H. EDGINGTON, ROBERT B. RICHARDS ON , MANLEY F. ALLEN, W. D. GREEN, R. V. GROVES, A. D. BOYD, MAYOR ALDERMEN and with the following absent: No~ , constituting a quorum; and, among other proceedings had were the following: Alderman 1"--"'" . .-,," ' ." \"..1, ~.."),}i:"'-~ '..,J '-'" ......'-~.. offered the following resolu- tion to the City Council and moved its adoption: WHEREAS, under and by virtue of a resolution and order duly passed by the City Council of the City of Wylie, Texas, on the 5th day of December, 1955, an election was held in said City on the 29th day of December, 1955 on three propositions for the issuance of the bonds of said City of Wylie, Texas, in the following amounts and for the following purposes, to-wit: $187,000 revenue bonds for the purpose of constructing improvements and extensions to the City's Waterworks System; $159,000 revenue bonds for the purpose of constructing improvements and extensions to the City's sanitary Sewer System; and $ 54,000 general obligation tax bonds for the purpose of constructing improvements and extensions to the City's sanitary Sewer System; AND WHEREAS, on this the i 11 day of ,-L.I.I -.) ~A-'.~ ., 195 Ii.) ,same being a \z \:>({ ,..; \ 1.tA- session of the City Council, there came on to be considered the returns of said election; and WHEREAS, upon consideration of the returns of said elec- tion, it appears that the same was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and WHEREAS, it further appears from said returns that there were cast at said election i \ ,) votes on the proposition for the issuance of $187,000 Waterworks System Revenue Bonds, of which number "C) \ votes were cast "FOR THE ISSUANCE OF $187,<IJ+l WATERWORKS REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED WATERWORKS AND SANITARY SEWER SYSTEM TO THE PAYMENT THEREOF"; and \ ""-- votes were cast "AGAINST THE ISSUANCE OF $187,000 WATERWORKS REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED WATERWORKS AND SANITARY SEWER SYSTEM TO THE PA YMENT THERE OF t1; and WHEREAS, it further appears from said returns that there were cast at said election \ \'1 votes on the proposition for the issuance of $159,000 Sewer System Revenue Bonds, of which number I 0 \ votes were cast "FOR THE ISSUANCE OF $159,000 SEWER SYSTEM REVENUE BONDS J AND PLEDGING THE REVENUES OF THE CITY'S CCMBINED WATERWORKS AND SANITARY SEWER SYSTEM TO THE PA YMENT THEREOF "; and \\0 votes were cast "AGAINST THE ISSUANCE OF $159,000 SEWER SYSTEM REVENUE BONDS, AND PLEDGING THE REVENUES OF THE CITY'S COMBINED WATERWORKS AND SANITARY SEWER SYSTEM TO THE PAYMENT THEREOF"; and WHEREAS, it further appears from said returns that there were cast at said election \ \ '\ votes on the proposition for the issuance of $54,000 General Obligation Tax Sewer System Bonds, of which number, i C \ votes were cast "FOR THE ISSU ANCE OF $54,000 GENERAL OBLIGATION TAX SEWER SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF"; and Il., votes were cast "AGAINST THE ISSUANCE OF $54,000 GENERAL OBLIGATION TAX SEWER SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF II ; and THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: That the aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the state of Texas and the resolution and order calling said election; that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying voters of the said City of Wylie, Texas, who owned property therein, SUbject to taxation, and who have duly rendered the same for taxation, were permitted to vote at said election; and, further that said election properly represents the desires of those qualified to vote as aforesaid. SECTION 2: That the proposition to issue the $187,000 revenue bonds for the purpose of constructing improvements and extensions to the City's Waterworks System was sustained by a majority of the qualified voters of said City, v oting at said election, who own taxable property in said City, and who have duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 3: That the proposition to issue the $159,000 revenue bo:nds for the purpose of constructing improvements and extensions to the City's Sanitary Sewer System, was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City, and who have duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds, and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 4: That the proposition to issue the $54,000 general obligation tax bonds for the purpose of constructing improvements and extensions to the City's sanitary Sewer System was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the pay- ment of the principal of and interest on said bonds in the time and manner prescribed by law. The resolution having been read in full, it was moved by Alderman \\. \ \ ~). Iv\, and seconded by Alderman' \\ \ ('..\1\ &\-c\. -~J c '--l that the same be passed and adopted. Thereupon, the Mayor put the motion to a vote of the members of the City Council, and the following members voted "AYE": Alder- men Richardson, Allen, Green, G roves and Boyd; and none voted II NO" .
