CALL TO ORDER
Vice-Chairman Ames called the meeting to order at 7:00PM. In attendance with Vice-
Chairman Ames was Commissioner Gregg, Commissioner Bennett, Commissioner
Goss, Commissioner Hemphill and Commissioner Onufreiczuk; Chairman Larson being
absent.
Staff members present were Renae 011ie, and Mary Bradley.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Hemphill gave the invocation and Commissioner Bennett led the pledge
of allegiance.
CITIZENS COMMENTS
No one approached the Commissioners.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the August 15,
2006 Regular Meeting.
A motion was made by Commissioner Hemphill, and seconded by Commissioner
Bennett, to approve the minutes from August 15, 2006, regular meeting. Motion passed
4 — 0 - 1, with Commissioner Onufreiczuk abstaining and Chairman Larson and
Commissioner Goss being absent.

ACTION AGENDA ITEMS
1. Consider a recommendation to the City Council regarding a Replat
for Woodlake Village Block C, Lots 1 R-3R2R & 1 R-4RR to abandon
an access easement on Lot 1 R-4RR and plat an existing easement
that was constructed on Lot 1 R-3R2R. Property located at 2010 &
2014 Hwy 78 N.
Ms. 011ie stated that the applicant is replatting the previously platted lots to abandon an
access easement on Lot 1 R-4RR and plat an existing easement that was constructed
on Lot 1 R-3R2R. An existing retail center occupies Lot 1 R-3R2R, with a proposed
carwash to occupy Lot 1 R-4RR.
With no questions for the applicant or staff, a motion was made by Commissioner
Gregg, and seconded by Commissioner Bennett, to recommend approval for the Replat
of Woodlake Village Block C, Lots 1 R-3R2R and 1R-4RR, located at 2010 and 2014
Highway 78 North. Motion carried 4 — 0, with Commissioner Goss and Chairman
Larson being absent.
2. Consider and act upon approval of a Site Plan for Wyndham
Estates Ph 3, Lot 8R for a 3,711 square foot office/warehouse
building on .349 acres, located at 205 Windco Circle.
Ms. 011ie stated that the applicant is proposing to develop a single story
office/warehouse building on one lot. The lot is .349 acres in size. The proposed
building totals 3,711 square feet.
The subject property has been platted since 2003 as Lot 8R of the Wyndham Estates
Phase 3 Addition. This area is currently zoned Light Industrial (LI) District.
With no questions for the applicant or staff, a motion was made by Commissioner
Bennett, and seconded by Commissioner Gregg, to approve the Site Plan for Wyndham
Estates Phase 3, Lot 8R for a 3,711 square foot office/warehouse building on .349
acres, located at 205 Windco Circle. Motion carried 5 — 0 - 1, with Commissioner Goss
abstaining, and Chairman Larson being absent.
DISCUSSION
1. Discussion regarding when a denied zoning change request can or cannot
be reconsidered for approval.
Ms. 011ie stated that a request was made by some of the Commissioners to interpret
when a zoning petition can return once denied. Distributed within the Commissioners
packet is an excerpt from the Zoning Ordinance, and some options for the
Commissioners to have staff submit revisions to the Zoning Ordinance.
Commissioner Bennett stated that when a zoning request is denied with prejudice, and
the applicant comes back the next month, and says it is different; does the staff decide
whether it is put on the agenda or not. Ms 011ie stated that P&Z will make that decision

if it comes back. The options given in the hand out are not in the Ordinance, but the
Commission may recommend that the Ordinance is revised to include the options. One
of the options is for staff to review and make the decision that the zoning petition is
substantially different, then put it on the agenda. Or, the Commission may opt to review
the revised zoning petition through a work session, and determine if the rezoning can be
resubmitted or not.
The consensus of the Commissioners agreed to recommend revising the Ordinance to
include that if a zoning petition is denied with prejudice, the applicant may request a
work session with the Commissioners to determine if there are substantial changes to
the requests and to voice opinions in an open forum. Ms 011ie stated that staff can draft
the wording and then continue to look within the Ordinance to see if there is something
to allow us to interpret it like this as it is; as opposed to having to re-write the Ordinance
with the option for a work session to be included.
ADJOURNMENT
A motion was made by Commissioner Onufreiczuk, and seconded by Commissioner
Goss, to adjourn the meeting at 7:20PM. Motion carried 6 — O.
