CITY COUNCIL MEETING
MINUTES
JULY 11, 1989
The City of Wylie City Council met in regular session on
Tuesday, July 11 , 1989 at 7 :00 P.M. in the Council Chambers
of the Municipal Complex . A quorum was present and notice
of the meeting had been posted in the time and manner
required by law. Those present were Mayor Chuck Trimble,
Mayor Pro Tem Bud Naish, Council Members Pat Stemple, Jim
Swartz , Steve Wright, Ortie Messenger and John Akin, City
Manager Charles Norwood, City Secretary Carolyn Jones,
Finance Director James Johnson, Code Enforcement Officer Roy
Faires, Public Works Superintendent Don White, Assist . City
Engineer Ron Homeyer and Chief of Police James Gilmore, and
a number of employees attending to show support of the
employee of the quarter.
APPROVAL OF THE MINUTES FOR MAY 23RD , JUNE 21ST, AND 27TH
MEETINGS: Councilman Wright corrected the statement in the
May 23rd minutes suggesting Beth Fultz serve as alternate
member of the Historical Commission to reflect Mayor Pro Tem
Naish made the suggestion not Councilman Akin. Councilman
Messenger corrected the June 27th minutes to reflect that
council can save the tax payers $20 ,000 instead of save tax
payers some money. Mayor Pro Tem Naish added the following
statement regarding the Park Master Plan, this is a five
year plan and not a budgetary item and it is just for
placement of items the board would like to see happen.
There being no other corrections or addition , a motion was
made by Councilman Akin to approve the minutes as corrected .
Seconded by Councilman Messenger . The vote was as follows:
Mayor Trimble - in favor , Mayor Pro Tem Naish - in favor ,
Councilman Akin - in favor , Councilman Wright - in favor,
Councilman Messenger - in favor , and Councilwoman Stemple -
in favor . This motion carried with all in favor.
APPROVAL OF PROCLAMATION FOR CITY OF WYLIE EMPLOYEE OF THE
QUARTER - JUNE 30, 1989 - OFFICER DON MCCARTER: Motion was
made by Councilman Akin to approve the proclamation for City
of Wylie Employee of the Quarter - June 30 , 1989 - Officer
Don McCarter . Seconded by Councilwoman Stemple. The vote
was as follows : Mayor Trimble - in favor , Mayor Pro Tem
Naish - in favor, Councilman Akin - in favor, Councilman
Swartz - in favor , Councilman Wright - in favor , Councilman
Messenger - in favor, and Councilwoman Stemple - in favor .
This motion carried with all in favor .
Mayor Trimble presented Officer McCarter the following
proclamation:
WHEREAS, Officer Don McCarter has been selected as the City
of Wylie Employee of the Quarter ending June 30 , 1989; and
WHEREAS, Officer McCarter is know for his outstanding
performance as a police officer; and
WHEREAS, Officer McCarter holds a perfect attendance record
since his employment with the City of Wylie; and,
WHEREAS, Officer McCarter has an outstanding attitude
regarding his position and relationship with the citizens
and community; and
NOW, THEREFORE, I , Chuck Trimble, Mayor of the City of
Wylie, do Proclaim Don McCarter as Employee of the Quarter
Ending June 30 , 1989 .
Mayor Trimble stated this is a program that is important to
the City and staff. This is our first presentation.
City Manager Charles Norwood said he is very happy for Don
and for the employees here tonight to show honor and
support.
Officer McCarter ' s wife Sandy and their daughters Linsey and
Chere were present plus other family.
PRESENTATION FOR RULING ON NON-PROFIT ORGANIZATIONS USING
COMMUNITY ROOM: Councilman Akin said it was the intent of
Council that the Community Room would be a revenue source
for the Park. City Manager Charles Norwood said staff would
like Council to establish a written policy that would list
the non-profit organizations who could use this room free of
charge. In other places, the Council has adopted a policy
and staff followed this policy. The non profit groups that
contributed to the City could use it for a small fee but no
one used the building free of charge.
Mayor Pro Tem Naish said that Council discussed this during
the budget sessions and the funds from the rental of the
Community Building have to go to the General Fund Budget not
the Park Budget . Also the non profit organizations could
use it free of charge, maybe we are getting abuse from these
organizations . Finance Director James Johnson said we have
a fee schedule set up for others using the building . City
Secretary Carolyn Jones stated some of the non profit
organizations using the building were, Boy Scouts, Girl
Scouts , Camp Fire Kids, Wylie Women' s League, Wylie Jaycees,
Wylie Sports Association and Parents and Tots.
Library Director Rosanne Burgess said we are not complaining
of the users , we just need to know who is non profit.
City Manager Charles Norwood said we just want one committee
to come up with rules and regulations to bring back to the
Council . Councilman Wright and Swartz volunteered to work
on this committee.
CONSENT AGENDA: The consent agenda consists of three
easements needed for the improvements to the wastewater
collection system. These easements are from John Bernard
Robinson - two permanent utility easements and M-W
Properties for one permanent utility easement . Mr. Homeyer
said this makes a total of ten easements, there are two more
that will be on the next agenda from Don Kreymer . Motion
was made by Councilman Swartz to approve and accept the
three utility easements as stated above. Seconded by
Councilman Akin. The vote was as follows : Mayor Trimble -
in favor , Mayor Pro Tem Naish - in favor , Councilman Akin -
in favor , Councilman Swartz - in favor , Councilman Wright -
in favor , Councilman Messenger - in favor , and Councilwoman
Stemple - in favor . This motion carried with all in favor .
CITIZEN PARTICIPATION: Mrs . Becky Paschal of 510 W. Oak
wanted to follow through with Mr . Norwood and Mr . Gilmore on
the four way stop signs. There is less patrol now and this
is a big problem. City Manager Charles Norwood said the
police department made a survey, they have recommended four
way stops, the public works department has ordered the signs
and we are waiting for them to come in . Mrs . Paschal said
she and others are going to post signs on their fences,
"caution, children at play" to alert the drivers coming
through the alleyway since there were no speed limit signs
in these alleyways . Mayor Trimble said that the speed
limits signs do not do any good. In my neighborhood, we
posted signs on our fences . Mrs. Paschal wanted to know if
the speed limit could be lowered to 20 mph. City Manager
Charles Norwood said not easily , you have to take a survey
and the speed is determined from what 85% of the drives are
going. Councilman Swartz said that once the four ways stop
signs are up and a few tickets issued , this should slow the
people down. Councilman Swartz wanted to know if Mr.
White' s crew could put some bright streamers on these new
signs so they would show up.
Mr. Bobby Jennings of Gaston Dr . North thanked the council
for the help on the street name confusion and the signs are
all up. I just wanted to say thank you.
COUNCIL DISCUSSION: Mayor Pro Tem Naish said when will the
five year Master Park Plan come to council for approval .
City Manager Charles Norwood said when staff gets it back
from the Texas Park and Wildlife Department, it will be
presented to the Park Board and then they will bring it
forward.
Mayor Pro Tem Naish wanted to know what could be done about
putting "no parking" signs up on one side of Stoneybrook.
Chief of Police James Gilmore said the problem is which side
do we make no parking on. This is just one of the streets
in town with this problem. Mayor Pro Tem Naish said this
was suggested by some of the citizens that live on this
street.
Mr. White said there are a lot of cars parked on the street.
City Manager Charles Norwood said we need to count houses on
each side of the street and then talk about it. Probably we
will have to have no parking on both sides and will need to
have a public hearing .
Mayor Pro Tem Naish wanted to know if there could be a joint
meeting with Planning and Zoning to address not having
another sub-division with only one entrance and also discuss
the speed limit of all residential streets be 20 mph.
Councilman Wright wanted to know what constituted working on
a vehicle. Mr . Faires said we had a compliant that a
resident was running a commercial garage at his home. It
was an anonymous compliant and we had to investigate it .
Councilman Swartz thanked Don White and his crews for the
work done around town.
Councilman Akin asked Mr . Johnson about the status of the
ambulance committee. Mr . Johnson said Mr. Dillard, City
Attorney, has completed his review and there are just a few
corrections . Councilman Akin stated he had asked for a
financial statement four time and I have not received it .
City Manager Charles Norwood stated that staff had it ready
and asked Mr . Homeyer to pass it out. Councilman Akin
stated he was happy to see the list of streets for
reconstruction. Do we use the counter to show which streets
are traveled on more. Mr . White said yes, the counter is
used a lot.
Mr . Johnson said to date, we have $15,705 .11 recovered from
the Street Reconstruction Program, but the bank has just
recently changed owners and they have stated they will pay
their assessment. This is approximately $23 ,000.00 . City
Manager Charles Norwood said staff has written letters to
the others asking for early payment.
Councilman Akin said Martinez Lane has money set aside for
the reconstruction of this street, I believe it is $17,000 .
Councilman Akin also asked Mr . White about the line in the
older part of town. Mr . White said that Masters St . is the
only street that has very little maintenance on the lines.
The other streets need a lot of work done on the lines prior
to reconstruction of the streets. Mr . Johnson said that the
developer has released the money for Martinez for
reconstruction with asphalt overlay, not two course
penetration.
Councilman Akin stated that when you adopt a five year plan,
we should be able to do all the work, I would have a problem
with a five year plan of this sort. Councilman Swartz asked
Councilman Akin how many years was on the plan he just
handed out . Councilman Akin said no time limit, it was just
called phase one. Councilman Akin thanked those who have
been working so hard in the Park.
City Manager Charles Norwood said that Wylie needs some
goals and also need to get the community involved . Get
input from the community and support from them. City
Manager Charles Norwood said he believes this should be a
five year plan and work toward this, may have to extend it
to six or seven years . City Manager Charles Norwood
recommended to Council to appoint a needs committee.
Mayor Trimble stated that Council has talked about this in
the past, if you do not update your plans every year then
they are left sitting and are not good.
Councilman Wright complimented the City Manager on what he
has brought to the City in the way of raising the spirits of
the employees .
There being no other matters for discussion, a motion was

PARK BOARD MEETING
MINUTES
JULY 6, 1989
The City of Wylie Park and Recreation Board met in regular
session Thursday, July 6, 1989 at 7 :15 P.M. in the Council
Chambers of the Municipal complex . Those present were Cheri
Albin, Jill Tomek , Bryan Glenn , Bill Emsoff , Bill Burge,
Joanie Zeeb (arrived late) , City Manager Charles Norwood,
City Secretary Carolyn Jones, Public Works Superintendent
Don White and Park Maintenance Foreman Phillip Bounds. Park
Board Member Mike Miller was absent .
Mr . Don White called the meeting to order, as the chairman
and vice chairman were not present since their term has
expired .
OATH OF OFFICE TO NEW MEMBERS: City Secretary Carolyn Jones
gave the oath of office to Bryan Glen and Cheri Albin. Mrs .
Zeeb arrived late and her oath of office was given at that
time.
ELECTION OF CHAIRMAN: A motion was made by Mr. Emsoff to
elect Jill Tomek as Chairman of the Park Board. Seconded by
Mrs . Zeeb. This motion carried with all in favor .
ELECTION OF VICE CHAIRMAN: Chairman Tomek made a motion to
elect Joanie Zeeb as Vice Chairman. Seconded by Mr . Emsoff .
This motion passed with all in favor .
APPROVAL OF MINUTES OF JUNE 1ST MEETING: Mrs. Zeeb
corrected the June 1st meeting to reflect in the general
discussion,"Mrs . Zeeb asked is there anyway we can keep this
area mowed" and also "asked can we make a recommendation to
Council to do something to get the grass mowed" . Mrs . Zeeb
also corrected Mrs . Tomek statement to reflect asked instead
of said to Don White when things are bought out of the
budget can you let the Park Board know what is being bought,
from who and how much it costs . Mrs . Zeeb also questioned
the roll call vote when everyone voted in favor . A motion
was made by Mr. Emsoff to approve the minutes with the above
stated corrections. Seconded by Mrs. Zeeb. This motion
carried with all in favor .
DISCUSSION OF COMMUNITY PARK MASTER PLAN: Chairman Tomek
stated that the presentation of the park master plan was
made to the City Council. Everyone was very impressed but
wanted a cost estimate on each item. Chairman Tomek stated
she has talked with the City Manager Charles Norwood and who
agreed that a cost estimate should be put with each item.
Chairman Tomek said staff was looking at funding from the
Texas Wildlife Department. City Manager Charles Norwood
said the Texas Wildlife Department will go through the plan,
give staff cost estimates and suggestions on the over all
plan. Once staff finds the funding from the state, then the
staff must find matching funds. Chairman Tomek asked if the
matching funding could be with labor . Mr. Norwood said yes.
When the plans come back from the state, then the Park Board
should go through and give another priority listing . Mrs.
Zeeb wanted to know if the state would come and see the park
and give us the estimates at the same time. Mr . Norwood
said no, as this is their time for review of budget and
plans and they will be working out of their offices, but
sometime in the fall , the state will visit our park.
Chairman Tomek wanted to know how long before staff received
the information from the state. Mr . Norwood said within one
month. Mr . Emsoff stated that if these plans and cost
estimates come back, then we can put them on the next
agenda.

Chairman Tomek said there are a few corrections to these
plans, the sand pit and volley ball court should be moved to
the picnic area on the north side of the playground and move
the basketball court to where the volley ball court is
shown. Phillip Bounds said the parking lot goes out into
where the fence will be around the ball fields, also looks
like the jogging path crosses the creek. Chairman Tomek
said according to Ron Homeyer , the jogging path does not
cross the creek.
Mr. Emsoff asked Mr . Norwood if the priority list was needed
now. Chairman Tomek said the Council was told at their last
meeting the swimming pool was on top of the list and I do
not believe Council objected to this , but there were
questions of the cost. Mr . Norwood said the pool will cost
approximately half million and I do not feel you can get it
this year . Chairman Tomek said that Council has talked
about asking for donations on the water bills - $1 .00 per
each family. This would bring in some of the cost of the
pool . Chairman Tomek said another top priority is the
soccer and football fields and also stated the playground
equipment is almost complete. Chairman Tomek asked Bill
Burge if it was to late to hydromulch. Mr . Burge said no.
Mr . White said funds are getting low and I do not know if I
have money for the materials. Chairman Tomek said we have
money to give back to the City from the Women' s league and
the $3 ,000 from W.S.A. Chairman Tomek said to go ahead and
try to hydromulch with this money.
City Manger Charles Norwood said if this board can do only
one thing , you have to generate an interest in the Park.
When you look at our population and the number of
volunteers, there is no interest in the park. Chairman
Tomek said the Wylie Sentinel run two articles on volunteer
work needed and my phone number . Chairman Tomek stated she
did not receive one call from these articles. Mr . Norwood
said you have to start now and let the citizens know about
the pool through the water bills and civic groups and news
media. If citizens do not know about what you are doing,
then you will not get the community involved . City Manager
Charles Norwood suggested the Park Board appoint a Community
Awareness Committee.
Mr . Bryan Glenn wanted to know where the tools for playing
volleyball, etc. would be kept . Chairman Tomek said either
in the Library or Community Room or in one of the storage
areas at the park. Mr . White said there is a deposit for
volley ball and net, although no one has used it in a long
time. Chairman Tomek said to use the Library and let the
people check the equipment in and out during the regular
library hours . Mr . Norwood said why not but up the net and
leave it up. Mr . Glenn stated not to put edging around the
volleyball court, just go from grass to sand.
DISCUSSION OF 89/90 CAPITAL IMPROVEMENTS TO COMMUNITY PARK:
Mr . White said this item is here because I wanted an ideal
from the board on what you want to see done next year if
funds are available. Chairman Tomek said Mr. White has
brought up an idea of having a contractor do the mowing ..or
the parks . Mr . White said he spends a lot on labor, tools
and maintenance to mow for the City and I believe a
contractor can do it cheaper. Mrs . Albin asked what areas.
Mr . White said the Municipal Building, Kirby Park, Valentine
Park and Community Park and all the highway right-of-ways,
approximately five miles .
Chairman Tomek asked what capital improvements Mr . White had
put in the park budget . Mr . White said the extension of the
park road and re-do the existing parking lot and the rest
will be for chemicals . Chairman Tomek asked Mr . Norwood

what the budget looked like. Mr. Norwood said he has not had
a chance to look at it or review it with Mr . White yet .
Mrs. Zeeb asked Mr. White if he still had the list of things
to do in the park. Mr . White said yes, but this is
maintenance not capital .
CITIZEN PARTICIPATION: There were no citizens present at
this meeting .
GENERAL DISCUSSION: Mr . Emsoff wanted to know if there was
a better entrance for Valentine Park. Mr . Emsoff said he
has talked with the owners of the houses on Ballard and
Birmingham and they are remodeling these homes. Mr . Emsoff
also stated there is a drainage ditch that goes into this
area, would it be possible to put in a pipe and lay a road
over the top of this drainage area. The Board requested
that Mr . White have Mr . Homeyer look at this area and see if
this could be done and give an approximate cost .
Mrs. Albin wanted to know if and when sub-divisions are put
in, do the developers have to address drainage. Mr . Norwood
said yes.
Chairman Tomek requested that the sections of the sub-
division ordinance pertaining to the parks be given to the
board members at the next meeting .
Chairman Tomek stated at each meeting the board should
discuss what they want to see done during that month and
then Mr . White can give a report the following month on what
was accomplished .
Mrs . Zeeb stated that each member of the board should have
an area to work on during the year . Mrs . Zeeb also voiced
her concern about not having a beautification program for
developers.
Mr. Glenn said maybe a joint meeting with the Planning and
Zoning Commission would help to get this beautification
program started.
Chairman Tomek asked what the board wanted done in the park
during this next month. Mr. Emsoff said to get the people
informed . Chairman Tomek said yes, but we need to get some
things done in the park. Mr . White said we are painting the
concession stand and trim on Akin Pavilion at this time.
Chairman Tomek asked Phillip Bounds to make a list of things
he wants to see accomplished this month. Chairman Tomek
asked Mr . Burge when he could start the hydromulch program
at the park. Mr. Burge said anytime. Chairman Tomek
volunteered to stay in touch with this project of getting
the hydromulch done in the park.
Mrs . Albin and Mr . Glenn volunteered to work on the Citizens
Awareness Committee. Chairman Tomek also requested that
this be a discussion item on the next agenda.

PLANNING AND ZONING MEETING
JULY 17, 1989
MINUTES
The Planning and Zoning Commission of the City of Wylie met
in regular session on Monday, July 17, 1989 in the Council
Chambers of the Municipal Complex . A quorum was present and
notice of the meeting had been posted in the time and manner
required by law. Members present were Chairman 8rian
Chaney, Vice Chairman Bart Petticord, Bobby Jennings, Bobby
Skipwith, and Cecelia Wood. Jim Ferguson was on vacation.
Staff members present were Code Enforcement Officer Roy
Faires, City Engineer Ron Homeyer , City Secretary Carolyn
Jones and Secretary Debbie Fletcher.

OF_MINUTES__OF__THE__JUNE__19TH__MEETING�
Chairman Chaney said on page one, second to last paragraph,
last line "fine" should be changed to "fines" . Cqairman
Chaney also stated that on page one, last paragraph, "has
agreed" should be "has tentatively agreed" . Bart Petticord
said on page three, top line, "illuminating" needs no be
changed to "eliminating" . He also mentioned that on the
third page, the third paragraph , second line, "Mr . Norwood
aid" needs to be corrected to read "Mr . Norwood saiC " . Bart
Petticord added that on page four, the first paragraph,
fourth line, "have been" should be "we have been" . He also
stated on page four, second paragraph, second line, " It
want " should be corrected to say " It won' t" . Also on page
four , second paragraph, line five, "getting state" needs to
be changed to read "getting the state" . Continuing with
corrections on page four , second paragraph, line nine, "but
it" should be "bm if " . Cecelia Wood made a motion to
approve the minutes for the June 19, 1989 meeting with the
noted corrections. Bart Petticord secondcd the motion . The
motion carried with all in favor.
Mr . Faires, Code Enforcement Officer stated that in regards
to page four, GENFRAL__DISCUSSION, he has ordered several
Emergency Preparedness booklets. Chairman Chaney said this
sounds good, there are severe] plans such as this and this
will give us an opportunity to look at several of them, and
make us aware, then we can decide which would be best for
US.
ELECTION_OF_CHAIRMAN_OF_THE_BOARD_OF_THE_PLANNING_AND_ZONING
COMMISSIOS Bobby Skipwith made a motion to reelect Brian
Chaney as Chairman of the Planning and Zoning Commission.,
Cecelia Wood seconded the nzmination. The motion was
carried with all in favor. Chairman Chaney thanked everyone
for their support .
ELECTION_OF__VICE_CHAIRMAN__OF_THE_BOARD_OF_THE_PLANNING_AND
ZONING_COMMISSION� Bobby Skipwith made a motion to reelect
Bart Petticord for Vice Chairman of the Planning and Zoning
Commission. Cecelia Wood seconded the nomination. The
motion was carried with all in favor. Vice Chairman
Petticord thanked the members.
CONSIDERATION_OF_REPLAT_OF_LOTS_1�_2�_3�_4�_AND_5_BLOCK_A_OF
STONE_GROVE__PHASE_1__FOR_CITY__COUNCIL� City Engineer, Ron
Homeyer said we will be making four lots out of five to
accommodate prospective buyers. 3A and 2A common property
lines are not radial with the curve. To simplify matters,
the best option is to deviate from the ordinance with a non...
radial lot line. All other requirements have been met.
Bobby Jennings asked if homeowners in the sub-division were
notified of thc replat. Is notification necessary? Roy
Faires answered by stating that it is not a requirement of
sub-division regulations, only in zoning matters is
notification required.
In this case, all you have to do is amend the planned unit
development. This is not a standard sub-division, it is a
planned unit development. Therefore, you can do anything
with it you want to do.
Bobby Jennings asked what is the purpose of the ordinance
stipulating the lot line has to follow the curve' Mr .
Faires said it is to assure us of having adequate front yard
width at the building line. Chairman Chaney added that it
also makes setbacks come out orderly. Bart Petticord said
the staff recommends this without reservations. Motion was
made by Mr. Petticord to recommend to the City Council the
approval of the replat . The motion was seconded by Bobby
Jennings. The motion carried with all in favor.
DUTIES_AND__RESPONSIBILITIES_OF__THE_BOARD� Chairman Chaney
suggests that tonight they do a broad, general overview on
what Board members feel is critical . These items will be on
the agenda for discussion at the next and future meetings.
It might be best to discuss one topic at each meeting
instead of several to kecp us on track and to help the Board
members find out what most concerns the Council . The items
of major concern to the Council will be discussed first and
the items of least concern will be discussed last . It might
take several months to complete these discussions. Mr.
SVipwith suggests for us to wait for Jim Ferguson and new
members before starting discussion of specific items.
Chairman Chaney suggests senior Board members state items
needing clarification ,.
Mr . Faires sazd a good item for discussion would be the new
Flood plan maps which includes all of Collin County. The
maps show you everything which has been annexed into the
City of Wylie. Mr . Faires said it might be as long as two
to three months before the map is available.
Mrs. Wood suggests future discussion of ordinances and sub-
division ordinances. Possibly a quick run through as to why
and the reason behind the ordinance. This should help the
members of the Board to better understand the ordinances.
Chairman Chaney said ETJ would be a good general discussion
topic to discuss at the next meeting. ETJ seems to be what
has caused the most trouble. Then at the meeting after next
another topic will be discussed. Chairman Chancy stated
that Mr . Faires will soon have the information of different
types of Emergency Plans through the Federal Emergency
Management Administration (F. E. M. A. ) .
Mr. Faires said Mr . Norwood addressed the Council at the
last meeting about the idea of a Super Committee to take
care of the master plan, planning and parks for the future.
Roy Faires said in further discussing this with Mr' Norwood,
that he suggested sub-committees off Lhe Planning and Zoning
Commission might work best and Mr. Norwood agreed. The sub-
committee would then report back to the Planning and Zonjrg
Commission, with information for the entire Board before
going on to Council . Mr. Faires suggested the Board members
start thinking of what item you want to have the most input
nn.
Mr. Jennings asked if there was a master plan for the city.
Mr . Faires said we have two maps which shows land use.
Bobby Jennings said he would like an opportunity to see the
land use map .
GENERAL_DISCUSSION� Mr. Skipwith mentioned on W. A. Allen
Drive and Foxwood he noticed paper blowing everywhere from
roofers working in the area. He asked if the City has ever
considered having builders throw trash in a designated area?
Mr. Faires said this would be difficult to enforce with the
present level of staffing.
Mr. Petticord asked on new development, the main entryway
into a sub-division, is there a way to amend the ordinance
so that streets can be half again as wide as other streets?
Cars are parked on both sides of the street and its next to
impossible for two cars to get through. Chairman Chaney
said this is an item that will be discussed at a future
meeting.
There being no further discussion, a motion was made by Mr .
Skipwith to adjourn, seconded by Mr . Petticord. The meeting
was adjourned with all in favor .

MEETING - MINUTES LUl
JUNE 29, 1989
The Wylie Historical Commission met on Thursday, June 29,
1989 at 7 :00 P.M. in the Council Conference Room at the
Municipal Complex.
Chairman John Spillyard opened our meeting with the Roll Call .
Present were : John Spillyard, Ellen Smith, Gail Clemmons ,
Agnes Dempsey, and Patricia Guess.
The resignation of Karen Cain was accepted and alternate-Beth
Fultz will fill her position.
Accounts were given of accomplishments made the last two
weeks from Committee Chairmans on each project listed in
Minutes of June 15, 1989.
The Historical Commission has been asked to participate in
Wylie Jubilee Celebration on July 15, 1989 , was voted on an
agreed to do so.
Committee discussed MATERIALS needed in future in order to
carry on business operations for 1989 and will be presenting
this to City Council soon.
Attached you will find Names , Adresses , and Phone Numbers
of all members, if at any time we may be of any assistance
pleasefeel free to call on us .
We the members wish to express our appreciation to Beverly
Fulkerson for her Publicity in the Wylie News and The Sen-

THIS AGREEMENT, by and between DONALD KREYMER _-And the
CITY OF WYLIE, TEXAS, is entered into this day of
June, 1989.
WHEREAS, the CITY OF WYLIE~ TEXAS, (herejnafter
referred to as "the City" ) has had cause to cite DONALD
KREYMER for various violations of the 5ode of Ordinances of
the City of Wylie includzng, but no7 limited to, junked
vehicles, substandard housing , electrical wiring, ursanitary
premises and unsightly grass and weeds: and,
WHEREAS, DONALD KREYMER has been found guilty of such
charges in the Municipal Court of the City of Wylie and has
appealed the convictions to the Collin County Criminal
Court ; and,
WHEREAS, DONALD KREYMER is in continuing violation of
the Code of Ordinances of the City of Wylie; and, therefore,
The CITY OF WYLIE and DONALD KREYMEF do hereby enter
onto the following agreement:
First : All fines oweo �or existing convictions shall
be reduced tc a total of Fiftoer Hunored Dollars ($1500. 00)
and this amount shall be paid in full to the CITY OF WYLIE,
TENAS; coinciding with the sinning of this agreement .
Second: DONALD KREYMER agrees to tear down the houses
located at 509 S. Jackson, 401 N. Jackson, 108 North Fifth
Street and 306 N. 1st Street , within 30 days from the
signing of the agreement , at his own expense.
Third: DONALD KREYMER agrees to remove the rubble,
debris and material from each house, one each month,
beginning in July, until the remnants from all four (4)
houses are removed. All the remnants must be compIetely
removed by October 31 , 1980.
Fourth: The [70 Bo.iloing Irsoectzr shall have thi.
final authority to determine whether removal has been
accomplished in a satisfa7tory manner and shall have
authority to require KREYMER t5 complete such removal '

Fifth: The CITY OF WYLIE, TEXAS, agrees to refrain
from citing DONALD KREYMER for any Code violations
pertaining to the above-mentioned four structures during the
period of time agreed upon to remove the �our houses in
question.
Sixth: DONALD KREYMER hereby agrees to indemnify and
hold harmless the CITY OF WYLIE, TEXAS, from any damages,
losses, injuries, or legal liability occurring from or
arising from the standard rubble, debris and materiel from
any damages, losses, injuries, or legal ! : ability occirring
f,om or arising from the standing rubble, debris and
material from any Of the houses which have been torn down
but not removed.
Seventh: Should DONALD KREYMER fail to perform any or
all of the obligations under this Agreement , then he shalI
oe deemed in default of this agreement and the CITY OF WYLTE
shall proceed with the prosecution of Code violations as it
deems fit.
Eighth: Both parties agree that in the event tha7 a
part or parts of this agreement is found to be invalid in
any court of competent jurisdiction, all other provisions
shall remain in full force and effect.

amended in part as follows:
"SECTION 2. APPLICATION FOR LICENSE.
a. . . . . In making such application, the person xn caking same shall
also state at the end of the application that the carnival, and each
and all of the shows, attractions, and exhibits --therein, will be
conducted in a decent, orderly and law abiding - manner and in
accordance with state law and the codes and ordinemences of the City
of Wylie. The form of such application shall inc ode an agreement
to be executed by the applicant that the applicars will indemnfiy
and hold harmless the City of Wylie, its agents, c =`ficers, servants,
and employes from any claim, cause of action, or - judgment arising
out of or in any way connected with the operation n of the carnival
within the City limits on public or private prooerty during the
effective dates of the license. With the applicat1 ion, the applicant
shall furnish proof that applicant is covered by _ a valid property
damage and public liability insurance policy in the a sum of not less
than One Million Dollars ($1,000,000). In this conmeection, applicant
shall furnish a copy of the policy in effect, ::together with a
certificate that such policy is current and in effi:ect and will not
expire or be canceled prior to the ending date of a license period.
b. Approval of Application. . . . .
ARTICLE II. COIN-OPERATED MACHINES.
SECTION 1. DEFINITION OF TERMS. As used in this artic:.t-e, the following
words and phrases shall have t,.e meanings respectively ascribed to .-:.nem:
c. Operator. "Operator" shall mean and include any person, firm,
company, association, or corporation who exhibits, displays, or
permits to be exhibited or displayed, in a place of business other
than his own, any "coin-operated machine" in this City.
d. Owner. "Owner" shall mean and include any person, individual, firm,
company, association, or corporation owning any "coin-operated
machine" in this City.
SECTION 2. ANNUAL OCCUPATION TAX.
a. There is hereby levied an annual occupation tax of Seven Dollars
and Fifty Cents ($7.50) for each and every coin-operated machine
as defined herein. Every owner who owns, controls, possesses,
exhibits, displays, or who permits to be exhibited or displayed, in
this City any coin-operated machine shall pay such tax; provided,
however, that nothing herein shall prevent the operator of such
machine from paying the tax required by this article for the account
of the owner, but the payment of such tax by such operator or
other person shall not relieve the owner of the responsibility of
complying with all the provisions of this article.
b. Payment of Tax.
(1) The tax levied hereby shall be paid to the Tax Assessor-
Collector who shall issue a receipt.
(2) The receipt shall be attached to the coin-operated machine
mentioned in the receipt and shall bear the serial number of
the particular machine.
(3) It shall hereafter be unlawful for any person to operate,
exhibit, or display or permit the exhibition or display of any
coin-operated machine in the City without having-attached
thereto a receipt issued as provided herein, and no receipt
issued for a certain coin-operated machine shall be
transferrable to any other machine.
c. Exemptions from Tax. All gas meters, pay telephones, pay toilets,
food vending machines, confection vending machines, beverage
vending machines, merchandise vending machines, stamp vending
machines, and cigarette vending machines and service coin-operated
machines are expressly exempt from the tax herein and the other
provisions of this article.
d. Failure to Pay Tax. Every coin-operated machine subject to the
payment of tax herein, and upon which the tax has not paid as
provided herein, is hereby declared to be a public nuisance and may
be abated as provided by law.
•SECTION 3. PROXIMITY TO SCHOOLS. No skill or pleasure coin-operated
machines shall be permitted within three hundred =0) feet of any school building in
this City.

SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance
be, and the same are hereby, repealed and all other ordinances of the City not in
conflict with the provisions of this ordinance shall remain in full force and effect.

SECTION 3.
Should any paragraph, sentence, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall
not affect the validity of this ordinance as a whole or any part or provision thereof,
other than the part so declared to be invalid, illegal or unconstitutional.
SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance,
as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in
the Municipal Court of the City of Wylie, Texas, shall be punished by a fine not to
exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every
day any such violation shall continue shall be deemed to constitute a separate offense.
SECTION 5.
This ordinance shall take effect immediately from and after its passage and the
publication of the caption, as the law and charter in such cases provide.

I have received and reviewed the attached invoice for the
engineering services on the Birmingham and Stone street
reconstruction project and found it to be appropriate. The
invoice provides for the preparation of "As-Built" construction
drawings , miscellaneous construction staking services and final
project administration services.
Attached is an itemization of all of the engineering costs and
related services as provided in the contract. The construction
staking, geotechnical services and the prints exceeded the
estimated amounts in the contract by a small amount. The excess
geotechnical expense was due to additional field time of the
project coordinator caused by mis-communication between him and
the city. The geotechnical services were billed directly to the
city inorder to avoid the handling charge which is administered
for additional services at the recommendation of Michael
Cummings. The excess construction staking cost was caused by the
Lone Star Gas line replacement delay which required much of the
construction staking to be performed twice. The excess amount of
printing costs was due to the number of construction plan sheets
along with the large number of bidders on the project.
Therefore, I recommend the final payment of $3, 539. 00 to Cummings
& Pewitt, Inc. for engineering and construction staking services
on the Birmingham and Stone Street Reconstruction Project.
