Board Members present were; Board Member Bryan Rogers, Board Member David Dahl, Board Member Bill Baumbach, and Board Member Jeff Ellis. Absent were Vice-Chair Marilyn Herrera, and Board Member Karyn McGinnis. Staff members present were: Planning Director, Renae 011ie, Assistant Planner Jasen Haskins, and Administrative Assistant Mary Bradley. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the October 27, 2008 Meeting. A motion was made by Board Member Dahl, and seconded by Board Member Rogers, to approve the Minutes from the October 27, 2008 Meeting as submitted. Motion carried 5 — 0. PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by John Woodall for a Variance to Section 2.5.4.3 (b & e) of the Zoning Ordinance requiring no structure be placed within an easement and a rear yard setback of a minimum of 5', property located at 714 Westwind Way in the Westwind Meadows Subdivision, Block 4, Lot 6 (ZBA 2009-01). Minutes April 27, 2009 Wylie Zoning Board of Adjustment Page 1 of 5 Mr. Haskins stated that the property is located at 714 Westwind Way and was platted under the 1985 Zoning Ordinance. The applicant is requesting two variances. The applicant states that an accessory building existed before the house was purchased, and a new accessory building replaced the existing accessory building. Due to the construction of the new accessory structure, the current Zoning Ordinance regulates the requirements for the accessory structure. Section 2.5.4.3.b prohibits an accessory structure from being located in an easement. The applicant is requesting a variance from this requirement. The applicant has provided a letter signed by him and Oncor Electric, who owns the easement, consenting to place the accessory building on the easement with specific provisions. The applicant is also requesting a variance from Section 2.5.4.3.e for the requirement for a rear yard setback of five feet to one foot. This represents an eighty percent adjustment to the requirements of the Zoning Ordinance. The structure is four feet from the alleyway. The applicant states that a hardship exists due to unique circumstances on the property. The new accessory structure replaced an existing accessory structure and was placed in the same area as the previous one. If the new accessory structure was placed in any other area of the backyard, it may have resulted in a large mature tree being damaged or removed. Public Comment Forms were mailed to 37 property owners, and six responses were received all in favor of the request. Chair person Jourdan opened the Public Hearing. Jill and John Woodall, 714 Westwind Way, Wylie, the applicants, stated that the new accessory structure is six foot longer than the old existing structure, but it is the same depth. Nick Thierfelder, 710 Westwind Way, spoke in favor of the request and that the old structure was falling apart. The new structure is very nice and complements the neighborhood. Memory Wilks, 705 Westwind Way, spoke in favor of the request, and stated that the backyard is not large enough for an accessory structure to fit within the requirements. Ms. Wilks expressed misunderstanding on the revising of Zoning Ordinance. Ms. 011ie stated that the Zoning Ordinance was revised several times since the subject property was developed. Rather than making the Zoning Ordinance comply to the specific neighborhood, it is regulated by the majority of the neighborhood in the city. Most neighborhoods within the City of Wylie are developed to allow accessory structures to fit the requirements. The Zoning Board of Adjustment allows those properties that have unique circumstances and hardships to obtain a variance. The Zoning Ordinance is periodically revised as society and materials change. Minutes April 27, 2009 Wylie Zoning Board of Adjustment Page 2 of 5 Anita Carrico, 706 Westwind Way, spoke in favor of the request, and that the new structure is very attractive and blends with the property. Tim Epperson, 713 Westwind Way, spoke in favor of the request, and sees no problem with the shed. He stated that both of his kids are sick tonight, but both have stated "save the box". John Godwin, 718 Flagstone Way, spoke in favor of the request, and stated that he located two structures that met the requirements within the Zoning Ordinance. Debra Byrd, John Sutten, and Warren Robertson were all in attendance in support of the request, but chose not to speak. Chair Person Jourdan closed the Public Hearing. Board Member Ellis stated that his personal opinion was in favor of community views and with all neighbors in favor, which outweighs the technical regulations. Board Member Baumbach concurred with Board Member Elllis, and complimented Mr. and Mrs. Woodall for being good neighbors to have a majority of them show up in support of the request. Board Member Dahl expressed concern of setting precedence, in response to a statement made of the number of accessory buildings that are nonconforming. Chair Person Jourdan stated that even though each variance was considered individually, the City Council will periodically review the number of variances requested and will consider revising the Ordinance if the variances are on the same type of request. Mr. Haskins stated that the subject neighborhood was a unique one, with the alley and easement. This is a case by case basis for neighborhoods with unique circumstances. The majority of the neighborhoods would not have an easement or an alley. Board Member Ellis encouraged the citizens in attendance, if they decided to construct an accessory building to come before the Board for a variance prior to the construction. A motion was made by Board Member Baumbach, and seconded by Board Member Rogers, to Grant both variances as requested; variance to Section 2.5.4.3.(b&e) of the Zoning Ordinance requiring no structure be placed within an easement and a rear yard setback of a minimum of five feet, property located 714 Westwind Way in the Westwind Meadows Addition, Block 4, Lot 6. Motion carried 5 — 0. 2. Hold a public hearing to consider and act upon a request by James Edge for a Variance to Section 6.3.E.4.b.3 of the Zoning Ordinance requiring a side yard setback of a minimum of 5', property located at 201 N. Jackson in the Brown and Burns Subdivision, Block 6, Lot 35C (ZBA 2009-02). Minutes April 27, 2009 Wylie Zoning Board of Adjustment Page 3 of 5 Mr. Haskins stated that the property is located at 201 N Jackson and is zoned Downtown Historic District. The applicant is requesting a variance to Section 6.3.E.4.b.3 for the requirement of a side yard setback be equal to or greater than the side yard setback of adjacent properties. The applicant desires to construct a carport, replacing a recently removed carport. The carport was in bad shape and falling down. The applicant proposes to construct a carport that matches the main structure with brick. The applicant states that a hardship exists due to the size of the existing residential structure and zoning restrictions, and placement of the carport in any area of the property other than where the previous one existed is not likely. It is Staff's opinion that the proposed new structure would not detract from the intent of the Downtown Historic District. Public Comment Forms were mailed to 24 property owners, and four responses were returned and all in favor of the request. Chair Person Jourdan opened the Public Hearing. Donna and John Edge, 513 Dogwood, Wylie and soon to be 201 N Jackson, applicant, stated that the main structure was built in 1894, and unsure when the carport was constructed. The proposed carport will visually match the existing main structure. Kathy Spillyards, 301 N Jackson, neighbor of the subject property, spoke in favor of the proposed variance. She stated that as a City Council Member, a residence of the Downtown Historic District, the importance of treasuring the Historical properties. The applicant has made a considerable investment, and the proposed improvements for the property will help the downtown area. The property is where it is, the surrounding area is what it is, the Zoning Ordinance is very helpful and needed for the City of Wylie, but exceptions need to be made. Chair Person Jourdan closed the Public Hearing. Board Member Baumbach expressed concern of the carport not being constructed to match the main structure, and recommended a stipulation made in the motion. A motion was made by Board Member Ellis, and seconded by Board Member Baumbach, to Grant the request with stipulation that the Accessory Building be constructed as drawn on the submitted Plan to match the main structure. Discussion The subject property is located at 1322 Century Way. The applicant is requesting a variance to Section 4.2.A.3 for the requirement for a side yard setback be 10' in areas zoned Light Industrial. The applicant is requesting a zero side yard setback for an approximately 4,000 square foot addition to an existing structure. The applicant has provided a rough site plan showing the size and positioning of the proposed addition. The existing structure conforms with current setback regulations. The applicant has stated that the reason for the request is to deter pedestrian traffic along the side of the building. The request represents a 100% adjustment to the requirements of the Zoning Ordinance. The setback is an established building line, parallel to a property line, over which no part of a building shall project, except as otherwise provided by the zoning ordinance. The purpose of the building setback requirement is to preserve and promote open space and increase neighborhood safety. This Board has approved set back variances within the past 24 months, but never for zero, nor for a structure of this size. Public comment forms were mailed to 8 property owners within 200 feet of this request, as required by State Law. At the time of this posting,no responses have been received. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. There is a 10' area between Lot 5 and Lot e. We ask that you allow us to extend our add-on to cover the 10' area to do away wilr the blind spot that exist. it will be a larger blind spot and dead space when the add-on is complete. Naturally the add-on will stay inside the 10' area and not intrude onto our neighbor. This will increase our add-on space to 50' x 80'. The original building contractor will build the add-on to match the existing building. This will insure that the add-on flows well and will be pleasing to the eye. The blind spot provides an ideal area for intruders. According to the plot plan the electrical feed comes from the rear of the property, but the underground feed comes from Century Way.Therefore we would not be covering any power lines. Property located at 711 Business Way, Lot 5R, Block 1, FM 544 Industrial Park Addition. (ZBA 2010-02) Discussion The subject property currently consists of a single lot within the FM 544 Industrial Park Addition. The entire complex is approximately 13,150 square feet. There are a total of 36 spaces located on site. An alternative parking agreement was approved for the tenant occupying 3,150 square feet for a Personal Service Use (Dance Studio) in March of 2009 to allow them to utilize one parking space located across the street on Lot 10R, 710 Business Way. Approximately 10,000 square feet of the 13,150 square foot building has been recently vacated and the remaining occupant desires to utilize the newly vacant area of the building to operate an indoor amusement type use. The facility will house an indoor golf range, mini golf, batting cages and snack area. The area is zoned Commercial Corridor with primarily industrial type uses which allows the proposed use. However, as previously noted, there are only 36 total parking spaces on site. The Majestic Ballroom utilizes 15 on-site parking spaces, leaving 21 unutilized spaces available for the proposed amusement use. Based on the zoning ordinance the proposed use, Commercial Amusement or Recreation, Inside, requires a parking ration of 1 to 100, or additional 100 parking spaces. Therefore, the applicant, in accordance with Article 8, Section 8.4.C.4.e, which states that, the Board may waive or reduce the parking and loading requirements in any district, whenever the character use of the building is such as to make unnecessary the full provision of parking or loading facilities, or were such regulations would impose an unreasonable hardship upon the use of the lot, as contrasted with merely granting an advantage or a convenience, is asking for a variance to the required parking of 100 spaces. That said, staff feels that some reduction in parking is warranted. Commercial Amusement or Recreation, Inside means a facility wholly enclosed in a building that offers entertainment or games of skill to the general public for a fee. Typical uses include bowling alleys, arcades & billiard parlors. This type use requires a parking ration of 1:100 plus one space for each employee. The subject use "Practice Swing — Golf and Baseball Academy" under the indoor commercial use as it is written would require 100 parking spaces. But it is staff's interpretation that the intent of the Commercial Amusement or Recreation, Inside is categorized too broad in this case and Page 1 of 3 Page 2 of 3 ZBOA 2010-02 lends itself to a more intense recreational use with video/arcade machines, pool tables, or similar high density entertainment devices occupying a majority of the gross floor area. As outlined by the owner, this facility would have large open space areas where there is no organized recreation functions taking place. Staff met with the Building Official in deriving an occupancy load based on the total square footage of useable public space. In accordance with current building codes the facility shall not exceed an occupancy load of 150 persons. This would allow a minimum of 50 parking spaces based on 3 persons per vehicle. When different use areas are considered,the subject facility breaks down as follows: - 4 golf stalls and 2 simulators parked at 3 spaces per stall/simulator = 18 - Mini-golf(8 holes) parked at 3 spaces per hole =24 - 2 batting cages parked at 3 spaces per cage = 6 - Snack area parked at 1 space for every 3 seats (52 seats) = 18 - Open party area 1,333 s.f parked at 1:100 = 14 80 total parking spaces required This is somewhat of a unique use as the zoning ordinance is very broad in categorizing commercial amusement uses. In accordance with Section 5.6 Classification of New and unlisted Uses the ordinance outlines the provision of new or unlisted uses that are similar to other uses listed in the same zoning district that allows the Director of Planning to make this determination without wholesale changes to the current Ordinance. If a full variance is not granted, the applicant would have to enter into an alternative parking agreement with an adjacent property owner and ultimately secure approval from City Council. The applicant has noted that they are in communication with the property owner of Lot l OR, 710 Business Way to secure additional parking. The outcome of this request will determine how many off-site parking spaces would be required. CONSIDERATIONS: 1. The applicant is asking for 40 parking spaces (50%variance) 2. 100 spaces required by Ordinance as written as a single use of Commercial Indoor Amusement. 3. 80 spaces required by combined uses. 4. 50 minimum spaces required based on occupancy load not to exceed 150 (37.5% variance) 5. Majestic Ballroom operates primarily during the hours of 5pm—9pm and weekends. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development Page 3 of 3 ZBOA 2010-02 code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. If approved, variance is void if occupancy load as indicated by construction plans exceed 150. Public comment forms were mailed to twelve (12) property owners within 200 feet of this request, as required by State Law.
