RESOLUTION 1985-85-10-1
A RESOLUTION OF THE CITY OF WYLIE, TEXAS SUSPENDING THE
IMPLEMENTATION OF PROPOSED CHANGES IN RATE SCHEDULES FILED
BY FARMERS ELECTRIC CO-OP, A DVISION OF ENSERCH CORPORATION,
FOR A PERIOD OF NINETY (90) DAYS BEYOND THE DATE OF WHICH
SUCH SCHEDULES WOULD OTHERWISE GO INTO EFFECT:
WHEREAS, Farmers Electric Co-op, a public utility
under Article 6050 et. seq. V. A. C. S. and Article 1446c
V. A. C. S. (as amended) did on September 5, 1985 file a
notice of rate change request and statement of intent for
electric service within the City of Wylie to become
effective October 10, 1985, and
WHEREAS, The City of Wylie acting under its Home Rule
Charter the Constitution and Home Rule Statutes of the State
of Texas, does have authority to regulate public utility
rates, and
WHEREAS, after having reviewed the materials presented
to the City Staff and Council , it is the opinion of the City
Council of the City of Wylie that such schedule of rates
should be suspended for a period of ninety (90) days from
October 10, 1985, for further study, investigation,
presentation of evidence and a determination and findings of-
the PUC of Texas on Famers Electric Co-op' s system-wide rate
proposal currently under suspension by the Public Utility
Commission of Texas (PUC) for completion of the rate
hearings,
NOW, THEREEORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WYLIE, TEXAS:
Pursuant to Section 43 (d) of the Public Utility
Regulatory Act, the implementation of the Farmers Electric
Co-op proposed rate schedules filed with the City of Wylie,
September 5, 1985, is hereby suspended for a period of
ninety (90) days from October 10, 1985, for futher study,
investigation, presentation of evidence, PUC findings and at
least one public hearing.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS, ON THIS THE 1ST DAY OF OCTOBER, 1985.
