AGENDA SUMMARY TUESDAY, JANUARY 14, 1986 ITEM NO. 1 - APPROVAL OF MINUTES - No additions or corrections . ITEM NO. 2 - CALL FOR CITY ELECTION - This is the formal action of the Council , required by law, which enables the City to hold the election of public officer ' s. The City Secretary will have information at the meeting providing an election calendar and other pertinent material . There have been some changes in the dates for sign-up and the cut-off date for sign-up this year, so pay particular attention to the material provided . ITEM NO. 3 - AUTHORIZATION FOR CITY MANAGER TO HOLD BRIEFING SESSION - This is the session we have held the past two years to brief candidates on general questions about the City and to answer their questions about the workings of the City . Your authorization is necessary for this session to be held . This year we will hold the session in the Library on February 22 from 9 : 00 AM to 12 :00 Noon. ITEM NO. 4 - APPOINTMENT TO ZONING BOARD OF ADJUSTMENTS - A vacancy has been created by the resignation of Mrs . Anna Starnes . State law mandates five (5) members and two (2) alternates for the Zoning Board of Adjustments . ITEM NO. 5 - PUBLIC HEARING ON ANNEXATION OF DISCOUNT BAIT HOUSE - This property is described as 1 .04 acres out of the Francisco de la Pina Survey , Abstract 688 and is located on SH78 directly adjacent to "Steaks Over Texas" . The Planning & Zoning Commission heard this petition at their last meeting and recommend approval . ITEM NO. 6 - PUBLIC HEARING ON ANNEXATION OF 51 ACRES ON HOOPER ROAD - This property is described as 51 .53 acres out of the Wm. Sachse . Survey , Abstract 835 and is located on the west side of Hooper Road , adjacent to Regency Business Park. The property owner is B. C. Wood . The P&Z recommends approval of this petition . ITEM NO. 7 - PUBLIC HEARING ON ANNEXATION OF 150 ACRES ON SH78 - This property is described as 143 .692 acres out of the R . D. Newman Survey , Abstract 660 and 7 . 297 acres out of the H . J . Hardin Survey , Abstract 438 . This property is adjacent to the George Lewis property , annexed some months ago and which is in fact a part of this complete parcel . The owner is the Louis Reese Co . This property is in the area that is in dispute between the cities of Wylie and Sachse . The property owner has advised the City of Sachse of their actions to petition annexation into Wylie . We may expect to hear from Sachse relative to this annexation as well as another which appears later in this agenda . The P&Z heard this petition and recommend approval . ITEM NO. 8 - PUBLIC HEARING ON ANNEXATION OF 23 ACRES ADJACENT TO THE HARVARD PROPERTY - This property is described as 12 . 5168 acres and 3 . 7014 acres out of the R. D. Newman Survey , Abstract 660 ; 2 acres out of the H . J . Hardin Survey , Abstract 438 and 5 acres out of the I . Clifton Survey , Abstract 193 and totals 23 . 2182 acres . It is located adjacent to the Harvard property , just recently annexed . The owner is John Robinson . The staff wrote inviting Mr . Robinson to annex this property and heard nothing from him. Subsequently, we made the decision to annex the property involuntarily in order to place other property , whose owners desired annexation, into contiguity and wrote advising Mr . Robinson of this fact to which he did respond by signing voluntary annexation papers and a zoning request . The P&Z recommends approval . As a point on interest , Jim McKnight of Kreymer Cos . , today filed a 1 petition for annexation of the 7 acre tract that was a part of the original tract known as the Harvard tract , so that area is solidifying . ITEM NO . 9 - PUBLIC HEARING ON ANNEXATION OF 149 ACRES WEST OF SH78 - This property is described as 149 .6546 acres out of the H . J . Hardin Survey , Abstract 438 and the R . D . Newman Survey , Abstract 660. It is located west of SH78 across from Century Business Park and directly adjacent to the property described above . The owner is Mr . Dingban Wang . Here again , we may hear from the City of Sachse . Mr . Wang ' s representatives have advised Sachse of their intention and desires . The P&Z recommends approval . ITEM NO. 10 - PUBLIC HEARING ON ANNEXATION OF 4 ACRES ON SH78 - This property is described as 4 acres out of the Francisco de la Pina Survey , Abstract 688 and is located at the Southeast corner of SH78 and Eubanks Lane. The P&Z recommends approval . ITEM NOS. 11-14 - PUBLIC HEARINGS ON THE NEXT ROUND OF LAKE ANNEXATIONS - This is the next round of lake annexations and they are described as No .8 , 754.34 acres out of the D. Farmer Survey , Abstract 303 ; No. 9 262 . 34 acres out of the W. Bell Survey , Abstract 37 ; No . 10 , 2628 .43 acres out of the price M. Carr Survey , Abstract 175 , the John Kirby Survey , Abstract 515 , the T. Roberts Survey , Abstract 781 and No . 11 , 27 . 7 acres out of the S . M. Ranier Survey , Abstract 740 . The P&Z recommends approval . ITEM NO. 15 - PUBLIC HEARING ON RE-ZONING OF 0.4496 ACRES ON SH78 - This property is described as 0 .4496 acres out of the S . B . Shelby Survey , Abstract 420. It is located on SH78 and is the site of Wylie Auto Parts . The request is for a change from Retail to B-1 zoning , which is a more appropriate zoning . The P&Z recommends approval . ITEM NO. 16 - APPROVE ZONING ORDINANCE FOR 0.4496 ACRES ON SH78 - See comments above . ITEM NO. 17 - FINAL PUBLIC HEARING ON REVENUE SHARING BUDGET fhe sheets in your packet reflect the earnings from Revenue sharing and the proposed budget for the expenditure of these funds . However , we do want to make you aware that a bill now under consideration in Congress may cause revenue sharing to cease almost immediately . ITEM NO. 18 - APPROVE INTERIM ORDINANCE FOR FARMER' S ELECTRIC - This ordinance , received from the PUC , is only for an interim period establishing rates for Farmer ' s ilectric in the City of Wylie . This ordinance will only establish rates until the PUC can end it ' s hearings and make a recommendation . We need to go ahead and pass this interim ordinance because time has run out and if we fail to approve the interim, Farmer ' s Electric would be entitled to enact the full effect of the original rate requested by a default action . ITEM NO. 19 - APPROVE ORDINANCE OF ABANDONMENT - At the time of this writing , we had not received , from the City Attorney , the actual ordinance , which he is drafting. Several months ago , the Council voted to abandon , at the request of the property owners , the curved road section that connects Masters Street and Fifth Street . Our City Attorney advised us that an ordinance of abandonment was required and that ordinance must be approved and the Mayor , or Mayor Pro Tem, authorized to sign it , by the City Council ; thus , this item appears on the agenda. ITEM NO. 20 - APPROVE CONSTRUCTION PLANS - REGENCY BUSINESS PARK, PHASES 2&3 - The appropriate staff members have reviewed these plans and have determined they meet the 2 City ' s subdivision and engineering standards and thus recommend approval . The P&Z recommends approval . ITEM NO. 21 - APPROVE CONSTRUCTION PLAN FOR OFFSITE WATER AND PERIMETER STREETS IN SOUTHFORK MHP - The staff has reviewed these plans and have determined they meet the City ' s standards and place them before for approval . ITEM NO . 22 - AWARD BIDS FOR COPIERS - Staff recommends the award of hid to Xerox for the City Hall copier . We recommend the 1048 at $10 , 585 .00 plus set-ups and supplies to he purchased on a lease/purchase agreement . Second , we recommend the award of bid to Innovative Office Supply Canon viP2436 in the amount of $9 , 191 . 00 , plus set-ups and supplies , to be purchased on a lease/purchase agreement . This will be the Engineering copier that will make 24x36 reproductions , which is the standard size for plats and submissions to the City . We believe that this item will facilitate the distribution of information among the staff employes and boards , while at the same time becoming a small producer of revenue for making duplications for other service units as well as local developers . In short , we believe in the long run , this unit will about half be id or by outsiie purchase of copies . ITEM NO . 23 - AWARD BID FOR AIR COMPRESSOR - This bid came Lock in at some2500 plus over the amount that was originally estimated . It is my belief that the reason this occurred , is because the Fire Chief handled the hid specification process himself and messed it up . Without ,__, Lending to , he played into the bidders hands by allowing the bidder to spec into the hid some additional bells and \„:istles ; however , I have reviewed the intended purchase and there is nothing wrong with what they have added , it is just more than we had intended to purchase . The budget does have adequate funds to cover this additional amount . It simply means that he will be authorized to buy that much less other equipment . I would recommend award of the bid because we need the item, and a gentle scolding or reminder that he work more closely with City Hall in the future on his bids and that he better estimate the cost of his bidded items . ITEM NO. 24 - AUTHORIZATION TO ACCEPT BIDS FOR ANIMAL CONTROL TRUCK - This item is in the budget for this year and will provide a new chassis to go under the animal control cage box_ . ITEM NO . 25 - GRANT UTILITY EASEMENT TO T.P. & L. This is an oicial grant of easement to TP&L to place the poles for lighting in the Community Park that are really already in ic:lce . Staff obviously recommends approval . ITEM NO . 26 — APPROVE LEASE/RENTAL AGREEMENT ON BACKHOE — We have an opportunity to purchase a good used backhoe from Mahaney International of McKinney for approximately $650 .00 per month for 24 months on a lease/purchase . This equipment appears to be in good shape and carries the staff recommendation for your approval so that our backhoes would not have to spend so much time going from one location to For example , it has been very difficult to keep the lift station crew and the street crew working because _;ring this last winter period we have had so many water and sewer breaks and stoppages not to mention a sharp here-_use in taps . This third backhoe would have each major crew with their own backhoe . While I would not feel comi_ortaele recommending the purchase of a new unit , I feel this purchase will more than pay for itself in lost time and :: licit ncy . hr . Windham will be happy to answer any questions you may have at the meeting . 3 ITEM NO . 27 — AUTHORIZE RENTAL/TRADE OF MOTORGRADER — Our oLnr ,r der has bit the dust . It is approximately 45 years old and was 20 some years old when we bought it . So one not nny we have not gotten our money ' s worth . However , last year we had to spend several thousand dollars on it and „ ,e increased repair bills continue to occur . The item that is out now is not even available and would have to be rinnted from raw metal . In looking for a remedy for this dilemma , we discovered a gentleman in the area who actually i :yes our Hotor, rjder (sarnum was right) and is willing to take our unit in trade and give us a unit that is only r<,'.'.n _rely seven years old . "vie have worked with this new unit for approximately two weeks and find it to be so isiactory . One should remember that even if this new unit needs repair , at least the parts will be available . jhis swap can be arranged for approximately 4000 . 00 which is about 1/3 of the estimate of the cost to repair our old ,; .t . ITEM NO. 2 - DISCUSS PLANS FOR COMING YEAR - Mr. Windham informed the board that last week Mr. White and his helper had made some improvements at the library setting out shrubs and trees . It is starting to look like a park and library: Mr. White is following the guidelines submitted to the city council some time ago. The city council decided to do it as you can. Mrs. Sewell asked if the lights are up? Mr. Morgan said that they had been up since November. Mr. Windham passed out site plans of the park property to show where the property lays and also for the board members to take home and work on where you would like the next things to be put. Mrs. Sewell asked if we had checked on the place on the hill ; the childrens home? Mr. Hale stated he had stopped by there and the person that we needed to notify was in Dallas. Derek Ammerman stated that he talked to Tren in reguards to the 4th baseball field. He has gotten some donations for the field. What we need to do is see prices on what it would take to do. He wants to get some tournaments going for the springtime. Mr. Windham stated that we have prices on doing the rest of the fence. If we can get the prices on dug-outs and lighting so that we could turn them over to Tren. Mr. Windham stated that Mr. White has begun planning on expanding the playground. We have a couple of items he has made in the shop. We intend to start getting the cost to cover the five picnic tables with _just the post and cover. Mr . Morgan asked if the metal door for Akin Pavi l l i on could be brought up in this meeting. After a discussion on the door- , Mr. Windham stated that we would get prices and install the door. Mr . Morgan asked if we elect officers at this time of year? Mr . Windham checked the charter and said it was in July that election is done. Mr . Morgan asked what happen to the motion we made in reguards to having possible funds from the state? Mr. Pappas stated that the impression he got was slim to none. There was some misunderstanding that the last thing that was funded was in a phase and all we had to do was reapply and get the rest of the phases; which is not the case. There is money available and what the state like to do is use the money on a matching bases so it would go further. Where they like to use it in where there is a clear cut example, they are providing new park areas. With all that in mind , it seemed like the best time for us to try and get funding is when we received the 200 acre park below the dam. In the states mind that would be bringing on a new park of a different type. With the three big items that we would like to put at the Community park it would be best to handle it by a bond issue. Mr. Windham stated that the new park signs for Stone Road are in and at this point we are waiting for the break away poles that the state requires to put them up. WHEREAS , the City Council of the City of Wylie , Texas , finds that the hereinafter described territory is contiguous and adjacent to the corporate limits of the City of Wylie ; and WHEREAS , the City has prepared a service plan for the area , a copy of which is attached hereto as Exhibit "A" ; and WHEREAS , after notice was duly given , public hearings on the proposed annexation were held by the City Council all in compliance with Article 970—A , Vernon ' s Annotated Civil Statutes of the State of Texas ; and WHEREAS , the City Council has concluded that such area should be annexed into and made a part of the City of Wylie , Texas : NOW, THEREFORE , BE IT - ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE , TEXAS : SECTION 1 . That the following described territory be , and the same is hereby , annexed into and made a part of the corporate limits of the City of Wylie , Texas , and the same shall hereafter be included within the territorial limits of said City , and the inhabitants thereof shall hereafter be entitled to all rights and privileges of other citizens of the City , and shall be bound by the ordinances , acts , resolutions and regulations of the City of Wylie , Texas . Said territory hereby annexed being described as follows : 12 . 5168 acres (Tr . 42-9 ) and 3 . 7014 acres (Tr 39) out of the R . D . Newman Survey , Collin County Abstract 660 ; and 2 acres (Tr 7 ) out of the II , J . Hardin Survey , Collin County Abstract 438 ; and 5 acres (Tr 11 ) out of the I , . Clifton Survey , Collin County Abstract 193 for a total of 23 . 2182 acres . SECTION 2 . It is the intention of the City to annex only that territory which is legally subject to being annexed by the City and should any portion of the above described territory be not subject to legal annexation by the City of Wylie , Texas , such fact shall not prevent the City from annexing such portion of said territory which is subject to leSal annexation by the City of Wylie , Texas . WHEREAS , the City Council of the City of Wylie , Texas , finds that the hereinafter described territory is contiguous and adjacent to the corporate limits of the City of Wylie ; and WHEREAS , the City has prepared a service plan for the area , a copy of which is attached hereto as Exhibit "A" ; and WHEREAS , after notice was duly given , public hearings on the proposed annexation were held by the City Council all in compliance with Article 970—A , Vernon ' s Annotated Civil Statutes of the State of Texas ; and WHEREAS , the City Council has concluded that such area should be annexed into and made a part of the City of Wylie , Texas : NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS : SECTION 1 . FOR A RATE INCREASE OF TEXAS INTERIM RATE ORDER A hearing was held in this proceeding on November 26, 1985, at which evidence was received pertaining to the request of Farmers Electric Cooperative, Inc. (Farmers) for an increase in rates. Farmers was represented by Campbell McGinnis, and the staff was represented by Alfred Herrera. Harold Crisswell , who has been granted intervenor status as the representative of a customer group, was not present at the hearing. After convening the hearing to take appearances, the examiner recessed at the request of the staff and Farmers so they could discuss a settlement of the case. After negotiations off the record, the hearing reconvened, and the staff and Farmers announced that they had achieved a settlement and would file a joint stipulation disposing of all issues. According to Mr. McGinnis, Farmers will be able to complete the improvements to the system recommended by Staff Engineer Harold Hughes by the time the stipulation is filed. In addition, the staff and Farmers jointly requested that interim rate relief be granted. Farmers moved also that the Crisswell group be struck as intervenors. The examiner took under advisement the request for interim rates and denied the motion to strike the intervenors. On December 2, 1985, Farmers reurged its motion to strike on two grounds: (1) • The only relief the intervenor requested is outside the scope of this proceeding, and (2) the intervenors have failed to prosecute their interest. The examiner DENIES Farmers' motion to strike, noting that a person need only show a justiciable interest to become an intervenor; an independent plea for relief is not required. See P.U.C. PROC. R. 21.41. In this case, the Crisswell group became an intervenor and may remain an intervenor simply by protesting the rate increase as customers. At the examiner's request, Farmers filed, on December 2, 1985, a summary of evidence showing good cause for interim rates. Farmers notes three reasons: (1) the inadequacy of existing rates , (2) the agreement of the staff, and (3) the low level of the interim rates. As to the adequacy of existing rates, Farmers points out that for the 12 months ending June 1985, its rate of return had fallen to 7.03 percent, far below the staff-recommended 12 percent. Its equity has been declining, and for the 12 months ending June 1985, its TIER was less than 2.0. In addition, as Farmers notes , the staff has strongly urged the granting of interim rate relief that would support the revenue requirement recommended by the staff in its prefiled testimony. With the rate design changes approved by the staff, the proposed interim rates are shown in Cooperative Exhibit 8. • The examiner is persuaded that interim rate relief is appropriate in this case. One, it has been proposed by agreement of the parties that participated in the hearing. Two, it has been recommended at the lowest level supported by the evidence. Three, the applicant in this case is a cooperative, and it is therefore in the member-customers' own interest to maintain its financial integrity. Last, it appears likely that the examiner will be unable to prepare a recommendation for final Commission action until next month, and granting interim rate relief will alleviate the adverse effect of the present rates, which are inadequate according to the staff testimony. Accordingly, the request of the staff and Farmers for interim rate relief is GRANTED, subject to possible refund when a final order is issued in this case. In accordance with its agreement with the staff, Farmers shall file proposed tariff sheets in four copies with the Commission tariff clerk within five working days of this Order. Unless the staff rejects the revised sheets within five working days of filing, they will be deemed approved as of December 1, 1985. If the proposed sheets are rejected, Farmers will have five days after notification to file amended tariff sheets with the same review procedure then to be repeated.
