainage channel bisecting the property and
running along its northern boundary.
In addition, the site provides for a dedicated area for outdoor open storage. The exterior
building materials will consist of 100% brick and/or stone façade. Five bay doors will
face the north with one additional bay door facing the south.
The Commissioners expressed concern of the chain link fence surrounding the property.
Ms. 011ie stated that with the property being a SUP, stipulations for the type of screening
preferred can be made by the Commission. Mr. Sohrabi stated that a six foot masonry
concrete block will screen the outside storage area and the dumpster enclosed with
masonry also. The Commissioners requested the chain link fence to be removed on the
west and south, and that there be no installation of chain link fence surrounding the front
of the property. Mr. Sohrabi agreed to remove the existing fence and to construct a
masonry concrete wall for screening of outside storage and the dumpster.
Mr. Steve Foster, New Heights Baptist Church, property owner across from the subject
property, expressed concerns for the flooding and the chain link fence surrounding the
property.
Mr. and Mrs. McGurley, 326 Hooper, adjacent property owners to the subject property;
Mr. McGurley expressed concerns for drainage of the excess paint and oil. Ms. 011ie
stated that the drainage for excess oil and paint is regulated by TCEQ and that the City
Engineer will review drainage plans prior to construction. All reports from TCEQ are
submitted to the City Engineer, when there are citations or concerns for the drainage.
Mrs. McGurley expressed concern of flooding onto her property when heavy rain comes.
Chairman Johnston recommended that staff contact Mrs. McGurley regarding the
flooding issues.

A motion was made by Commissioner Kopchenko, and Commissioner Osborne, to
approve the Site Plan for Hooper Road Body Shop on one lot on 1.717 acres, generally
located east of Hooper Road and approximately 410 feet south of Steel Road, with
stipulation that the existing chain link to the west and south be removed and no
installation of chain link fence, and the outside storage area and dumpster be screened by
a concrete masonry wall. Motion carried 5—O.
ADJOURNMENT
A motion was made by Commissioner Manganilla, and seconded by Commissioner
Osborne,to adjourn the meeting at 7:46PM. All Commissioners were in consensus.
