Assistant Don Hughes Mike Phillips Carter Porter Commission Members Absent: Staff Members Absent: William Chapman Terry Capehart, Assistant Planner Chris Seely CALL TO ORDER Chairman George called the Regular Meeting to order at 7:03 p.m. INVOCATION AND PLEDGE Chairman George offered the Invocation and Commissioner Porter led the Pledge of Allegiance. CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the September 2, 2003, Regular Meeting. A motion was made by Commissioner Porter, and seconded by Commissioner Byboth, to approve the minutes as submitted. Motion carried 5 —0. P & Z Meeting September 16, 2003 Page 2 of 5 ACTION AGENDA 1. Consider and act upon approval of a Site Plan for Office/Warehouse Building, being all of a certain 17,996 square feet (0.413 acre) tract of land, located at 201 Windco Circle, being Lot 6R, Block 1 of the Wyndham Estates Addition, Phase III 4th Revision, City of Wylie, Collin County, Texas. Thompson stated that the proposed Site Plan is for an office/warehouse center for two tenants of approximately 2,250 square feet each, and the building totals 4,500 square feet. The lot totals 17,996 square feet (0.413 acre), and zoned for Industrial (I) uses such as that proposed. The property was replatted in February 2003 as a Minor Plat as Lot 6R, Block 1 of the Wyndham Estates Addition Phase III 4`h Revision, combining two lots and providing a joint access with the adjoining property to the north. On August 26, the Board of Adjustment approved a variance reducing the side yard from twenty-five feet to ten feet. John Villareal, 105 South Ballard, Wylie, Texas, submitted elevations of the subject building and stated that there will be steel and gable canopy projecting over the front façade two feet above the doorway. A motion was made by Commissioner Phillips, and seconded by Commissioner Hughes, to approve the Site Plan as submitted. Motion carried 5 —0. 2. Consider and act upon approval of a Site Plan for the Stepping Stones Daycare, being all of a certain 3.074 acre tract of land generally located north of Alanis Drive and east of Ballard Avenue, City of Wylie, Collin County, Texas. Thompson stated that the subject tract totals 3.074 acres, is zoned for Neighborhood Services (NS) uses. The proposed buildings consist of an administration building of 4,875 square feet and a daycare building of 10,000 square feet connected by a covered breezeway. A Preliminary Plat of the Alanis Addition, creating the lot of record is also on the current agenda for consideration. Chairman George questioned the screening between the residential and the proposed daycare facility. Thompson stated that daycare is allowed in either nonresidential or residential properties. In this case the daycare facility is considered residential character because of the architectural design and more fitting with the residential neighbor, and the screen wall is more appropriately located in the retail to the west. P & Z Meeting September 16, 2003 Page 3 of 5 Phillip Abels, 5343 Vanderbuilt, Dallas, Texas, represented the applicant stated that the four residential lots to the east will have a wooden fence on the back property line, and should be completed before the construction of the proposed daycare facility. Chairman George asked if in lieu of making the applicant put a masonry wall against residential wood fence, would the applicant put a wrought iron fence in the front where a chain link fence was going to be placed. Mr. Abels stated that the final construction plans are not complete, but a wrought iron fence could be placed along the front building line to the east day care building and in front of the outdoor playground. The Commissioners discussed the requirement for screen wall in a nonresidential area. Thompson stated that a masonry wall should be required between Lot 1 and Lot 2, as the proposed daycare facility is on Lot 2 and is a residential character. Thompson stated that when the commercial uses are developed on Lot 1 they will be required to put a screen wall, between Lot 1 and Lot 2. June Nance, owner of land, spoke in favor of the day care and questioned the location of the Commissioners required wrought iron fence. Commissioner Porter stated that the Commission is not requiring a fence but if there is any fence visible in the front it must be a wrought iron rather than chain or wood. Lot 1 will provide a masonry wall between the retail and day care, which will be considered at the time the Site Plan, is submitted for Lot 1. Commissioner Porter questioned the location of the dumpster. Mr. Abels stated that the dumpster will be located to the northwest off the circular drive, and enclosed with a masonry wall matching the building. A motion was made by Commissioner Phillips, seconded by Commissioner Byboth, to approve the Site Plan for Stepping Stones Daycare contingent upon any fencing that fronts Alanis between the buildings or between the building and property line be wrought iron in nature and the screening wall around the three sides of the dumpster pad match façade to the building. Motion carried 5 —0. 3. Consider a recommendation to the City Council regarding a Preliminary Plat for the Alanis Addition, being all of a certain 5.201 acre tract of land, generally located east of Ballard Avenue and north of Alanis Drive, as described in a deed to Whisenant Properties, Inc., as recorded in County Clerk's File No. 97-0054771 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas. Thompson stated that the Preliminary Plat will create 2 lots totaling 5.201 acres. Lot 1 is 2.127 acres in size and will be developed in the future as Neighborhood Services retail. Lot 2 is 3.074 acres in size and will be developed as the Stepping Stones Day Care, for which a Site Plan was approved on the current agenda. The Plat does provide joint access between the two properties, but can not provide joint access to the north or to the P & Z Meeting September 16, 2003 Page 4 of 5 east because of the fire station and existing residential. Additional right-of-way of varying widths is dedicated for the future expansion and widening of Ballard Avenue. A motion was made by Commissioner Hughes, and seconded by Commissioner Porter, to recommend approval of the Preliminary Plat. Motion carried 5 —0. 4. Consider a recommendation to the City Council regarding a Development Plan/Preliminary Plat for the Woodbridge Phase 9 Addition, being all of a certain 49.718 acre tract of land, generally located south of Alanis Drive and west of Sachse Road, and being a part of the remainder of the 411.15 acre tract of land described in a deed to C. J. Thomsen, recorded in Volume 742, Page 64 of the Deed Records of Collin County, Texas and being a part of the remainder of the 199.3963 acre tract of land described in a deed to Woodbridge Properties, L.L.C., as recorded in County Clerk's File No. 97-0032076 of the Deed Records of Collin County, Texas, and being situated in the Richard Newman Survey, Abstract No. 660, City of Wylie, Collin County, Texas. Thompson stated that the 49.718 acre tract of land will create 230 single-family residential lots of varying densities with landscaped entry features and other common areas/open spaces to be owned and maintained by the Homeowners Association. The subject property is part of the larger mixed-use Woodbridge Planned Development (PD 98-15), which consists of Single-Family Residential of varying densities, Multifamily Residential, a Golf Course, Parks, Commercial, a School Site, and Common Open Spaces. The Phase 9 Addition is the first residential phase entirely within the Wylie city limits. The Development Plan completes the zoning and the Preliminary Plat initiates the development. The Plat complies with the Concept Plan approved with the PD. Creek Crossing Lane, which intersects Sachse Road, will serve as the primary point of access. Creek Crossing Lane and Lost Highlands Lane will serve as collectors constructed with 37 feet of pavement. Creek Crossing Lane will eventually be extended to connect with Woodbridge Parkway within Sachse to the west and Lost Highlands will connect with Alanis Drive to the north. Because the requirement for two points of access for emergency vehicles cannot be complied with for this phase, an ordinance will be established prohibiting parking on both Creek Crossing and Lost Highlands until these streets is completed and other entry points are provided in future subdivisions. Don Herzog, Herzog Development Corporation, 9696 Skillman Street, Dallas, Texas, represented the applicant, stated that there will be no lots or driveways facing Creek Crossing Lane or Lost Highlands Lane, so the no parking will be effective in assuring a wide street for emergency turn-arounds.
